THE MINISTER OF LAW AND JUSTICE (SHRI M. VEERAPPA MOILY): Sir, I beg to move:

“That the Bill further to amend the Ancient Monuments and Archaeological Sites and Remains Act, 1958 and to make provision for validation of certain actions taken by the Central Government under the said Act, be taken into consideration.”

Sir, a nation’s cultural property commonly represented in the form of its artistic and architectural heritage is an inseparable part of its existence. It lives on through the generations of human existence. It stands as testimony to the various events of the past. It is in a sense age-less and seam-less. We are extremely lucky that India has world’s richest cultural heritage in the form of temples, forts, palaces, churches, mosques and various other historical monuments.

As socially and culturally conscious citizens mindful of our rich historical traditions, it is our duty to preserve these cultural monuments for their artistic and historic value and pass them to posterity. Article 51 (a) of the Constitution says:

“It shall be the duty of every citizen of India to value and preserve the rich cultural heritage of our composite culture.”

Hence, we, in fact, have to look forward as to how to preserve and protect these monuments. It was with this intention in mind and also acting on the judgments of the Delhi High Court in October, 2009 we promulgated the Ordinance and today we have come with a Bill replacing the Ordinance. It is an improvement over the Ordinance.

Several provisions have been strengthened because after the issuance of the Ordinance certain concerns were expressed and this Bill reflects the firm resolve of the Government to preserve, conserve and protect the monuments and sites. The provision relating to prohibited and regulated areas surrounding the protected monuments have been made stricter. Fresh constructions in prohibited areas have been completely banned through this Bill, including in respect of public projects coming up after detailed surveys and preparation of heritage bye laws have been provided for. This was not in existence. The establishment of a competent authority has been envisaged in this Bill. There will be a National Monuments Authority established to grade and classify the monuments which has not been there till today. The Bill also seeks to take some actions on the Central Governments projects and validate some of the recommendations and decisions taken by the earlier Advisory body. This Bill has been strengthened. Perhaps we are getting into a new domain of preservation and conservation so that even in the name of Government projects one cannot meddle national monuments. We need to attribute such kind of a sanctity so that posterity will not blame us. The Acts of 1904, 1952 and 1958 did not provide for prohibited and regulated areas. Only rules had been provided for in the Act of 1958 for prohibited and regulated areas. We have not incorporated this provision in the Ordinance and this Bill so that at no point of time in future there is any problem.

Sir, I would also like to bring to the notice of the august House that there was an occasion in the past when the even the Taj Mahal was auctioned! There are as many as more than 37 monuments which are missing. I think, that kind of a historical mistake will not be repeated if this Bill is approved. I seek the mandate of this House to pass this Bill because we are on the brink of creating history by passing this Bill.

श्री रमेश बैस (रायपुर): सभापति महोदय, सरकार जो यह बिल लाई है, वह अध्यादेश के रूप में लाई है। जबकि सरकार को मालूम था कि यह जनवरी में हुआ है और एक महीने बाद फरवरी में लोक सभा चालू होनी थी। फिर ऐसी क्या जरूरत थी, सरकार को इतनी जल्दी क्या थी कि वह इसे अध्यादेश के रूप में लाई। अगर सरकार की मंशा साफ होती तो जब 1958 का कानून देश में चल रहा था तो एक महीने में ऐसा कौन सा पहाड़ टूट जाता कि राष्ट्रपति के द्वारा इसे यहां अध्यादेश के रूप में लाया गया। चूंकि यह अध्यादेश से आता है तो स्थायी समिति में नहीं जाता। हम चाहते हैं कि यह मामला स्थायी समिति में जाए और वहां इस पर विचार-विमर्श हो। उसके बाद इस पर निर्णय हो। मैं इस अध्यादेश को प्रस्तावित कर रहा हूं, परंतु अध्यादेश के बारे में मेरे साथी श्री अर्जुन मेघवाल इस पर चर्चा करेंगे।

SHRI ADHIR CHOWDHURY (BAHRAMPUR): Sir, already the Minister of Law, Hon’ble Shri Moily, has introduced the Bill wherein he has dipicted indicated the entire background which has necessitated the Ordinance.

It is a general aspect of parliamentary practice to invoke an Ordinance. When both the Houses of Parliament are not in Session and if the President is satisfied that the circumstances have existed to render it necessary for taking an immediate action, then he or she may promulgate an Ordinance. So, it is a common practice of parliamentary democracy. In India, since the inception of our Constitution, scores of amendments have been promulgated and have been invoked.

The Hon. Minister of Law has already made a statement in the Parliament under rule 71 (1) of the Rules of Procedure and Conduct of Business in Lok Sabha whereby he has stated the background of the Ordinance.

Sir, as we know, India is a country which is recognised as a culturally and spiritually enriched country in the world. Being an Indian, I am proud of the fact that we have never broken down our present with the glorious past of this country. In this regard, we may even differ with the civilisation of Egypt, Mesopotamia and even Greece. The ancient civilisation of India vividly recorded all the antiquities of the rich culture of our country. Culture simply strengthens the bond between the past and the present. … (Interruptions)

Before the advent of Archeology the farmers of Egypt and Iraq were not aware of their predecessors and even the farmers of Greece were not distinctly aware of the culture of Periclean Athens. But Indian farmers maintained their rich past with all its dignity including its heritage. This is India. I would like to quote John Ruskin. He said:

“It is again no question of expediency or feeling whether we shall preserve the buildings of past time or not. We have no right whatever to touch them. They are not ours. They belong partly to those who built them and partly to all the generations of man-kind which would follow us.”

The fact is that culture is an identity of a country. It is incumbent upon us to preserve, to protect and to maintain that culture. When the Europeans came to our land, they found here a culture which was fully conscious of its antiquities which had not had any fundamental change over the centuries. A harmless Indian in a remote part of the country can recall the shadowy chieftain who was ruling even centuries before the Christ was born. This is India. The orthodox BRAHMINS still alluded or referred to the hymns which were composed hundreds of years earlier than the birth of Christ.

Whenever we discuss this issue, we must be obliged to those British officers, namely, John Wilkins and Cunningham who were considered fathers of Indology and archaeology of our country. Without that archaeology and without that heritage, we cannot trace our origin and we cannot trace our past. If a nation forgets its past, then it loses its identity. So, we have to preserve it.

Hon’ble Shri Veerappa Moily is a very erudite person in his subject of law. I think the contents of the Bill may be spelt out by him, but the substance of the Bill must out-reach his ministerial jurisdiction because it relates to the Ministry of Culture, etc.

Sir, in spite of all our endeavours to preserve our archaeological properties, I feel sorry to state that still the Central Government is a little stingy in allocating the funds to this area. You will be astonished to note that only 0.12 per cent of our Budget proposals have been earmarked for the Ministry of Culture including the Plan and the Non-Plan expenditure. So, with this paltry sum of fund, how can we preserve our huge and humongous assets that we have inherited? This must be the question before this House and we should ponder over it because we have established the Archaeological Survey of India which the hon. Minister has referred to. But what is the jurisdiction of the Archaeological Survey of India? It simply protects 3,675 assets. It is a small faction of which we have had in our country. Even the hon. Minister has referred in this House that 35 archaeological assets have disappeared from this country. This country has been worshipping over the centuries the archaeological assets of our country. There, the 35 assets have been disappeared and it has been referred to the Parliament.

Sir, what is the function of the Archaeological Survey of India and its jurisdiction? The Ancient Monuments and Archaeological Sites and Remains Act, 1958 is in vogna. It empowers the Central Government to declare only such ancient monuments, archaeological sites and remains which are in existence for not less than 100 years to be of national importance. The State Governments have also got their identical legislations to protect the ancient monuments and archaeological sites.

Sir, under the jurisdiction of the ASI, there are 3,675 monuments and under the jurisdiction of all States taken together, there are 4,000 monuments. It means, the Central and the State Governments put together are protecting only 8,000 monuments and sites whereas the number of unprotected monuments and sites are as much as more than two lakhs. Can you imagine in a country where two lakhs of monuments are unprotected, we are protecting only 8,000 monuments by both the Central and State Governments put together? Moreover, this legislation does not extend to modern architect of modern value. As such, a large number of heritage monuments, both historical as well as contemporary, fall outside the ambit of the said Act. Similarly, various Central and State legislations for conservation and preservation of forests and environment cover a small fraction of the total number of natural heritage.

Sir, I would also like to remind you that in the year 1972 under UNESCO a convention was held. That is called, World `Heritage Convention’. India is a signatory of that World Heritage Convention under the patronage of UNESCO.

In the year 1977, we have ratified it. But still, in the year 2010, we have not been able to frame a Central institutional instrument under the Union legislation. We do not know the cultural and natural heritage that need to be protected.

Sir, you are coming from Goa. Someone is coming from Lakshadweep. We do not have any idea of the underwater archaeological properties. Who will protect them? Without having any legislative instrument, without having any institutional instrument of protecting the natural and cultural heritages, how will it be possible to protect, preserve and maintain those assets of our country? It also needs to be considered.

India is a country where common people are not concerned about the real value of the archaeological sites and remains. Even the Lal Mahal was demolished. Can you imagine it? The yellow sediment has been deforming the glorious Taj Mahal. The suspended particles have been depositing on the Taj Mahal. If we are not serious about protecting our archaeological heritage, then, it will be a great loss to our country. So far as the Archaeological Survey of India is concerned, it does not have the adequate resources, adequate manpower, adequate instruments even to protect their prescribed assets, as has been entrusted upon them. … (Interruptions)

I am going into the legislation itself. I must propose to the hon. Minister that the punitive measures must be more stringent because only a fine of rupees one lakh or two years jail term is not adequate to safeguard our monuments.

The definition of the term “prohibited area” was introduced by the Ordinance to be retained, as has been assumed. But clearly it is defined as an area of a minimum 100 metres from the limit of the protected area or protected monument in all the directions. The 100 metre limit as the prohibited area was declared in the Government of India Notification, 1992. This declaration was made with a view to effectively protect and safeguard the protected monuments and protected areas.

The Bill empowers the Government to extend the extent of the prohibited area on the recommendation of the National Monument Authority. There are two Authorities. One is the Competent Authority and the other one is the National Monument Authority. I would request the hon. Minister to clarify the distinctive jurisdiction of the two Authorities so that it could not overlap each other.

Article 49 of the Constitution of India mentions:

“It has been the obligation of the State to protect every monument or place or object of artistic or historic interest, declared by or under law made by Parliament to be of national importance, from spoliation, disfigurement, destruction, removal, disposal or export, as the case may be.”

We have, under the Seventh Schedule, the Concurrent List, the Union List and the State List. In all the Lists, the protection of monuments is incorporated. What I would like to suggest is that we need to have the Heritage Police to protect our monumental assets. We need to have more stringent laws to protect our monumental assets.We need to expand the jurisdiction of the Authority, namely, the Archaeological Survey of India, which consists of very competent personalities of our country, to provide them more financial support, more resources so that they can perform their job in an adequate manner.

With these words, I support the legislation.

SK. SAIDUL HAQUE (BARDHMAN-DURGAPUR): Sir, the Government has introduced the Ancient Monuments and Archaeological Sites and Remains (Amendment and Validation) Bill, 2010 by revoking the Ordinance.

Why this Ordinance came? We all know that it is because of the Delhi High Court verdict, which set January 29 as the deadline to respond to the judgement for the protection of monuments. On the basis of that the Archaeological Survey of India issued show-cause notices to the civic agencies in connection with the combination on infrastructure activities in and around 92 projected structures.

Naturally, in view of the present Commonwealth Games, the Government has promulgated the Ordinance. No doubt the High Court verdict will affect the development projects. Naturally, the Bill has come to clear the infrastructure projects so that in the current rule of 100 metres of prohibited area and further 200 metres of regulated areas some projects and some development works can be done.

Right it is there that some sort of development work is needed to be done. But the question is what will happen to the illegal constructions which have been done since 1992 and since 2006 where construction has taken place within these 100 metres and 200 metres barriers? What will the Government do? The Bill states nothing about that.

We know that many of our heritage sites are at risk now. There is innumerable encroachment at all these historical sites gradually growing up. Our country, India, can boast of 27 UNESCO’s Heritage and National Sites, including the historical gems, like Taj Mahal, Sun Temple, Ajanta and Elora Caves, Red Fort and so many other monuments. But is the Government protecting those monuments or historical sites properly for which we can take pride? Apart from that there are numerous monuments of which the Government takes no care at all.

What is important is that the Government is a party to the UNESCO Convention of 1972, but what we are doing now? I am quoting Director, National Mission on Monuments and Antiquites: “Only a handful of sites are protected by the Government of India. This is less than one or two percent of the cultural and archaeological resources of the country. There are a number of heritage sites lying unprotected.” So, what will be the role of the Government? The Bill should clearly state all these things. Developmental projects are no doubt needed, but not at the risk of our proud and boastful cultural heritage.

The Bill states that Archaeological Survey of India has brought 3,675 monument sites under the purview of the 1958 Act. This constitutes a very small fraction of the total number of ancient monuments in the country. The Union Ministry of Culture itself acknowledges that, as has been told by the previous speaker that about 35 national monuments including tombs and other areas have gone missing. Naturally, maximum number of missing monuments is from Delhi where ASI has its Headquarters.

In the last Session of the Rajya Sabha a question was put which stated that several protected historical sites have been buried under illegal construction of buildings and others have been submerged in reservoirs or looted by art thieves. According to Shri Shashi Misra, Chairman of Indian National Trust for Art and Culture a huge number of structures are disappearing and are being sold in the international market. What are we doing? What are we doing? I would like to know whether the Government is protecting them. In 1984, R.N. Mirdha Committeee recommended that a minimum of 9000 monument attendants should be provided for security reasons. But, so far, ASI has been able to deploy only 4000. What will be the Government’s role here? What is important is keeping the data about all ancient monuments and archaeological sites. But, that is not properly done; it is not my words. Shri A.K. Sinha who is the Director, Monument, ASI himself has admitted that apart from a few, a number of monuments have not been recorded properly by ASI. What is the Government’s notion there? How will the Government face that? That is very important.

The Bill may be necessary for the developmental project, for Commonwealth Games, but the lapses of the Bill are that nowhere does it mention that the direction issued by the Commission will be binding upon all the existing Acts. Next, the Commission can issue direction to an individual but not to any local bodies. The Bill ought to have given the Commission the necessary power to punish the offender. That has not been done by the Bill. What is needed now is to formulate a composite law relating to not just heritage or cultural sites but a broad definition of any place or structure that is worth preserving for historical, antiquarian, or archaeological reasons.

We need to preserve all the monuments because there lies in them the country’s ancient and medieval history that is etched in stone and marble. We are proud of our heritage. The Bill for establishment of a National Commission for Heritage Sites in 2009 is nothing but a half-hearted effort as the legislation does not fill all the gaps in preservation of heritage. It is high time that conservation and preservation efforts were dovetailed with the Local Area Development Plans. Financial assistance for protection of all these sites needs to be increased. We need to build awareness among all sorts of people.

I would like to mention about a recent report that has been published in the Times of India. That report tells that in a Valentines Day, several people scribbled on the walls of a protected monument by writing down their eternal love. This should not be done. Care should be taken for that. But, who will take the care? What is urgently needed is a third level of institutional, legal arrangements involving local bodies and a committed enforcement of rules and scientifically grounded measures to enhance such ancient monument protection so that we can feel really proud of all the monuments that lie scattered all over the country because therein lies our history, our heritage, and we are proud of them.

With these words, I conclude.

श्री शैलेन्द्र कुमार (कौशाम्बी): उपाध्यक्ष महोदय, आपने मुझे प्राचीन संस्मारक तथा पुरातत्वीय स्थल और अवशेष (संशोधन और विधिमान्यकरण) अध्यादेश, 2010 पर बोलने का अवसर दिया, इसके लिए मैं आपका आभारी हूं। सम्मानित सदस्यों और माननीय मंत्री जी ने कुछ बातें कही हैं। मैं आभार व्यक्त करता हूं कि हमारे बीच माननीय सदस्य श्री रमेश बैस और श्री अर्जुन चरण सेठी जी यह सांविधिक संकल्प लेकर आए हैं। यह विधेयक 1958 विधेयक का संशोधन विधेयक है। आज देखा जाए तो हमने विदेशों में भी प्राचीन पुरातत्वीय स्थलों को देखा है लेकिन विदेशों में प्राचीन पुरातत्व से संबंधित स्थलों को जिस प्रकार से संरक्षा और सुरक्षा से रखा जाता है, मेरे ख्याल से हिंदुस्तान में नहीं रखा जाता है। यहां कुछ ऐसे स्मारक और भवन हैं जिन्हें लीप पोतकर ठीक कर दिया जाता है, मेन्टेनेंस होता है लेकिन सुरक्षित और संरक्षित करने का कोई प्लान नहीं है।

अभी हमारे साथी से बात हो रही थी। हम लोगों के चाहे जितने भी साथी हों, जनमानस में जो भी मानव है, यदि थोड़ी बहुत तकलीफ भी हमें होती है तो हम लोग कहते हैं - हे राम। यहां तक कि गांधी जी को जब गोली लगी तो वह हे राम कहकर मरे थे। अभी हमारे साथी बैठे हुए थे, वह चित्रकूट,बांदा से चुनकर आते हैं। रामगमन पथ, जो अयोध्या से चलकर इलाहाबाद होते हुए चित्रकूट जाता है। उसके लिए भारतीय जनता पार्टी की सरकार ने एक योजना बनाई थी और रामगमन पथ रोड को बनाने की बात कही थी। लेकिन आज तक उस पर मूर्त रूप में कुछ नहीं हो पाया है। जबकि चित्रकूट, इलाहाबाद, कौशाम्बी, जहां से मैं चुनकर आता हूं, भगवान रामचंद्र जी को जब 14 वर्ष का वनवास हुआ था, तब वह इसी रास्ते से होकर गए थे। इलाहाबाद में जब वह गंगा पार कर रहे थे तो वहां श्रिगवेरपुर एक जगह है, जहां केवट ने उन्हें नाव से गंगा पार कराई थी और जहां नाव से गंगा पार कराई थी, वह भी हमारे क्षेत्र का बार्डर है और जिस क्षेत्र में उतरकर गये, वहां भी कौशाम्बी जनपद में यमुना नदी है, वहां से चित्रकूट आता है, जहां तुलसीदास जी का एक स्लोगन है - “ चित्रकूट के घाट पर भई संतन की भीड़, तुलसीदास चंदन घिसे तिलक देत रघुवीर।” लेकिन हमने आज तक उनके लिए कुछ नहीं किया। किसी को कोई भी तकलीफ होती है, यदि आदमी मरता है तो हे राम कहकर मरता है। मर्यादा पुरुषोत्तम राम एक आदर्श पुरुष थे। उन्होंने एक आदर्श प्रस्तुत किया था, लेकिन उनके लिए हम कुछ नहीं कर पाये हैं।

दूसरी बात मैं कहना चाहता हूं कि इलाहाबाद में झूंसी एक जगह है, वहां एक राजा थे, उनके बारे में एक कहावत है - “अंधेर नगरी चौपट राजा, टका सेर भाजी, टका सेर खाजा”। यह बिल्कुल संगम के बगल में है। हम उसे भी आज तक संरक्षित नहीं कर पाये। वह बिल्कुल उल्टा-पुलटा है। जबकि हमारे इतिहास में यह सब बड़े स्वर्णाक्षरों में अंकित है, लेकिन हम उसे भी संरक्षित नहीं कर पाये हैं। इसके अलावा इलाहाबाद में प्रयाग संगम है, जहां लाखों-करोड़ों लोगों की भीड़ होती है और देशी-विदेशी पर्यटक भी आते हैं। अभी बहुत मुश्किल से लड़-भिड़कर कर हम लोगों ने श्री प्रफुल्ल पटेल से कहा कि कम से कम आप दिल्ली से इलाहाबाद के लिए एक फ्लाइट चला दीजिए। वह भी एक एटीआर फ्लाइट है और अक्सर वह फ्लाइट कैंसिल हो जाती है। इस तरह से पर्यटक भी वहां आकर्षित नहीं हो पाते हैं। इलाहाबाद में केन्द्रीय सरकार के तमाम विभाग भी हैं। आदरणीय सोनिया जी, यूपीए की चेयरपर्सन यहां बैठी हैं, वह आपकी ससुराल है, वहां आपका घर है। स्वराज भवन, आनंद भवन जो आजादी की लड़ाई का मुख्य केन्द्र बिन्दु रहा है। उसे तो हमने संरक्षित किया है। आज तमाम साउथ से जब भी लोग इलाहाबाद जाते हैं तो आनंद भवन और स्वराज भवन जाना पहले पसंद करते हैं और लोग वहां जाते भी हैं।

श्रीमती सोनिया गांधी (रायबरेली): हम लोग खुद उसकी देखभाल करते हैं।

श्री शैलेन्द्र कुमार: जी हां। इसलिए मैं आपका ध्यान प्रयाग संगम की ओर आकर्षित कर रहा था। संगम के बगल में एक किला बना हुआ है, जिसे अकबर ने बनवाया था। उस किले के अंदर एक अक्षय वट वृक्ष है। वह वृक्ष अमर है, वह कभी नष्ट नहीं होता। माननीय मुलायम सिंह यादव जी जब डिफैंस मिनिस्टर थे, चूंकि उस किले के अंदर डिफैंस का कार्यालय है। इसलिए यदि आम आदमी वहां जाता है तो एक कहावत है कि जो अक्षय वट वृक्ष का दर्शन करता है, वह मोक्ष की प्राप्ति करता है। वहां हर यात्री गंगा स्नान करने के बाद अक्षय वट वृक्ष को देखना पसंद करता है। लेकिन डिफैंस एरिया में होने के कारण लोग उसे देखने नहीं जा सकते, वहां जाने पर रोक लगी थी। माननीय मुलायम सिंह यादव जी से जब लोगों ने कहा तो कुछ दिनों के लिए उन्होंने उस रोक को हटवा दिया था और सुरक्षा के कारण वहां बहुत बैरीकेडिंग कर दी गई। संगम पर जो भी देशी-विदेशी यात्री आते थे, वे अक्षय वट वृक्ष के दर्शन करते थे। हम उसे भी अभी तक संरक्षित नहीं कर पाये हैं। वहां आम जनता, आम यात्रियों के लिए, जिनकी उन चीजों से निष्ठा, आस्था जुड़ी हुई है, हम उनके लिए भी यह व्यवस्था नहीं कर पा रहे हैं कि उन्हें हम कैसे क्या चीजें दिखायें।

दूसरी बात यह है कि कौशाम्बी में कड़ा जगह है जहां अलाऊद्दीन खिलजी और मुगलों के समय की लड़ाइयां हुईं। वहां पर आज भी हजारों मज़ार और कब्रिस्तान हैं. ये बड़ी अच्छी और खूबसूरत तरीके से बनी हैं। हम उसे भी संरक्षित नहीं कर पाये। उनके किले, द्वार और चबूतरे बने हुये हैं, उसे संरक्षित करने की बात है। भारद्वाज आश्रम, जहां हमारे प्राचीन ऋषि-मुनियों और भगवान रामचन्द्र जी ने वास किया। यह भारद्वाज आश्रम आन्नद भवन के सामने हैं., पहले वहां गंगा बहती थी। उसे भी हम संरक्षित नहीं कर पाये। इसी प्रकार से गौतम बुद्ध की नगरी कौशाम्बी है जो मेरा संसदीय क्षेत्र है। लेकिन आज भी गौतम बुद्ध के कौशाम्बी बौद्ध सर्किट में हम नहीं ले पाये हैं. जबकि गौतम बुद्ध जी वहां रहे, वहां पर 12 वर्ष तक उन्होंने पढ़ाई-लिखाई की, बौद्ध धर्म की शिक्षा का प्रसार और प्रचार किया, हम उसके लिए भी कुछ नहीं कर पाये। राजा उदयन की राजधानी बिलकुल यमुना के किनारे बनी हुई है, उसका भी वही हाल है। वहां कड़ा पर संत मलूक दास का भी स्मारक है। आपने एक कहावत सुनी होगी - "अजगर करे ना चाकरी, पंछी करे न काम, संत मलूका कह गये सब के दाता राम " हम उसे भी संरक्षित नहीं कर पाये। संत मलूक दास के स्मारक के लिए कुछ नहीं कर पाये। ये सब हमारी ऐसी ऐसी धरोहर हैं, हमारे पुरातत्व से संबंधित पुराने स्थल हैं जिनको संरक्षित और सुरक्षित करने की आवश्यकता है। हमें इन सब को राष्ट्रीय मानचित्र पर लाना पड़ेगा लेकिन हम नहीं ला पाये।

उपाध्यक्ष जी, संदीपन घाट है जहां भगवान कृष्ण को बाण लगा था। वहां बहुत बड़ा मेला लगता है। वेदों के अंदर, महाभारत के अंदर संदीपन का उल्लेख किया गया है, हम उसे भी संरक्षित नहीं कर पाये। लोगों की आस्था और निष्ठा इससे जुड़ी हुई है। हमारी धार्मिक पुस्तकें- रामायण और महाभारत, वेद हैं, जहां कहीं कुछ मिलता है, लोगों ने अपनी आस्था और निष्ठा दिखाई है और तमाम सारे कार्य किये हैं । हमारी सरकार ने आज तक उस पर कोई विशेष ध्यान नहीं दिया । मैं तो चाहता हूं कि मध्य प्रदेश और इलाहाबाद, फिर चित्रकूट, खजुराहो, कौशाम्बी ये बिलकुल जुड़े हुये हैं। इसका पथ मार्ग बनवा दिया जाये तो देशी और विदेशी पर्यटक आकर्षित होंगें, हमारा राजस्व भी बढ़ेगा और लोगों को रोज़गार भी मिलेगा। इसलिय़े, मैं अंतिम बात कहकर अपनी बात समाप्त करूंगा। आज जरूरत इस बात की है कि अगर माननीय मंत्री जी यह बिल हमारे सामने लेकर आये हैं तो इस बिल के माध्यम से, मैंने तो केवल एक-दो जगह की बात कही है, अगर सारे हिन्दुस्तान को ले लिया जाये तो मेरे ख्याल से हजारों जगहें ऐसी होंगी जिनको संरक्षण देने की आवश्यकता है, उन्हें संरक्षित करने की आवश्यकता है ताकि हमारे देशी -विदेशी लोग वहां आयें, उस से ज्ञान अर्जित करें, उससे अपने जीवन को यथार्थ में लागू कर कम से कम अपने जीवन स्तर को सुधारें। यह हमारी एक ऐतिहासिक, धार्मिक धरोहर रही है। इनको हमें संरक्षित और सुरक्षित करना पड़ेगा। इसलिये, मैं इस बिल का समर्थन करते हुये अपनी बात समाप्त करता हूं।

SHRI ARJUN CHARAN SETHI (BHADRAK): Hon. Deputy-Speaker, Sir, I thank you very much for giving me this opportunity to speak on the issuance of the Ordinance as well as the procedure being adopted by the Government to pass this particular Bill under discussion.

At the outset, I must admit that I am not a lawyer.

But at the same time, I must point out here that I have special interest in preservation of monuments and archaeological sites in different parts of the country as well as in the State of Orissa. You know, Hon. Deputy-Speaker, in Orissa a large number of protected monuments exist. Simultaneously, we have also got the World Heritage Site in the shape of Sun Temple at Konark. Over the years, whatever preservation measures taken by the ASI are not at all satisfactory. On the other hand, they have adopted old method of preservation and techniques to maintain them. As a result, the world famous, Sun Temple at Konark as well as famous temple at Puri, Lord Jagannath are in ruins, I must say. Whatever funds they have provided over the years are not at all sufficient while taking into consideration the gigantic nature of the monuments and the sophistication of arts that were engraved in the structure.

Secondly, I must point out here that unless immediate measures are taken by the Central Government and provide enough funds, these rare structures, monuments may not survive the time. As a result, we may lose the precious monuments in the country. So, I urge upon the Government as well as the Minister concerned, Veerappa Moily Ji to take immediate measures. The ASI cannot do anything. Unless your immediate intervention is there, these rare monuments may not survive. So, I would request the Minister to do something immediately so that these rare monuments are protected and preserved.

At the same time, I would like to mention a few points on the Ordinance. I am one of the movers of the Resolution disapproving the issuance of Ordinance by the Government. I know legislation by way of Ordinance is not new to this august House. Many times, this august House has had debated on the constitutionality of issuance of Ordinance by the Hon. President of the Republic and acceptance of it by the House. But this particular Ordinance that has been issued by the Government is certainly unprecedented. By means of this Ordinance and passing of this particular Bill, the Government intends to validate all the actions of the ASI which have been taken since 1992 onwards. Since 1992 till today, whatever actions the Archaeological Survey of India, ASI, has taken will be validated by this particular piece of legislation. This is certainly unprecedented. At least to my knowledge, I have not seen such a measure in the past. If it has been done, then the hon. Minister would educate me as to what were the occasions when things were done in this particular way. Since 1992 till today, whatever action the ASI has done will be validated by passing this Bill. Not only that, there is another point. As I have said earlier, I am not a lawyer. But I have certain kind of interest in this particular Bill because this pertains to large monuments and rare monuments in my State.

They have appointed an Expert Committee. Whatever action that has been taken by the ASI is under adjudication in the court of law, that is, in Delhi High Court. Delhi High Court has issued strictures against the actions of the ASI. Because the ASI told earlier to the Court, that 100 metre prohibited area is sacrosanct. This is the word I used. This is sacrosanct. But later on, without informing the High Court of Delhi, the Government has issued this Ordinance. They have consulted the hon. Minister of Culture and they have appointed the Expert Committee. They have not intimated it to the High Court nor have they sought permission to constitute this particular Expert Committee to regularise or to review. Without informing the High Court of Delhi they have constituted the Expert Committee. As a result, the High Court of Delhi has again struck it down and the ASI has filed a petition in the Supreme Court, which is pending for adjudication.

Now, this particular Ordinance has been issued. Here also the hon. Minister has mentioned in his statement that Parliament was not in Session, etc., and the President of India, under Article 123 of the Constitution has issued this ordinance to give effect to the amendment that was required to be carried before 29th January 2010. Why has this been done? As I have stated, I am not a lawyer, but as a common man hailing from a village I would like to know why this has been done. I would like to know what will happen after the expiry of this particular date. Hon. Minister may kindly tell me about this.

These actions that have been taken by the Government create suspicion in the minds of everybody and also in my own mind. If I am allowed to say, I think the Government’s bona fides are not clear. The hon. Minister of Law and Justice is a very erudite lawyer and he knows the law better than I do. So, please clarify this. Are you not going to pre-empt something keeping in your mind that you want to do something which is not as per law and the court of law will not take you lightly?

Lastly, I must quote a press report that has appeared in national newspapers.

Why has the Hon. Prime Minister given that direction? Sir, I would like to quote here what has appeared in The Indian Express dated 22nd February, 2010. With your permission I would like to quote:

“The Prime Minister’s brief to Law Minister is to ensure that no VIP or the builder lobby is able to benefit from the proposed law; something that heritage experts and the conservations are already alleging. He wants nothing left to anybody’s discretion.”

Why has he commented in this way? Why has the hon. Prime Minister of India commented in this way? I think that creates a suspicion in the minds of everybody. Hon. Minister, Moilyji, please clarify this and convince the House on this aspect. Whatever steps you have taken, they are not clear and on the other hand they create suspicion, create many doubts in the minds of the hon. Members of Parliament and also in my mind. When you reply, please clarify on this point.

SHRI T.K.S. ELANGOVAN (CHENNAI NORTH): Thank you, Mr. Deputy-Speaker, Sir. I rise to support the amendment proposed by the hon. Minister of Law and Justice to the Ancient Monuments and Archaeological Sites and Remains Act, 1958 and to make provision for the validation of certain actions taken by the Central Government under the said Act. It is necessary that our ancient monuments should be protected. We have a hoary past. We have a very long history. India has attracted people from various countries, in fact, from the western countries where many of the expeditions by the Governments of the western countries have taken place to come to India and see our history.

While supporting this Bill, I have only one apprehension. It is the apprehension of the people who are residing in the areas where these ancient monuments are situated, particularly those people who are dependent on these monuments. They are like the tourist guides, the petty shopkeepers, the shopkeepers who sell the handcraft items, the hoteliers, the tea-shop owners etc. These are the people who are dependent on these monuments and it is also the apprehension of the people who are there to protect these monuments. Their livelihood depends on the very presence of these monuments. They should not be removed on any account from that area. Their livelihood depends on the tourists who are visiting the place and they are there for quite a long time.

My only request to the hon. Minister is that nothing should make them displaced from the areas where they are living. With these words, I support the amendment.

SHRIMATI SUPRIYA SULE (BARAMATI): Thank you, Sir. I stand here to support the Bill. As we are all aware, we have ratified the UNESCO Convention. We have talked about identification, protection, conservation, presentation and rehabilitation of cultural and natural resources. I will certainly like to second what my hon. colleague Mr. Elangovan has just said. It is very crucial for us to save our heritage. But, unfortunately, a lot of times ASI gives all this work to CPWD who do not, though the intentions being very good, have the expertise of really doing basic things as lighting or conservation or upgradation of any of our monuments.

I think, times have changed. We have to convert our heritage sites into our resources. I would like to give an example of Orissa. Recently, a lot of MPs had gone to Orissa on a trip about malnutrition. Hon. Chief Minister was kind enough to take us on a round for seeing all the restoration that he had got done personally, without any help from ASI. He himself is an expert. He has proved that with basic amenities and finance available, he has been able to do some fabulous work in Bhubaneswar itself for various temples.

I would like to take some more examples. The Opera House and Crawford Market are beautiful sites in Mumbai and the State I come from. ASI has made our Shivaji Terminus a World Heritage Site. Now, this Crawford Market and Opera House both are at a small distance from this place. Unfortunately, the Maharashtra Government has given four FSIs for upgradation of these markets. It is an extremely serious concern. Do we really every time need NGOs to come to the Government and tell what our heritage is? I think, we owe it to our people, we owe it to our next generation.

We talk about India because we are proud of our culture, our heritage, our languages and our food. I do not know why we cannot convert all these into our resources. Talking about forts in Maharashtra, in my own constituency, there are six forts. There is not one fort where we can do restoration because half of the land belongs to the Defence Ministry. We have requested the Defence Ministry, but the Defence Ministry has issues with the State Government. They say that unless the State Government resolves these issues, they are not going to allow us to touch those places. How will it help? We have young generations. We are talking about migration. We want to reverse migration and these are great opportunities of livelihood that we can incorporate.

I am sure that today you go anywhere in the world and you will find that India has the oldest culture, but we are looking at the West to give us guidelines. To talk about great agencies called ICCMOS and ICROM, I would say that these are the two agencies which the UNESCO uses for restoration of sites which are there in Rome. Rome is the most beautiful site. If you go there and visit any place, there is a ticket and there is enough information. They know how to market their sites. I think, we need to look at it as a marketing avenue.

Let us be proud of our culture. Let us make the required changes and not just get tied down by laws. Let us get the experts. In most of the foreign countries, they use our restoration people who go abroad and help them. Why can we not use our talent in our own country and make a difference, giving our next generation an opportunity of livelihood and good knowledge of our culture? That is all I would like to say.

I stand in support of this Bill, but I would appeal to the hon. Minister to take the right decision and get the experts. We are not against CPWD, but we need experts to do the very basic things to restore our heritage.

SHRI PRABODH PANDA (MIDNAPORE): Mr. Deputy-Speaker, Sir, I rise to support the Bill. While supporting this Bill, at the very outset, I must raise one point: What was the necessity of promulgating the Ordinance in this respect? I think, there is no difference in this House on this particular subject. So, I would like to know the necessity of promulgating the Ordinance.

I am not going to touch upon all aspects in this respect as this Bill is confined to legal aspects only. So, this Bill has been brought by the hon. Minister, Shri Moily.

We are proud of our ancient monuments. How many protected monuments are there and how many are still unprotected? Several Members also mentioned about this aspect. Nearly 8000 monuments are protected by both the Governments, the Union Government and the State Governments. There are around two lakh unprotected monuments in our country. It is not that everything has been exhausted. It is not that there is nothing to be unearthed as there are several spots in our country to be unearthed. We are talking about the Buddhist centres. Excavation work is going on in different parts of our country not only by the ASI but also by several universities. There is one place in my constituency named Mughal Mare near Dantan where excavation is going on, and according to the remarks of the specialists and excavationists it might be conceded as the largest Buddhist spot in Eastern India. Therefore, different places are there to be unearthed and discovered.

Basically, there are two main aspects of this Bill. One is about the safety and security, and another is the aesthetics of the monuments and sites. It is said that 100 m. surrounding the monument is to be declared as a prohibited area and another 200 m. surrounding this prohibited area is to be declared as a regulated area. How much funding is required for this purpose? I think that it was not necessary to promulgate this as it is already cleared in the Financial Memorandum. I feel that the salaries and remuneration should be declared; and it was necessary to promulgate this sort of an Ordinance before placing the Budget; and Rs. 250 crore to Rs. 300 crore to be provided for this purpose from the Consolidated Fund of India. This is a very meagre amount for the protection of two lakh monuments of our country. It is too meagre an amount for this purpose. Therefore, I feel that there is no budgetary allocation to comply with the essence of this Bill.

We are going to declare 100 m. surrounding the monument as a prohibited area and another 200 m. as a regulated area. Therefore, the Department should go in for land acquisition. Further, nothing has been said about the rehabilitation of the evicted persons. What would be our stand about the land acquisition? Who will provide the compensation? … (Interruptions) Nothing is mentioned here. I would like the Minister to respond to this issue also. This amount of money will not be enough for providing compensation and rehabilitation.

There is another place in my constituency called Pathra, the village full of temples. It has already been declared as a National monument. But even today, though the land has been acquired there, but compensation has not been provided. The farmers are suffering as a result of this, and they are not in a position to leave the authority to run their excavation and other aesthetic works. This is the problem.

In addition, there are several other spots like Narajole, which is a very old area and it should be declared as a National monument. I am not against this Bill, and the main essence of the Bill is welcome, but it is not enough. Nothing is explained about providing compensation or rehabilitation and nothing has been said about the share of the Central and State Government, etc. What will be our stand in the coming days with regard to this issue? Nothing has been cleared so far. I believe that during the course of the reply of the hon. Minister he will convince us and will respond to all these points.

With these words, I support this Bill.

श्री अर्जुन राम मेघवाल (बीकानेर): उपाध्यक्ष महोदय, यहां प्राचीन संस्मारक तथा पुरातत्वीय स्थल और अवशेष, (संशोधन और विधिमान्यकरण) विधेयक, 2010 प्रस्तुत किया गया है, मैं उसके संबंध में चर्चा करने के लिये खड़ा हुआ हू। 1958 का एक्ट अभी तक प्रभावी था। उसके बाद 16.06.1992 को उसके नियम बने और एक एक्सपर्ट एडवाइज़री कमेटी बनी जिसके पास परमीशन देने की पावर आयी। उस एडवायजरी कमेटी में चेयरमैन के अलावा 6 सदस्य विभिन्न क्षेत्रों से विशेषज्ञ थे। टाउन प्लानिंग, अरबन टाऊन प्लानिंग और आर्किटैक्ट क्षेत्र से ये लोग रखे गये थे। ए.एस.आई इसका नोडल डिपार्टमेंट था। मैं आपके माध्यम से सदन को बताना चाहता हूं कि परमीशन के लिये 171 प्रार्थना पत्र आये जिनमें 93 दिल्ली से संबंधित थे और सिर्फ 9 प्रार्थना पत्र मैट्रो और कॉमनवैल्थ से संबंधित थे। मंत्री जी ने जो पेपर सरकुलेट किया है उसमें बिल को लाने का कारण बताया है। मेरा कहना है कि अध्यादेश की जरूरत क्यों पड़ी? यह 1958 से अधिनियम चल रहा था। इस बिल की धारायें 20ए, 20बी, 20सी और 20डी अधिनियम से संबंधित हैं जिसके तहत एक्सपर्ट एडवायजरी कमेटी बनी थी। मैं जानना चाहता हूं कि अध्यादेश लाने की अचानक जरूरत क्यों आ पड़ी और आज सरकार ने इसे पारित करने के लिये मन बना लिया। मेरा मत है कि मैट्रो और कॉमनवैल्थ के 9 प्रार्थना पत्र पैंडिंग हैं। दिल्ली हाई कोर्ट ने 30.10.2009 को एक डायरेक्टिव दिया था जिसे मैं कोट करना चाहता हूं।

“The Delhi High Court declaring the Expert Advisory Committee (EAC) to be illegal and directing the Director General of ASI to not only stop issuance of further permissions but also to take steps within a period of four weeks to reconsider all previous permissions granted on the recommendation of EAC.”

ये जो परिस्थितियां बनीं, उसके बाद सरकार सचेत हुई। क्या सरकार को कॉमनवैल्थ की बात मालूम नहीं थी, क्या मेट्रो प्रोजैक्ट के बारे में जानकारी नहीं थी कि यह प्रोजेक्ट आने वाला है? जब दिल्ली हाई कोर्ट का आदेश हुआ तो लोक सभा का तीसरा अधिवेशन चल रहा था जो 18 दिसम्बर को सम्पन्न हुआ, सरकार इस अध्यादेश को उस सत्र में ला सकती थी। सरकार ने यह जो प्रोसैस अडाप्ट किया है, मैं उसका विरोध करता हूं। अगर सरकार को ऐसा लगता है कि आजकल हाई कोर्ट सरकार के पक्ष में निर्णय नहीं दे रहे हैं तो केवल इस सम्बन्ध में ऐसा क्यो सोचा गया और भी प्रकरण हैं। खाली-पीली सीटें क्यों ला रहे हैं? मैं राजस्थान से आता हूं। मैं बताना चाहता हूं कि इसी हाउस में 85वां संविधान संशोधन किया गया और अनुसूचित जाति और जनजाति के कर्मचारियों और अधिकारियों को 16 (4ए) के तहत प्रमोशन में भी रिजर्वेशन देने की बात कही, लेकिन बहुत से हाई कोर्ट, जिनमे राजस्थान हाई कोर्ट भी शामिल है, हिमाचल हाई कोर्ट भी है, पंजाब हाई कोर्ट भी है, कर्नाटक हाई कोर्ट भी है, उस 16 (4ए) की व्याख्या एम.नागराजन के फैसले के आधार पर कर रहे हैं और कहते हैं कि अनुसूचित जाति और जनजाति में भी क्रीमीलेयर लागू करें। क्रीमीलेयर लागू यह हाउस करेगा या न्यायालय तय करेंगे। मैं सरकार को इसलिए कहना चाहता हूं कि यह अनुसूचित जाति और जनजाति के अधिकारियों और कर्मचारियों का मामला है। अगर सरकार को इतनी ही चिंता है कि आजकल हाईकोर्ट के निर्णय ठीक नहीं आ रहे हैं तो केवल इसी केस में यह अध्यादेश क्यों लाया गया, क्यों नहीं अनुसूचित जाति और जनजाति के कर्मचारियों और अधिकारियों के मामले में भी यह अध्यादेश लाया गया, उनके लिए भी अध्यादेश लाना चाहिए था। इस अध्यादेश को लाने की जरूरत जब इस केस में पड़ सकती है, तो एम. नागराज के निर्णय के बाद भी अनुसूचित जाति व अनुसूचित जनजाति के कर्मचारियों और अधिकारियों के हितो की रक्षार्थ भी ऐसा अध्यादेश सरकार को लाना चाहिए था। अभी अखबारों का जिक्र आया, मैंने भी कुछ अखबारों में पढ़ा कि इस अध्यादेश के पीछे कुछ खास लोगों को परमीशन देने की सरकार की मंशा है। सरकार को आम लोगों का ध्यान रखना चाहिए या खास लोगों का ध्यान रखना चाहिए। 85वां अमेंडमेंट आये हुए कितना समय हो गया है। 16 (4ए) संविधान में इंसरशन किया, इसी हाउस में, अनुसूचित जाति और अनुसूचित जनजाति के अधिकारियों और कर्मचारियों को क्यों प्रमोशन नहीं दिये जा रहे हैं? हाउस को इस पर भी अध्यादेश लाना चाहिए। मैं यह कहना चाहता हूं कि अगर इस अध्यादेश को लाये हैं तो उस अध्यादेश को भी लाना चाहिए। वह भी आम लोगों के हित की बात है। अब जो यह नेशनल मोनुमैंट ऍथारिटी बनाने की बात आयी है, हम इसका स्वागत करते हैं कि नेशनल मोनुमैंट ऍथारिटी बननी चाहिए, लेकिन क्या एक्सपर्ट एडवाइजरी कमेटी के पास जो केसेज़ आये थे और जिनमें परमीशन ग्रांटेड हुई थी, हाई कोर्ट यह कहता है कि उनकी समीक्षा करें, क्या सरकार ने उनकी समीक्षा की है? सरकार को समीक्षा के साथ, खुलेपन के साथ इस हाउस में बिल पेश करना चाहिए था। इस बिल के बारे में जितनी भी शंकाएं उत्पन्न हो रही हैं, उन्हें पहले ठीक करना चाहिए था। यह बिल स्टैंडिंग कमेटी में क्यों नहीं गया, यह बिल क्या स्टैंडिंग कमेटी में नहीं जाना चाहिए था, हम सरकार से मांग करते हैं कि इस बिल को स्टैंडिंग कमेटी में भेजा जाए और वहां पर प्रॉपर चर्चा करायी जाए। प्रॉपर चर्चा कराने के बाद इस हाउस में बिल को लाया जाए। ऐसा कौन सा पहाड़ टूटने वाला है। कॉमनवेल्थ और मैट्रो से संबंधित केवल नौ एप्लीकेशन ही आपके पास पैंडिंग हैं। उन्हें किसी और जरिये से भी निबटाया जा सकता है। इस मुद्दे पर मैं चाहता हूं कि मंत्री जी जब जवाब दें तो इन विषयों को भी क्लियर करें, यह बिल स्टैंडिंग कमेटी में जाना चाहिए, नेशनल मोनुमैंट ऍथारिटी बनती है तो बहुत अच्छी बात है, लेकिन एक्सपर्ट एडवाइजरी कमेटी ने अब तक जिन केसेज़ में निर्णय दिया है, उनकी पुर्नसमीक्षा क्यों नहीं की गयी और पुर्नसमीक्षा का चार्ट भी हमारे सामने इसमें लगाना चाहिए था। मेरा एक निवेदन यह भी है कि हाई कोर्ट के निर्णय के बाद सामान्यतः लोग सुप्रीम कोर्ट जाते हैं। यहां एक एसएलपी सुप्रीम कोर्ट में पैंडिंग भी है। यह भी एक इश्यू इससे संबंधित है और सरकार को इस सम्बन्ध में सदन में भी बात करनी चाहिए थी।

महोदय, मैं माननीय मंत्री जी से एक बात और कहना चाहता हूं। मैं नॉर्थ एवेन्यू में रहता हूं, नॉर्थ और साउथ एवेन्यू में एमपीज़ के हाउस हैं, मैंने थोड़ी रिकवेस्ट की कि इनमें थोड़ा अमेंडमेंट कर दीजिए, इन्हें थोड़ा सा ठीक कर दीजिए। इसके बाद यह हमारे लिए सुविधाजनक हो जाएगा। सीपीडब्ल्यूडी वाले कहते हैं कि इट इज ए हैरीटेज। आप कोई चेंज नहीं कर सकते और न ही हम परमीशन दे सकते हैं।

एमपी खास वर्ग में आ रहा है या आम वर्ग में आ रहा है, यह किस वर्ग में आ रहा है? मुझे तो लगता है कि यह एमपी तो आम वर्ग में भी नहीं आ रहा है। कोई नहीं सुन रहा है। मैं सीपीडब्लूडी के पास गया। अधिकारियों से भी मिला कि इसमें कुछ नहीं होना है। उन्होंने कहा कि ऐसा नहीं हो सकता है, साहब ये हैरिटेज है, हम इसको नहीं छेड़ सकते हैं। जब आप उसको कुछ नहीं छेड़ सकते, तो क्या आप इस बिल के माध्यम से पूरी दिल्ली को छेड़ देंगे? इससे दिल्ली का हैरिटेज लुक भी खराब हो सकता है। एक बात मैं और कहना चाहता हूँ। शाम के समय मेरा घूमने का समय होता है। एक दिन मैं इंडिया गेट घूमने गया तो मुझे एक छतरी नज़र आई। मैंने कहा कि छतरी के नीचे क्या था? तो पता चला कि उसके नीचे जार्ज पंचम का स्टैच्यू था। वह हटा दिया गया। मैंने कहा कि जार्ज पंचम का स्टैच्यू था, उसको हटा दिया, तो छतरी को क्यों रखा हुआ है? वे कहने लगे कि ये हैरिटेज है। ये हैरिटेज है तो उसमें किसी का स्टैच्यू तो लगाओ। जार्ज पंचम को तो हटा दिया, लेकिन अपने किसी नेता का स्टैच्यू तो लगाओ - महात्मा गांधी जी का लगा दो, या किसी का भी लगा दो। स्टैच्यू की जगह खाली पड़ी है। ... ( व्यवधान) मैं सरकार से मांग करना चाहता हूँ कि ... ( व्यवधान)

किसी का भी स्टैच्यू लगाओ, तय तो करो, छतरी को खाली क्यों छोड़ रखा है? ... ( व्यवधान) मायावती जी के बारे में तो आप जानो। मैं तो कह रहा हूँ कि जब जार्ज पंचम का स्टैच्यू हट सकता है तो फिर वह जगह खाली क्यों है? या तो फिर वह छतरी भी हटे। वे कह रहे हैं कि छतरी तो हैरिटेज है। मैं कहना चाहता हूँ कि यह जो एम.पीज़ के आवास हैं, इसको आपने हैरिटेज तो घोषित कर दिया, लेकिन इनको भी प्रोटैक्टेड और रेगुलेटेड एरिया में कुछ छूट दो, नहीं तो हम भी हैरिटेज हो जाएँगे। ... ( व्यवधान) इस बिल में यह प्रावधान भी होना चाहिए। आपने मेरी बात को ध्यान से सुना और सदन में बोलने की इजाजत दी इसके लिए उपाध्यक्ष महोदय बहुत बहुत धन्यवाद।

श्री शरीफ़ुद्दीन शारिक (बारामुला): ऑनरेबल चेयरमैन सर, जो आसारे कदीमा के बारे में सरकार की तरफ़ से तरमीमी बिल पेश हुआ है, मैं उसकी पुरज़ोर ताईद करता हूँ। यह जिस शक्ल में भी है, इसमें खामियाँ भी हो सकती हैं मगर मैं उसमें नहीं जाऊंगा। शायद नामुकम्मल भी होगा, कई लोगों ने उसकी तरफ इशारा भी किया, मैं उसकी तरफ नहीं जाऊंगा, लेकिन मेरी ज़ेरे-नज़र जो पहलू है, मैं हुकुमते हिन्दुस्तान को, यूपीए सरकार को मुबारकबाद दूँगा, इसलिए कि आज आसारे कदीमा जो है, वह एक झरोखा है, एक खिड़की है, इस अज़ीम कौम के माज़ी को देखने का, अपनी गुज़िश्ता तहज़ीब, तमद्दुन और तारीख़ को देखने का, अपनी तहक़ीक और एस्थैटिक्स टेस्ट जो हमारे असलाफ़ में रहा है, उसको देखने का, हमारी इल्मी सलाहियतों को, हमारी हुनरमंदी को देखने का, हमारी जो कौमें हमसे पहले चली गई हैं, उनकी एस्थैटिक सैन्स को देखने का, उनके इल्म-ओ-अदब को देखने का, उनकी ज़िन्दगी को देखने का एक दरीचा है ये आसारे कदीमा। इस दरीचे से हम 5000 साल पहले नज़र डालते हैं तो हमें अपने असलाफ़ की काबिलियत नज़र आती हैं, उनकी कलमकारियाँ दिखती हैं, उनकी तहज़ीब दिखती है, उनका तमद्दुमन दिखता है, अपनी तारीख़ में हम झाँकते हैं, और वह वलवलअंगेज़ चीज़ें देखते हैं जो इस मुल्क में इस कौम के साथ गुज़री हैं। इसमें इश्तराक है पाकिस्तान के साथ चूँकि वह थोड़ी मुद्दत हुई इस देश से अलग हुआ। इससे इश्तराक है बंग्लादेश के साथ जो थोड़ी मुद्दत हुई, हमारे बरे सग़ीर हिन्दुस्तान और पाकिस्तान से अलग हुआ, लेकिन हमारी तमद्दुनी तारीख़ मुश्तरका है, तहज़ीबी तारीख़ हमारी मुश्तरका है। हमारी इल्मी तारीख मुश्तरका है, तहकीकी तारीख हमारी मुश्तरखा है। मुश्तुरखा भरोखा है, जिस झरीखे से हम देखते हैं अपने असलाफ को, देख पाते हैं अपने चन्द्रगुप्त मौर्या की फुतुहात को, उनकी तामीर को, देखते हैं महाराजा अशोक की अजमत को, उस अजमत पारिण को देखते हैं जिससे भारत का नाम 5000 साल से दुनिया की तारीख में रोशन है। हम देखते हैं मुस्लिम काईदीन फातहीन जो इस मुल्क में आ गए, उन्होंने तहजीबी तौर पर क्या-क्या दिया इस मुल्क को, वह इस बिल में है। हम देखते हैं जमहुरियत के बाद हमने क्या किया, उससे पहले हमने क्या किया। इसीलिए मैं आपको मुबारकबाद देता हूं उन तारीखी जगहों को भी नुमाया कर दीजिए, जिन पर लोगों ने कब्जा किया है और उनको आपकी फहरिस्त से गायब कर दिया है। जो मौजूद हैं, उन्हें भी बनाने संवारने के लिए आप फोरी इकदाम कीजिए। मैं माननीया लॉ मिनिस्टर साहब और सरकार से गुजारिश करूंगा कि खातिर ख्वाह रकम फराहम कीजिए, ताकि हमारी मुसलसारीख आगे बढ़ती चली जाए। दिल्ली में लोग आते हैं। वे दस मंजिला, बीस मंजिला इमारतों को देखने नहीं आते हैं। वे आपके स्टेडियम देखने नहीं आते हैं। वे लालकिले को देखने आते हैं, वे जामिया मस्जिद को देखने आते हैं, वे कुतुबमीनार को देखने आते हैं, वे पार्लियामेंट हाउस को देखने आते हैं। वे इन चीजों को देखने आते हैं, जिनमें आपकी तारीख बोल रही है। हमारे प्राचीन मंदिर, हमारी प्राचीन मूर्तियां, हमारी तारीख बोल रही है। ये बोलती हुई तस्वीरें हैं, इन्हें महफूज रखने के लिए आप जितने भी कदम उठाएंगे, यह हम पर और गुजश्ता आइंदा जो नस्लें आएंगी, उनकी जान पहचान अपनी गुजश्ता नस्लों से होगी। आप आने वाली नस्लों पर मेहरबानी कर रहे हैं। आप मेहरबानी करके इस चीज को आगे बढ़ाइए। आपको इन जगहों की तहकीक करनी है। कितनी जगह मौजूद हैं, कितनी खराब की गई हैं और कितनी जगहों पर नाजायज कब्जा किया गया है। इसके अलावा जो भी मौजूद हैं, उन्हें तरक्की देने के लिए आसारेकदीमा की जगहों को उनको महफूज करने करने के लिए आपको फोरी इकदाम करना पड़ेगा। यह एक इलमी तहकीक है। हमारे आइंदा स्कालर्स इस पर पीएचडी और डाकटरेट की डिग्रियां लेंगे, हमारी तारीख और तहजीब को नुमाया करने के लिए। वहीं कौमें तारीख में जिन्दा रहती हैं, जो कौमें अपने असलाफ की तारीख को और अपने गुजरे हुए जमाने को आगे रख कर अगले जमाने में कदम रखेंगे। वही तारीख है और वही लोग आगे जाते हैं। मैं आपसे पुरजोर गुजारिश करूंगा कि जिन लोगों ने नाजायज कब्जे किए हैं, उन कब्जों को हटाने के लिए जबरदस्त कोशिश की जानी चाहिए और हमारे पास कौरवों से लेकर पांडवों तक जो पहली तारीख है, उसके सिवाए हम अधुरे रहेंगे। भविष्य में हमें कुछ बातें मालूम होंगी और 50 साल के बाद मालूम ही नहीं होगा कि हम पहले क्या थे। इसलिए मेरी आपसे, सरकार से और मोहतरमा सोनिया गांधी से खसूसी तौर पर गुजारिश है कि इसे महफूज रखने के लिए, आगे बढ़ाने के लिए सरकार को काम करना चाहिए। केवल खाना पूर्ति के लिए नहीं कि बिल लाएंगे, ऐसा नहीं होना चाहिए। बेदिली से बिल लाएंगे, यह चीज नहीं है। कहवा के लिए बिल लाएंगे, यह चीज नहीं है। हिंदुस्तान के तमहुन को, हमारी तारीख को, हमारी तहजीब को महफूज रखने के लिए, आइंदा बढ़ाने के लिए इस बिल को लाइए। मैं इसकी पुरजोर ताईद करता हूं।

श्री अरुण कुमार वुंडावल्ली (राजामुन्दरी):उपाध्यक्ष महोदय, प्राचीन संस्मारक तथा पुरातत्वीय स्थल और अवशेष अध्यादेश, 2010 के समर्थन में बोलने के लिए मैं खड़ा हुआ हूं। मैं हिंदी में बोलने की कोशिश करूंगा। मेरी सीखी हुई हिंदी है, इसलिए शायद आपको बर्दाश्त करना पड़े। दुनिया के मशहूरMark Twain said: “India is the cradle of human race; the birthplace of human speech; the mother of history; the grandmother of legend; and the great grandmother of tradition. Our most valuable and most instructive material in the history of man are treasured up in India only.” This is what Mark Twain said about our great country.

आइंस्टीन ने कहा -

“We owe a lot to the Indians who taught us how to count without which no worthwhile scientific discovery could have been made.”

When many cultures were only nomadic forest dwellers over 5000 years ago, we established Harappan culture in Sindhu Valley. मैं खुश हूं कि आप हमारे ट्रेडिशन, कल्चर और हेरिटेज को प्रोटेक्ट करने के लिए ऐसा बिल ला रहे हैं जिससे मुझे उम्मीद है कि भारत का नाम और रोशन होगा। इसके साथ ही भारत की हिस्ट्री को सारी दुनिया देखेगी और भारत के बारे में अच्छी सोच बनेगी, अच्छी सोच का डेवलपमेंट होगा। लेकिन एक्ट बनाने से ही काम नहीं चलता है एक्ट को इम्पलीमेंटेशन करने वाली मशीनरी को भी इरेक्ट करना चाहिए कि वह काम कर रही है तो कैसे कर रही है। जैसा कि मेरे दोस्त ने बताया कि कोर्ट में एक बार गए तो क्या होता है, यह कोई नहीं जानता है। मैं एक उदाहरण देता हूं, 1996 में हैदराबाद एयरपोर्ट में गोपाल कृष्ण मूर्ति की मूर्ति जो वेणु के साथ है और एक महालक्ष्मी की मूर्ति को कस्टम वालों ने पकड़ लिया। उन्होंने कहा यह आर्काइव्स है, How are you exporting it? The person who was exporting it said. जो एक्सपोर्ट कर रहा था उसने कहा - नहीं, यह हमने बनाया है, तंजावुर के पास बनाया है। हमने बहुत सी चीजें एक्सपोर्ट की हैं लेकिन किसी ने पकड़ा नहीं, आप कैसे पकड़ रहे हैं? लेकिन कस्टम अफसर तगड़ा आदमी था, immediately he referred the matter to the Archaeological Survey of India. Hyderabad Archaeological Survey said that yes, these are antiques and these are prohibited to be exported. Then the exporter appealed and said - नहीं, यह तो हमने बनवाया है। जहां वे बना रहे थे एक एक्सपर्ट कमेटी वहां गई और मूर्तियों को देखा और वे आकर बोले कि यह मूर्ति आर्काइव्स है, यह वहां की बनी हुई नहीं है। So, the exporter again went to the High Court and appealed that these are not the archive material. The High Court ordered the Archaeological Survey of India to immediately constitute a high powered expert committee. The Committee was constituted and it gave a Report saying that these are the prohibited archives that are being exported. इसके खिलाफ कोर्ट में केस चल रहा है। जो आदमी इस धंधे में है, वह बहुत पावरफुल आदमी है। उसके हाथ में प्रेस है, उसके हाथ में मीडिया है। आंध्र प्रदेश का बहुत बड़ा मीडिया मैन है इसलिए लोग डरते हैं।, मैं 2007 से लिखता रहा, एक केस में एडवोकेट गया, जितनी कमेटी थी, सब कमेटी कहने लगी कि यह मुजरिम है, immediately take action against him. 1996 में कोर्ट में गए, चार सरकार बदल गई, आठ प्रधानमंत्री बदल गए लेकिन वह आदमी पब्लिक में ऐसे ही चल रहा है जैसे कोई राजा चलता है। ....* एक टीवी का मालिक है, एक पेपर का मालिक है। वह ऐसा काम कर रहा है, मैंने इसके खिलाफ कम्पलेंट भी दी थी। वह कोर्ट से ऑर्डर लेकर आता रहता है, हमने एडवोकेट को अच्छी एजुकेशन देकर भेजना है।

Such a Bill has been brought in the House. आप देखें, वाइल्ड लाइफ प्रोटेक्शन में बड़े दो लोगों को मार दिया इसलिए पूरा भारत शिकार के लिए जाने से डरता है। इससे पहले हमेशा शिकार होता था। मेरे गांव से 50 मील दूर बहुत बड़ा फोरेस्ट है। यहां सब शिकार के लिए जाते थे, दो बड़े पापुलर लोगों को मार दिया, अंदर कर दिया इसलिए अब सब डरते हैं। ऐसी बड़ी फिश को पकड़ लो, बड़ी फिश को इन्वाल्व कर लो तो जो एक्ट आ रहा है इसमें सच्चाई से पूरे एक्ट से प्रोटेक्शन मिलेगा। एक्ट से भारत को भी प्रोटेक्शन मिलेगा।

SHRI PRASANTA KUMAR MAJUMDAR (BALURGHAT):1 Hon. Chairman Sir, it is not that I am not supporting this Ancient Monuments and Archaeological Sites and Remains (Amendment and Validation) Bill, 2010. But I want to just say that the sections and acts of this Bill should be implemented in a more stringent manner. In India, we had rules of various royal dynasties like Pal dynasty, Gupta dynasty, Kanishka dynasty, Maurya dynasty, Mughal dynasty in Delhi and other parts of the country and thus we have inherited numerous antic archaeological sites and monuments. There are so many relics of ancient civilization and culture. We can find out from those remnants that in what manner the country was ruled, in what fashion, the governments were run. If we look at cities like Agra, Delhi, Konark or places like Hajarduari Palace, Murshidabad or Bangar in Dakshin Dinajpur, Madurai etc. We will see that all these places are studded with so many historical sites and monuments which reflect the rich cultural heritage of our nation. If our future generation is not made aware of these then it will be a great loss for us. The younger generation will not know what richness our culture carries.

It we our unable to preserve the culture of our country then the nation may die down. Therefore the law which is proposed to create a prohibited area around the heritage sites is commendable and I support this move whole-heartedly. Not only that, the administrative machinery of the government should be pressed into action for maintenance and preservation of these sites. Hon. member Shri Adhir Chowdhury has very rightly pointed out that the archaeological assets of the country are being smuggled and sold out in the foreign countries for a pittance. No one is there to look after this. In huge parts of India, there are priceless assets lying underground which have not been excavated as yet. They have not been tapped to date. It is a treasure trove of art and sculpture.

I want to speak about my District Gangarampur. In Bangarh area the Archaeological Survey of India had undertaken excavation work as a result of which Mughal, Gupta or Kushan dynastic remnants have been discovered amazingly. If the government completes the entire excavation work then we will be able to get hold of huge treasure of ancient civilization. But there is also the protected or prohibited area as near the site

Along with the increasing population pressure, more and more areas are being encroached every day. Which has its direct bearing on the preservation of the monuments. This has to be stopped. Both the state and the central government have to work in tanden with each other to keep a check on such illegal encroachments.

There are various other places which are yet to be discovered and which may lead to the unearthing of rich cultural history of this country. If we fail to preserve the art, sculpture, culture and history of India, our identity as a nation may be erased, may become blurred forever. Therefore, cutting areas party lines, we should stand up for proper presentation of these heritage monuments and sites.

In North Bengal, Buxar in Jalpaiguri should be declared as a heritage site. There are several other areas which are historically very important and should be given heritage status. I request Hon. Minister to initiate a special drive in this regard. Scores of tourists flock this country from all parts of the world to visit India. They are eager to know more about Indian culture and civilization. Tourism industry in flourishing like anything. Scholars and researchers of the world gather here to study Indian society. This environment is extremely conducive today for prospering of tourism sector. It might in turn lead to generation of employment and development of economy. In my district, the place of Bangarh should also be developed as a tourism spot of historical importance.

With these words, I thank you for allowing me to speak and conclude my speech.

डॉ. रघुवंश प्रसाद सिंह (वैशाली): सभापति महोदय, कोर्ट मे पेंच लग गया था,उसे सुलझाने के लिये यह बिल तात्कालिक तौर पर अध्यादेश को विनियमित करने के लिये यहां लाया गया है। ऐसा नहीं है कि हमारे हैरिटेज, गौरवशाली इतिहास, ऐतिहासिक धरोहर है, उसके उजागर करने, उसका संरक्षण, उसका ठीक से संचालन, उसके लिये सरकार बहुत उत्साहित है, इस विधेयक से यह साबित नहीं होता है। हिन्दुस्तान इस मामले में दुनियाभर में सब से ज्यादा गौरवशाली है। हमारा गौरवशाली इतिहास, सास्कृतिक ऊंचाई, वसुधैव कुटुम्बकम्, ग्लोबलाईजेशन को सिखाने चले है। सैंट कोलम्बस हिन्दुस्तान को खोजने चला था, अमरीका को खोजने नहीं चला था । वह तो उसका जहाज फंस गया और वह अमरीका जा पहुंचा। वास्कोडिगामा, इबन बतूता, अलबेरुनी, ह्वांग सांग, फाह्यान एक से एक विदेशी यात्री हिन्दुस्तान का गौरवशाली इतिहास देखने और उसका पता लगाने यहां आये। ब्रिटिश राज में कनिंघम ने खुदाई करायी लेकिन देश की आजादी के बाद कोई खुदाई करायी, कोई पता लगाया? एक खुदाई करने का काम जो ऐतिहासिक,प्रागऐतिहासिक, लाख वर्ष का इतिहास हिन्दुस्तान का, सांस्कृतिक धरोहर लेकिन हम नहीं जानते हैं कि उन जगहों को उजागर करने का, उन्हें संरक्षित करने का, उनका अनुसंधान करने का, उनका विकास करने का हुआ तो देशी और विदेशी पर्यटक आकर आकर्षित हों,िहन्दुस्तान के बराबरी में कोई मुल्क नहीं है। जनतंत्र भी यही पैदा हुआ। हिन्दुस्तान को जनतंत्र की माता कहा जाता है। जहां भगवान बुद्ध गये थे। मतलब यह है कि सात धर्मों का जो पालन करेंगा, समाज में उसकी अवनति नहीं होगी, उन्नति होगी।। वैशाली में लोग बार बार एकत्र होते हैं। 2500 वर्ष पहले भगवान बुद्ध का आब्जर्वेशन है। बार बार असैम्बल होते, बैठक करते , उसमें बहस करके निर्णय करते। नियम बनाकर हुकम जारी करते। Democracy is the rule of law। हमने अब्राहम लिंकन से प्रजातंत्र की परिभाषा नहीं सीखी। हमारे पुरखों ने हिन्दुस्तान में जनतंत्र को पैदा किया। इसीलिय़े राष्ट्रकवि दिनकर ने कहा - "वैशाली जन का प्रतिपालक,गण का वह विधाता, जिसे खोजता देश आज उस प्रजातंत्र की माता, रूको पथिक एक क्षण मिट्टी को शीश नवाओ, राज सिद्धियों की समाधि पर फूल चढ़ाते जाओ, फूल चढ़ाते जाओ। ये राष्ट्रकवि दिनकर जी की पंक्तियां गौरवान्वित करने वाली हैं। प्रजातंत्र की जन्मदाता यह धरती है। ग्रीस के लोग 2100-2200 वर्ष पहले का दावा करते हैं कि वहां जनतंत्र था, नहीं यहां साढ़े तीन हजार वर्ष पहले से लिक्षवी रिपब्लिक वज्जि संघ था। उस समय रजवाड़ों की दुनिया भर में व्यवस्था थी। उस समय रजवाड़े होते थे, लेकिन वहां कोई राजा नहीं होता था, चुने हुए प्रतिनिधि, पार्लियामेंट का नाम बै-संस्था-घा था, जहां पर शपथ लेते थे। हम हाउस में शपथ लेते हैं, वहां तालाब में अभी भी उसके अवशेष मौजूद है, अभिषेक पुष्करणी, जो लोग चुनकर आते थे, वे उसमें शपथ लेते थे। सरकार ने इनके बारे में क्या किया है? मैं जानना चाहता हूं कि क्या उन सब ऐतिहासिक धरोहर स्थल की जानकारी है, क्या कहीं खुदाई हुई है? कलिंगन खुदाई कराकर चले गये, उन्होंने जो बताया, हम उसका भी विकास नहीं कर पाये हैं। 100 मीटर, 200 मीटर तक घेरा, ठेका लगाने के लिए बिल लाये हैं और दावा करते हैं कि हम बड़ा भारी ऐतिहासिक और पुरातात्विक, हैरीटेज और धरोहर की व्यवस्था कर रहे हैं। महोदय, इनकी बहुत कम रूचि है, जानकारी नहीं है। अंधा चकाचौंध का मारा, क्या जाने इतिहास बेचारा। यह साक्षी है, चंद्र, खगोल, भूगोल, ये सब इतिहास बताता है। इसीलिए महोदय, भगवान बुद्ध की अस्थियां, जब वैशाली में महापरिनिर्वाण हुआ, उन्होंने भाषण किया कि नवें दिन हमारा महापरिनिर्वाण होगा। उत्तर प्रदेश के कोशी नगर में जब महापरिनिर्वाण हुआ, रात भर मारकाट की स्थिति हो गयी और अस्थियों का झगड़ा हो गया। प्रमुख शिष्य आनन्द और अनिरूद्ध आये और उन्होंने पंचायतें कीं। उनका विभाजन आठ जगहों पर हुआ और एक वैशाली को मिला, एक अभी अमरावती, आंध्र प्रदेश के गुंटूर जिले में मिला, एक उत्तर प्रदेश के सिद्धार्थ नगर जिले के पिपरहवा में भगवान बुद्ध की अस्थियां स्थापित हैं। सन् 1998 की खुदाई में वैशाली में मिला। मशहूर इतिहासकार डॉ. अलटेकर, काशी प्रसाद जायसवाल इंस्टीटय़ूट के डायरेक्टर थे। उन्होंने खुलाई करायी और अस्थियां मिलीं, लेकिन महोदय, अभी तक उसकी स्थापना का निर्णय नहीं हुआ है। भारत सरकार ने, श्रीमती अंबिका सोनी जी ने लिखित रूप में वहां के मुख्यमंत्री जी से कहा कि फंड एवलेबल है, परियोजना भेजी जाए। कल्चर विभाग में परियोजना भेजी गयी है। मैं माननीय मंत्री जी से कैटेगरीवाइज जानना चाहूंगा, एक सप्ताह के अंदर राज्य सरकार का प्रस्ताव आ गया है, भगवान बुद्ध की अस्थियों को स्थापित करने के लिए, उसका नाम रहेगा, बुद्ध सम्यक दर्शन संग्रहालय, राज्य सरकार ने जमीन एक्वायर करने की प्रक्रिया के लिए 32 लाख रूपए रिलीज कर दिये हैं, भारत सरकार का कमिटमेंट हाई कोर्ट में है, मिनिस्टर का लिखित में है, इसलिए अब इसमें देरी नहीं की जानी चाहिए। भगवान बुद्ध का सर्किट, भगवान महावीर का जैन सर्किट, चंद्रगुप्त अंतिम समय में वहां से चले थे, कर्नाटक के इन्दरगिरी, चन्दरगिरी, श्रवणबेलगोला, जो वहां पर स्थल है, वहां पर भगवान बाहुबलि की सैंकड़ों फिट ऊंची मूर्ति है, अभी तक उसे विश्व धरोहर में शामिल करने के लिए सरकार ने क्या किया है? सत्य और अहिंसा का संदेश जो भगवान महावीर के समय से हुआ। चन्दरगिरी, इन्दरगिरी पर्वत पर इसके ऐतिहासिक सबूत हैं, लिखा-पढ़ी में है। वहां धर्मस्थली और एक से एक पुराने जमाने की कला वाले मन्दिर, तंजावुर, आध्र प्रदेश, उड़ीसा में खारबेला, एक से एक, जिनका बौद्ध साहित्य में वर्णन है, स्थान का उल्लेख है। आध्र प्रदेश में, उत्तर प्रदेश में, महाराष्ट्र में, औरंगाबाद जिला, अहमदनगर में एक से एक ऐतिहासिक धरोहर हैं।

जहाँ खुदाई नहीं हुई, वहाँ खुदाई करवाने और उसके बाद उसको सुरक्षित रखने का इंतज़ाम करवाएँ। उसकी धरोहर को संरक्षित करने का, उसका विकास करने का, उसको संचालित करने का इंतज़ाम करवाएँ। एक से एक महापुरुष हुए - संत थिरुवल्लुवार, नारायण गुरु, आदिगुरु शंकराचार्य, संत सुंदरदास और एक से एक संत हुए। संत मध्वाचार्य, वल्लभाचार्य, रामानुजाचार्य, रामानंद, एक से एक ज्ञानी और दार्शनिक महापुरुष हुए हैं। उन सबका क्या इंतज़ाम है? उनके स्थलों को, उनके उपदेशों को संग्रहीत करने का क्या प्रयास सरकार रही है? इसलिए हमारे भारत के जो गौरवशाली और ऐतिहासिक तथा पुरातात्विक महत्व के स्थल हैं, उन सभी स्थलों के विकास की क्या कोई योजना है?... डॉ. रघुवंश प्रसाद सिंह: अब तो हम देश भर का लाखों वर्ष का इतिहास बता रहे हैं। महोदय, जो साहनी, निषाद और मल्लाह लोग हैं, उऩके देवता बाबा अमर सिंह हैं। सऊरा में समस्तीपुर जिला के शाहपुर पटवड़ी के नज़दीक कुँआ के बारे में सिकरी लोग कहते हैं कि बाबा अमर सिंह सोने की नाव पर आए थे और सिकरी बांध को उन्होंने कुँए में डुबाया हुआ है। उसी जगह शहीद बामरूप साहनी, शहीद झूडा साहनी हुए जिनका रिकार्ड में नाम ही नहीं है, वे आज़ादी के लिए फाँसी पर चढ़ गए थे, उनका रिकार्ड में नाम ही नहीं है। इसीलिए यह सारा सवाल है।... ( व्यवधान) विक्रमशिला, नालंदा, केसरिया, लोरिया आदि सभी स्थान बौद्ध पर्यटन के स्थान हैं। वैशाली भगवान महावीर की जन्मभूमि है। वहां चौमुखी महादेव, मीरनशाह की मज़ार, सूफ़ी सर्किट, अजमेर शरीफ़, फुलवारी शरीफ़, मकदूम साहब की मज़ार, बिहार शरीफ, करकांटी की मज़ार, सिरुकाही की मज़ार है। सूफी सर्किट, रामायण सर्किट और महात्मा गांधी सर्किट, इन सबका जब विकास होगा, तब हिन्दुस्तान का गौरवशाली इतिहास दुनिया में चमकेगा और आने वाली पीढ़ी जानेगी कि हम किनकी संतान हैं और वह भी गौरवान्वित होंगे और हमारा झंडा ऊँचा रहेगा।

श्री अनंत गंगाराम गीते (रायगढ़): सभापति महोदय, 23 जनवरी 2010 को महामहिम राष्ट्रपति द्वारा आर्डिनैन्स निकाला गया। उसे विधेयक के रूप में आज सदन के सामने यहाँ प्रस्तुत किया गया है। मैं इस विधेयक का समर्थन करता हूँ और सरकार का विशेषकर जो आर्कियोलॉजिकल डिपार्टमैंट है, उस मंत्रालय का और उसके साथ साथ जो पर्यटन मंत्रालय है, इन दोनों मंत्रालयों का ध्यान आकर्षित करना चाहूँगा।

सभापति महोदय: यह तो सिर्फ कल्चर मिनिस्ट्री से संबंधित है।

श्री अनंत गंगाराम गीते: मैं लंबा भाषण नहीं कर रहा हूँ। मैं इसके लिए दो-तीन सुझाव देना चाहता हूँ। मैं इस बिल का समर्थन करते हुए दो-तीन सुझाव देना चाहता हूँ।

सभापति जी, मैंने इऩ दो मंत्रालयों का ज़िक्र इसलिए किया कि हमारी हिन्दुस्तानी सभ्यता हिन्दुस्तान की बहुत पुरानी सभ्यता है। हमारा जो इतिहास है, वह बहुत समृद्ध इतिहास है। यदि हम तलाश करते हैं तो आपको इस देश के हर गाँव में एक आर्कियोलॉजिकल साइट मिल जाएगी। जैसे अभी रघुवंश बाबू यहाँ बोल रहे थे कि यदि हम फिर से खुदाई शुरू करते हैं तो हर गाँव में आर्कियोलॉजिकल साइट हमारे देश में मिल सकती है। भारत के कण-कण में इतिहास है।

इसलिए हमारा इतिहास काफी समृद्ध है। जो स्मारक हैं, चाहे वे बड़े-बड़े किले के रूप में हों, मंदिरों के रूप में हों या राजा-महाराजाओं के पैलेस के रूप में हों, ऐसे कई स्मारक हैं। हर गांव में आपको ये स्मारक दिखाई देंगे। मैं इस बात को टूरिज्म से इसलिए जोड़ना चाहता हूं, उस ओर सरकार का ध्यान इसलिए आकर्षित करना चाहता हूं कि सबसे पहले इन सारी आर्कियोलॉजिकल साइट्स को और हमारे मोन्यूमेंट्स को प्रौटेक्ट करने के लिए हमारे पास अपना कानून है, लेकिन उसमें हम सुधार कर रहे हैं। हम इस की ओर थोड़ा ज्यादा विस्तार से देख रहे हैं।

सभापति महोदय, उदाहरण के तौर पर महाराष्ट्र में रायगढ़ का किला है, जो छत्रपति शिवाजी की, उस समय के हिन्दवी स्वराज्य की राजधानी थी। उस रायगढ़ किले पर छत्रपति शिवाजी का एक पुतला लगाया गया है। हम अपने इतिहास की बात करते हैं, स्मारकों की बात करते हैं। जब हम अपनी सभ्यता की बात करते हैं, तो उससे इस देश की जनता की भावना भी जुड़ी हुई है। इस देश के लोगों की भावनाओं से जुड़ा हुआ हमारा इतिहास है। यह हमारी आर्कियोलॉजिकल साइट्स हैं, ये हमारे स्मारक हैं, मोन्यूमेंट्स हैं, उन से हमारी भावनाएं जुड़ी हुई हैं। वहां के स्थानीय लोगों ने मांग की कि वहां के स्टेचू पर छतरी बनायी जाये क्योंकि वह स्टेचू धूप मे हैं। लेकिन आर्कियोलॉजिकल डिपार्टमैंट मना करता है कि आप वहां पर छतरी नहीं बना सकते। मेरी समझ में नहीं आता कि हमने वहां पर स्टेचू लगाया है, जो धूप, बारिश और खुली छत में हैं। उसके ऊपर यदि हमें छतरी लगानी है, तो हमारा डिपार्टमैंट उसके लिए इजाजत नहीं देता। ये जो बातें हैं, या हमारी जितनी भी आर्कियोलॉजिकल साइट्स हैं, स्मारक हैं, आज देश मे जितने भी विदेशी पर्यटक आते हैं, वे इन्हीं स्मारकों को देखने आते हैं। आप औरंगाबाद में अजंता-एलोरा की गुफाओं में जाइए। अजंता-एलोरा में दुनिया भर के लोग आते हैं। वहां पर हमने उस जमाने में, पांच-दस हजार साल पुराने जो स्मारक बनाये हैं, कई पांडवों के जमाने से हैं, कई बौद्धकालीन हैं। जो अलग-अलग हमारे यहां के केव्ज है, वे पांडवों के जमाने से हैं, बौद्धकालीन हैं। जिस प्रकार उन्होंने इस कला को बनाया है, एक तौर पर आश्चर्य महसूस होता है कि जब कोई शास्त्र प्रकट नहीं हुआ था, साइंस, विज्ञान की इतनी प्रगति नहीं हुई थी, उस समय इतने बड़े-बड़े कला के स्मारकों का उन्होंने निर्माण किया है, तो उसे देखने के लिए देश-विदेश से लोग आते थे। ... सभापति महोदय: आपका समय ज्यादा नहीं है।

श्री अनंत गंगाराम गीते: मैं अपनी बात खत्म कर रहा हूं। मेरा सुझाव है कि जैसे हमें इनको प्रोटेक्ट करना है, वह हमारा इतिहास है। प्रोटेक्ट करते समय दुर्भाग्य से सबसे बड़ी शिकायत यह है कि आर्कियोलॉजिकल डिपार्टमैंट, जिनको इन्हें मैनटेन करना है, उनके पास मेन्टीनेंस के लिए, रख-रखाव के लिए धन नहीं है। आप बजट में क्या प्रोविजन करते हैं? हम आर्कियोलॉजिकल डिपार्टमैंट को कितना धन देते हैं? हमारे जो साइट्स हैं, उनकी मेन्टीनेंस ये डिपार्टमैंट नहीं कर सकते। जो हमारे मोन्यूमेंट्स हैं, उनकी मेन्टीनेंस आप नहीं कर सकते। यदि हमारे इतिहास को, हमारे स्मारकों के रख-रखाव के लिए यदि कोई निजी संस्थाएं आगे आती हैं, यदि कोई निजी लोग इसके लिए आगे आते हैं, तो हमें ये रुख अपनाने की आवश्यकता है कि इस इतिहास को हमें हमेशा के लिए रखना है, उसे संभालना है, तो उसके रख-रखाव की ओर भी ज्यादा ध्यान देने की आवश्यकता है। उसके लिए अधिक तौर पर धन देने की आवश्यकता है और थोड़ा फलैक्सीबल व्यू इन सारे स्मारकों के बारे में होने की आवश्यकता है। ये हमारे सारे स्मारक दुनिया के सबसे बड़े टूरिस्ट डेस्टीनेशन के तौर पर माने जाते हैं और आज देश-विदेश से लोग इन स्मारकों को देखने के लिए आते हैं। मेरा सुझाव इतना ही है। मैं इस विधेयक का समर्थन करता हूं, लेकिन जो हमारे स्मारक हैं, उनके रख-रखाव की ओर अधिक ध्यान देने की आवश्यकता है।

SHRI P.C. CHACKO (THRISSUR): Mr. Chairman, Sir, I support the Ancient Monuments and Archaeological Sites and Remains (Amendment and Validation) Bill, 2010.

I would also like to congratulate the hon. Minister who has reminded responsibility of every citizen which he quoted from Article 51A of the Constitution which says that it shall be the duty of every citizen of India to value and preserve the rich heritage of our composite culture.

This Bill and the introductory speech made by the hon. Law Minister gave us an assurance. The assurance he has given not only to this House but also to the whole country is that how much importance we are attaching to this Bill. In his own words, he has said that even for the Government’s purpose, they will not allow, in future, to tamper with our archaeological monuments and sites so that the posterity will not blame us. These words are echoing in our ears. I consider this as a great assurance from the hon. Minister of Law.

There are one or two technical points which I would like to mention. The Hon. Member Shri Ramesh Bais, while opposing this Bill, said that this Bill should be referred to the Standing Committee. Our Standing Committee system is such that whenever we are not getting sufficient time to discuss a Bill or any matter in this House, the matter is referred to the Standing Committee. Today, this whole House is getting an opportunity to discuss, in detail, this very Bill. So, referring this Bill to the Standing Committee is not a good thing. The Standing Committee is not more important than the House. So, we are getting full time to discuss the Bill in this House. It has almost exceeded two-and-a-half hours now. We have been discussing this Bill for such a long time.

He has also said that this Ordinance was not necessary. It is very well explained by the hon. Minister and so I need not repeat it. The High Court of Delhi has made it very clear. In a Public Interest Litigation, the High Court has said that the restriction made by the Government of India by a Notification should be amended. The point is that 100 metres from the monument site is considered as a prohibited area. Another 200 metres is considered as a regulated area. This restriction was found unsatisfactory by the High Court of Delhi. I am not questioning the wisdom of the High Court of Delhi. In this kind of a situation, what could have been done by the Government? As the High Court has said, the monument-specific restriction should be imposed. The “monument-specific restriction” means a lot. The point is that 3675 monuments are now under the Archaeological Survey of India. So, within a limited time of 15 days, if the High Court says that the Government of India should make monument-specific restriction, it is humanely not possible. So, probably, the Government of India, the Department of Culture has decided that an Expert Advisory Committee would be formed. Again, the Delhi High Court has said in a subsequent judgment that the Expert Advisory Committee is illegal and it should be dispensed with. This is a very peculiar situation where the Government had no other option. So, the criticism that the Ordinance was brought forward with some ulterior motive was not correct. In fact, if anybody has that in mind, that was made very clear by the hon. Minister. So, the Government had no other way.

It was also made very clear that very important developments were taking place including that of the Commonwealth Games, the Delhi Metro System. Some important public works were also connected with this. In such kind of a situation, everything would have come to a grinding halt had the Government not taken proper steps. To avoid that situation, the Government has brought in an Ordinance.

Again, the third judgment from the Delhi High Court is that all the 171 permits and sanctions which were given since 1992 should be cancelled. In that kind of a situation, the Government approached the High Court, got some time and then went in for a Special Leave Petition before the Supreme Court. In-between, an Ordinance was promulgated and now this is coming before the House. Using all the avenues and finally without any option, when it is coming here, this Government cannot be blamed for this.

Sir, you are adoring the Chair. So I cannot refer to your speech. I may say that an hon. Member from Orissa also mentioned about the Prime Minister’s statement. It shows about the abundant caution from the side of the Government. What did the Prime Minister say? The Prime Minister said that it should be in the public interest. The Indian Express Report which the hon. Member from Orissa quoted here in this House is that it should not be for any private interest. This Government do not have any ulterior motive and this Government do not have any private interest other than the public interest. Shri Suresh Kalmadi is sitting here. The Commonwealth Games Committee is coming here every now and then and watching the progress of our preparations for the Commonwealth Games. India’s prestige is involved here and so we cannot stop the public works in this kind of a situation. Probably even when the Ordinance was to be promulgated, our hon. Prime Minister made it very clear that it should be for the public interest. This has come in The Indian Express and that has been quoted here.

Sir, I would like to say one thing which has already been mentioned by many hon. Members of this House. The Archaeological Survey of India is looking after nearly 4,000 monuments and archaeological sites and remains. We have got a very rich cultural heritage in this country. I come from the southernmost tip of the country. We have the Jewish Synagogue in Kochi, we have the Madurai Meenakshi Temple and various other monuments in the South. We have some beautiful ancient monuments like Ajanta, Ellora caves, Konark Sun Temple, Sanchi Stupa, Mount Abu, Bhilwara Temple etc. This country is full of rich heritage with a large number of monuments. With a miniature budget provision which is allotted to the Archaeological Survey of India, how can they protect them? So, I would request the hon. Minister that we have to support the Archaeological Survey of India by allocating more money to them. Any visitor to these wonders of India – these archaeological sites – can understand that this rich heritage has no parallel in the world. These have to be preserved. So, they have to be provided with more money.

Then, we do not have the technical know-how and modern technology to preserve them. We do not have the technology, we do not have any research division, we do not have the chemical preservation methodology available here and in the World Heritage sites which are there today, all these modern techniques are applied. So what are available with us today, we cannot preserve them. They are all in a precarious condition now. We have to preserve them, enrich them and hand them over to future generations. We need more scientific and technological know-how to preserve all our heritage sites. This Bill has been brought before this House with all the good intentions and I wish that the House fully supports it.

Sir, the hon. Minister Shri Veerappa Moily said that 95 heritage sites have just disappeared. Shri Ramesh Bais opposed this Bill. But we know how one heritage site, the Babri Masjid, disappeared. Somebody responsible for that is sitting on the other side. For various reasons, our heritage sites are being destroyed and they are disappearing. If this is happening in this country, we should put an end to it. For that, I wish that even with some reservation, those who opposed this Bill may also support it and let this be the wish of the people of India that we are determined to protect and preserve and conserve the archaeological sites of India.

SHRI KALYAN BANERJEE (SREERAMPUR): Mr. Chairman, Sir, I support the Ancient Monuments and Archaeological Sites and Remains (Amendment and Validation) Bill, 2010. But at the same time, I would like to place certain things before this august House. At a very late stage, anyhow the Central Government has understood the fault which has been committed when the original Act was enacted.

My predecessor friend was just speaking about the reference of the Delhi High Court’s judgement and a statement was also circulated by the hon. Minister.

With my experience, I have seen that it is not only the Delhi High Court’s judgement, but in fact there are a number of matters arising out of judgements of the Bombay High Court. Right from 2003-04, on several occasions they have observed that this Act is faulty. In fact, whenever the Act is placed in operation earlier, so many faults have been found.

I do not know whether by only amending certain provisions that part would be ultimately rectified or not, future days will speak on that. There are certain provisions also and my observations are also there whether this part can be given a retrospective effect or not, that would be decided later on, I am not on that. But I would like to point out that Kolkata is having one pride and it is called Victoria Memorial Hall. It is really unfortunate that the officers of the Central Government of this Department have never taken care to protect this Memorial Hall. In fact, there was a Public Interest Litigation only that right from 1998-99, this Kolkata Memorial Hall is being protected till now under the orders of the court.

No doubt, everyone is supporting this Bill, but what are the officers doing? Why have the people to go to the court and file a Public Interest Litigation for protecting the ancient monuments and archaeological sites? It was happening at one point of time that the brightness of the Victoria Memorial Hall was almost obliterating and in fact, by reason of the court’s order it has now been protected. Now, when the High Court interfered, ultimately it is again coming on the surface. Today, in Kolkata, nobody within 200 metres of the Victoria Memorial Hall can park even a car for the purpose of protecting the Victoria Memorial Hall.

My point is why does the court have to take care about this? What are the officers of the Central Government doing? The Government is having a wish, enacting an Act and I see that everyone here almost is supporting this. But what are these officers doing? I would request the hon. Minister to take care of these monuments and urge him to see that these monuments are really protected and his officers should rise to the occasion now.

We feel really proud for all this. But I would like to know why there is this lackadaisical attitude of the Central Government officers. Even today, no one can construct any shop within 200 metres of Victoria Memorial Hall. The court is so concerned about it. Public spirited persons are going before the court and they are protecting it. I am supporting this Bill. I have some reservations on certain provisions of this Bill and I do not know whether in future what would be the ruling of the court on that. I am not on that.

My point is that the Central Government, particularly, this Department must send a message to all its officers that these should be protected in a right manner and that there should not be a lackadaisical attitude. I would also request the hon. Minister to bring all the orders of the courts that have been passed, try to find out as to whose fault was it that the people had to go to the court and to take steps against those faulty officers.

डॉ. गिरिजा व्यास (चित्तौड़गढ़):सभापति महोदय, मैं आपको धन्यवाद देती हूं कि आपने मुझे इस महत्वपूर्ण विषय पर बोलने का मौका दिया। मैं इस रिपोर्ट की इस बात को कोट करती हूं, the past has not passed; it is still passing by. मैं यहां पर आज स्व. राजीव जी को श्रद्धांजलि भी देना चाहती हूं। राजीव जी को केवल 21वीं सदी में ले जाने के लिए नहीं, केवल कंप्यूटर इंट्रोडय़ूस करने के लिए नहीं, राजनीति में केवल महिलाओं की भागीदारी सुनिश्चित करने के लिए नहीं, बल्कि राजीव जी को एक नाम के लिए और जाना जाना चाहिए कि किस तरह से हमारे मोनूमैन्ट्स और हमारी सांस्कृतिक धरोहर प्रिजर्व रहे। इसीलिए मुझे याद है कि उन्होंने न केवल कल्चरल सैंटर्स खोले, उनका मंशा उनकी असामयिक मृत्यु के साथ चली गई। लेकिन मंशा यह थी कि हमारे मोनूमैन्ट्स जिंदा रहें, हमारी पर्फोर्मिंग आर्ट जिंदा रहे और हमारी चित्रकलाएं भी जिंदा रहें। इस तरह से उन्होंने जो प्रयास किया था, आज उस प्रयास की दिशा में यूपीए की सरकार आगे बढ़ रही है और सोनिया जी स्वयं यहां बैठी हुई हैं। इसलिए मैं सदस्यों को इस बात के लिए निश्चिंत होने के लिए कह सकती हूं कि वे सरकार की मंशा को किसी प्रकार के अपवाद के घेरे में न लें, सरकार की मंशा निश्चित तौर पर स्पष्ट है कि हम अपने मोनूमैन्ट्स की रक्षा करना चाहते हैं।

महोदय, मुझे याद है कि राजीव जी के जमाने में इन्टैक ने जिस तरह से कार्य किया था, उसका मुझे एक वाकया याद है कि उदयपुर में सज्जनगढ़ पर मैं लाइट लगाना चाह रही थी, जब मैं टूरिज्म मिनिस्टर थी और तब मैंने कहा कि राजीव जी यह पास नहीं हो रहा है तो उन्होंने कहा कि यह तो क्लियर कराना पड़ेगा, न केवल सरकार से, बल्कि इन्टैक से भी पास कराना पड़ेगा, क्योंकि वे संस्थाएं आगे आकर हमारे मोनूमैन्ट्स की रक्षा करती हैं। इसके अलावा मोइली साहब मैं आपको भी धन्यवाद देना चाहती हूं, सोनिया जी की मंशा को भी धन्यवाद देना चाहती हूं कि हर एक पल वह उनके साथ थीं और आज यहां हाउस में जब इस बिल डिस्कशन हो रहा है तो यहां पर उनका बैठना इस बात की ओर संकेत करता हूं कि हमारी अपनी सांस्कृतिक धरोहर के प्रति उन्हें कितनी चिंता है।

लेकिन मैं यहां यह निवेदन भी करना चाहती हूं, जो आपकी रिपोर्ट में भी है, इसमें जो बजट एलोकेशन है, वह हमारे पूरे बजट का 0.12 परसैन्ट है और उसमें भी आर्क्योलोजी आदि का एक-तिहाई निकाल दें तो हमारे प्रिजर्वेशन के लिए केवल 0.04 परसैन्ट बचता है। इसलिए मैं सोचती हूं कि जब बिल पास हो तो रूल्स में इस बात को जरूर डालें कि इस बजट को बढ़ाना किस तरह से आवश्यक है।

हमें एक बात और याद आ रही है कि जब राजीव जी ने यह कहा था कि हमें इसे दो भागों में विभाजित करना होगा। आपने अथॉरिटी की बात करके एक तरह से उनकी मंशा को पूरा करने की कोशिश की है। इसके लिए मैं मंत्री जी को धन्यवाद देना चाहती हूं। उसमें प्रथम है थीमवाइज और दूसरा है सैक्टरवाइज। थीम में उन्होंने कहा था कि हमें सिंधु घाटी की सभ्यता से लेते हुए वैदिक पीरियड से, रघुवंश जी मैं आपकी बात ही कह रही हूं, हमे उसके बाद सिंधु घाटी की सभ्यता, वैदिक पीरियड, एपिक्स के जो हमारे पीरियड्स हैं और इसमें मोइली जी से ज्यादा कौन जान सकता है, जिन्होंने अपनी पोयट्री में एपिक्स को, रामायण को लिखने की कोशिश की है। इसमें बुद्धिस्ट पीरियड है, मौर्या, अशोक, गुप्ता, राजपूताना, मराठा, मुगल और उसके बाद ब्रिटिश पीरियड है, गौथिक पीरियड है और उसके बाद हमारा माडर्न पीरियड है, जिसमें आनंद भवन का जिक्र भी हमारे साथी ने किया था, ये सब सम्मिलित हैं। दुख की बात यह है कि चार हजार मोनूमैन्ट्स की रक्षा करने के बावजूद भी आज बहुत से अधूरे हैं। इसलिए सरकार की मंशा पर कोई शक नहीं कर सकता क्योंकि कम से कम उस अधूरेपन को दूर करने का प्रयास इस अध्यादेश के द्वारा किया जा रहा है। इस अध्यादेश की आवश्यकता पर हमारे साथियों ने बहुत विस्तार के साथ कहा कि इसकी आवश्यकता क्यों पड़ी। संभवतः यह आवश्यकता भी इस बात को लेकर है कि एक तरफ हमारे देश में गेम्स होने वाले हैं, निश्चित तौर पर जिसमें हमारे देश का नाम होगा। लेकिन दूसरी तरफ हमारे टूरिज्म, आर्ट और कल्चर को संरक्षित करने के लिए भी हम लोगों को प्रयास करना चाहिए। मैं यह भी निवेदन करूंगी कि अथॉरिटी के निर्माण में, अथॉरिटी के बनाने में उन लोगों का सहयोग लिया जाए, जिनकी इसमें रुचि हो और तीन बातों का विशेष रूप से ध्यान रखा जाए - प्रथम आपके सर्वे का कार्य बहुत ढीला होता है, रिसर्च और उत्कीर्णन। मैडम यहां विराजी हुई हैं और मैं आपके माध्यम से मंत्री जी से निवेदन करना चाहूंगी कि चाहे वह दिलवाड़ा का टैम्पल हो, मैं राजस्थान से आती हूं और राजस्थान के बारे में कहा जाता है कि वहां हर 12 मील पर हमारी भाषा बदलती है, हमारा पानी बदलता है। परंतु मैं कहती हूं कि हर 12 कदम पर हमारे यहां सांस्कृतिक धरोहर है। उन धरोहरों में से केवल दो का जिक्र मैं यहां करूंगी, जिनके बारे में अभी तक नहीं कहा गया - बाड़मेर का अर्थुना है, जिसमें पालीवालों के गांव, जो उस समय की हमारी संस्कृति है, यह कम से कम 9वीं शताब्दी के हैं, लेकिन उन पर कुछ ध्यान नहीं दिया जा रहा था।

दूसरा बांसवाड़ा है, वहां टैम्पल के टैम्पल पता नहीं कि किस शताब्दी के थे, वहां रिसर्च भी नहीं हुआ है। इसलिये रिसर्च, उत्खनन और सर्वे - इन तीनों को हमारे नियमों में डालने की कृपा करें। जहां वियना केवल म्युजियम्स के कारण, ताशकंद केवल एक मदरसा के कारण, यूरोप के अनेक देश केवल फोर्ट्स एंड पैलेसेज के कारण, जहां इंगलैंड केवल पैलेसेज के कारण, जहां पाकिस्तान केवल तक्षशिला के कारण, जहां चीन दीवार के कारण और केवल एक-एक मौनूनेंट के कारण आज विश्व में अपना स्थान बनाये हुये हैं। आज दिल्ली जैसी जगह पर भी हम देख लें कि कम से कम 150 मौनूमैंट्स यहां मिल जायेंगे। मेरे घर तक जाते हुये 10 मौनूमेंट्स हैं। इसलिये सरकार के मंत्री ने जो रिपोर्ट दी है, उसे लेकर कहती हूं कि ईसा पूर्व और उसके बाद इसको निश्चित तौर पर हम लोगों को दो भागो में बांट देना चाहिये और सैक्टर और थीम वाईज जैसे फोर्ट्स आदि उन भागों में बांटेंगे तो उस कार्य से हम लोगों को निश्चित तौर पर फायदा मिलेगा। सभापति महोदय, मैं ज्यादा वक्त नहीं लेना चाहती लेकिन केवल कानून ही पर्याप्त नहीं है। कानून का इंपलीमेंटेशन भी आवश्यक है। इसलिये कृपा करके ऐसे नियम बनाये जायें जिसमें राज्य सरकारों को इंपलीमेंटेशन करने में कठिनाई न हो। केवल केन्द्र सरकार के ऊपर न डाल दें कि यह केन्द्र की जिम्मेदारी है कि केन्द्र से कुछ आयेगा तभी इंपलीमेंट होगा। दूसरा अवेयरनैस का है। डा. रघुवंश प्रसाद जी ने भी कहा है। मैं उनकी इस बात का समर्थन करती हूं लेकिन उन्हें बताना चाहती हूं कि आज हम लोगों में कितनी अवेय़रनैस है?किसी भी फोर्ट पर, किसी पैलेस पर टैम्पल पर तपाक से लोग थूक पड़ते हैं जब हम उसकी रक्षा नहीं कर पाते हैं, इसके लिये जिम्मेदार कौन है? इसके लिये अवैरनैस की आवश्यकता है। मैं राष्ट्र कवि दिनकर की पंक्तियां उदृधत करना चाहूंगी - " समर शेष है किन्तु नहीं है दोषी केवल व्यास, जो तटस्थ है, समय लिखेगा उसका भी अपराध। इस सदन ने तटस्थ न रहकर एक एक स्वर में इस बिल को पास करने के लिये जो जो अपनी सहमति जताई है, वह अपने आप में बहुत आवश्यक है।

सभापति जी, नियम में कम से कम यह डालें कि मैं चित्तौड़ आती हूं , वहां के किले में लोग अभी तक रह रहे हैं, उनके लिये पानी आदि की व्यवस्था चाहिये। इन नियमों में अलग अलग राज्य की समस्याओं को लेकर उनका समाधान करने की कोशिश करें तो निश्चित तौर पर यह बिल एक पहला कदम है लेकिन यह पहला कदम आखिरी दिशा की तरफ ले जायेगा और हमारी धरोहर की रक्षा करने में सहायक सिद्ध होगा।

*श्री पन्ना लाल पुनिया (बाराबंकी)ः हमारी ऐतिहासिक एवं सांस्कृतिक धरोहर के रखरखाव उसका चयन, सुरक्षा प्रदान करने के लिए संसद द्वारा ANCIENT MONUMENTS AND ARCHAEOLOGICAL SITES AND REMAIN ACT 1958 मौजुद है। आज इसी एक्ट में संशोधन किए जाने का प्रस्ताव है। Statement of Reason & Objectives & Statement under rule 71 (I) Rules of Procedure and conduct of Business in Lok Sabha में माननीय मंत्री जी के द्वारा विस्तार से बताया गया है कि इस एक्ट में पहले ओर्डिनेन्स के माध्यम से क्यों संशोधन किए जाने की आवश्यकता थी।

इस अधिनियम के अंतर्गत देश के ऐतिहासिक एवं Ancient Monuments and Archaelogical sites के रखरखाव एवं सुरक्षित रखने का अधिकार भारत सरकार में संस्कृति विभाग के अंतर्गत Archeological Survey of India के ऊपर जिम्मेदारी है। आज इनकी संख्या 3675 है। राज्य सरकारों ने भी अपने स्तर से ऐसे स्थलों का चयन किया और उसकी संख्या भी लगभग 4000 है। देश में केन्द्र सरकार के द्वारा तथा राज्य सरकारों के द्वारा लगभग 8000 साईट्स का चयन किया गया है।

इसी एक्ट के अंतर्गत केन्द्र सरकार ने 16.6.1992 को इन Notified Monuments के आस-पास Prohibited Zone तथा Regulated Zone का निर्धारण किया है। इन Monuments के 100 मीटर की दूरी तक Prohibited Zone बनाया गया और इनके बाहर 200 मीटर तक Regulated Zone निर्धारित किया गया। हाईकोर्ट ने कहा हर Monument के लिए जमिनी हकीकत को ध्यान में रखते हुए अलग-अलग Prohibited तथा Regulated Zone बनाए जाएं। यह बड़ा व्यापक कार्य था इसके साथ एक्सपर्ट कमेटी की रिकमण्डेशन पर Director General Archeological Survey of India द्वारा 171 निर्माणों की अनुमति दे दी गई, जिनमें से 93 केवल दिल्ली से संबंधित है। इनमें 9 मैट्रो रेल और कॉमनवैल्थ गेम्स से सम्बन्धित है। हाईकोर्ट ने पुनः आदेश जारी कर एक्सपर्ट कमेटी को समाप्त कर दिया, भविष्य में स्वीकृति देने पर पूर्ण रूप से रोक लगा दी गयी तथा पूर्व में दी गयी समस्त स्वीकृतियों पर पुनर्विचार करने के लिए भी आदेश दिया गया। इन सभी कठिनाईयों को ध्यान में रखते हुए अध्यादेश के माध्यम से संशोधन किया गया और उस संशोधन का Revalidation Bill तथा एक्ट में संशोधन कर व्यापक प्रस्ताव प्रस्तुत किया गया है। भारतीय संस्कृति एवं पुरातत्व खजाने की रखरखाव, सुरक्षा को चुस्त-दुरस्त करने के लिए यूनेस्को कन्वेशनशन, 1972 में कहा गया था और जिसका Ratification भारत सरकार के माध्यम से 14 नवम्बर, 1977 में किया गया था। इसकी तर्ज पर यूनेस्को कन्वेशन, 1972 जिसका Ratification किया जा चुका है, उसी की तर्ज पर National Heritage Commission की स्थापना की जानी है। जिसका भी प्रावधान इस संशोधन अधिनियम में किया गया है। इस National Heritage Commission को निति निर्धारण करने के लिए भारत सरकार को सुझाव देने का अधिकार है, पुरातत्व स्थलों की पहचान करने के लिए रिसर्च कार्य करने का अधिकार है। World Heritage Sites के लिए यूनेस्को को नोमिनेशन भेजने हेतु स्थान चयन कर भेजने का अधिकार है और राष्ट्रीय महत्व के स्थलों का रोस्टर तैयार करना भी इनका दायित्व है।

आज के दिन केवल 8000 Archeological Sites है जिनका की राज्य सरकार एवं केन्द्र सरकार मिलाकर देखभाल करते है। जिसमें से भारत सरकार और Archeological Survey of India के अन्तर्गत 3675 साईट्स है और 4000 साईट्स राज्य सरकारों द्वारा देखी जा रही है। यूनेस्को द्वारा घोषित 27 Archeological Sites हैं जिनमें ताजमहल, कोनार्क सूर्य मन्दिर, इलौरा कैव, लाल किला, कुतुब मीनार आदि है, जिन्हें पूरी दुनिया से लाखों लोग देखने आते हैं। आज जो संशोधन कर रहे हैं उसके माध्यम से इसमें विस्तृत ध्यान देकर पहचान करने की आवश्यकता है। आज 8000 साईट्स की हम बात कर रहे हैं लेकिन ये 8000 साईट्स केवल पूरे देश में जितनी भी साईट्स हैं उनका 1 या 2 प्रतिशत है। लाखों की संख्या है, जिनका अभी तक न तो पहचान की गई न ही चयन किया गया है और न ही किसी प्रकार की सुरक्षा की व्यवस्था की गई है। पुराने अधिनियम में ANCIENT MONUMENTS AND ARCHAEOLOGICAL SITES AND REMAIN ACT 1958 में केवल उन्हीं स्थलों की देखरेख की व्यवस्था की गई जो कि 100 वर्ष ज्यादा पुराने हों आज वर्तमान में अनेकों/अनेकों ऐस MORDEN ARCHAEOLOGICAL SITES हैं जिनकी सुरक्षा का दायित्व राष्ट्र को उठाना चाहिए। उसको ध्यान में रखते हुए भी इस संशोधन की आवश्यकता है। भारी संख्या में हमारे HISTORICAL MONUMENTS पर अनाधिकृत कब्जा किया जा रहा है। आज ए.एस.आई. के 24 सर्किलों में से 22 सर्किलों में अनाधिकृत कब्जे है। 249 हैरिटेज साईट्स पर अनाधिकृत कब्जा है। आपके एलोरा कैव मंदिर, सासाराम स्थित शेरशाह का मकबरा, लेह में लामा युरू की Monastery फैजाबाद में 18वीं सदी में बना बहु बेगम का मकबरा ये सभी महत्वपूर्ण स्थल है, जो अनाधिकृत कब्जे में है। इन अनाधिकृत कब्जों को हटाने के लिए भी इसमें प्रावधान किया गया है और National Heritage Commission को इसका दायित्व दिया गया है।

निजी लोगों के पास भी काफी ANCIENT MONUMENTS है, क्योंकि वह उनकी निजी सम्पत्ति है, उसके रखरखाव, निगरानी, सुरक्षा रखने की भी आवश्यकता है। पुराने महलों को होटलों में बदला जा रहा है, मूलभूत परिवर्तन न हो इस पर निगरानी करने की आवश्यकता है, इसको संशोधन में National Heritage Commission यह अधिकार दिया गया है कि निजी सम्पत्तियों की देखरेख/िनगरानी करने के लिए निर्देश दिया जा सकता है। निर्देशों की पालन न करने पर 2 साल की कैद या 1 लाख का जुर्माना या दोनों का भी प्रावधान किया गया है। यह एक महत्वपूर्ण संशोधन है।

कुछ MONUMENTS गायब हो गए हैं। 35 राष्ट्रीय महत्व के साईट्स गायब हो चुके है, दिल्ली अकेले में 11 MONUMENTS गायब है। 1950 में 157 Heritage Monuments of National Importance की गिनती हुई थी, जिनमें से 11 गायब है। ये 11 की संख्या कम नहीं है। कुल 8675 में से 11 गायब होना जबकि उनकी सुरक्षा केन्द्र व राज्य सरकारों के माध्यम से की जा रही थी, जो चिंता का विषय है। 1984 के आर.एन. मिर्धा कमेटी ने यह संस्तुति की थी कि देश में कुल 9000 साईट्स को प्रोटेक्शन प्रदान किया जाए, लेकिन हम आधे से भी कम 4000 को ही प्रोटेक्शन दे पाये है। ये एक ऐतिहासिक कदम है जो चाहे न्यायालय के आदेश से हो या यूनेस्को कन्वेंशन के आधार पर हो लेकिन जितने भी प्रावधान किए गए वे बहुत महत्वपूर्ण है, इनका पूरे सदन के द्वारा पूरजोर समर्थन किया जाना चाहिए और सर्वसम्मति से बिल को पास किया जाना चाहिए। यदि कोई कठिनाई होती है आगे उन पर अलग से विचार करके संशोधन प्रस्ताव लाया जा सकता है। मेरा निवेदन है कि जो संशोधन बिल को पास किया जाए, मैं उसका समर्थन करता हूं। इससे जुड़ा हुआ एक महत्वपूर्ण बिन्दु पर ध्यान आकर्षित करना चाहता हूं। देश में हमारे राष्ट्रीय नेताओं की मूर्तियां लगायी जाती है। यह निर्धारित करने की आवश्यकता है कि किन-किन राष्ट्रीय नेताओं की मूर्तियां लगायी जा सकती है। उत्तर प्रदेश में प्रदेश की मुखिया स्वयं अपनी मूर्ति लगवा कर इतिहास में जगह बनाने का प्रयास कर रही है। बाबा साहब डा. अम्बेडकर ने कभी अपनी मूर्ति लगाने के लिए नहीं कहा लेकिन लोगों ने बिना सरकारी खजाने से पैसा लगाए स्वयं चंदा करके लाखों की संख्या में उनकी मूर्तियां लगायी है। लोगों के लिए अच्छा काम करेंगे तो लोग स्वयं उन्हें याद करेंगे। लोगों के दिलों में जगह बनाओं। इस पर स्पष्ट नीति होनी चाहिए। जो स्वयं को महिमा मंडित करने का प्रयास करता है, धन का दुरूपयोग करता है उन्हें दंडित किया जाना चाहिए। मैं अंत में इस ऐतिहासिक बिल का समर्थन करता हूं।

SHRI M. VEERAPPA MOILY: Mr. Chairman, Sir, I salute all the hon. Members who have contributed to this great debate, particularly on the culture and heritage of this great country.

Arnold Toynbee, a great historian, had said that out of 21 world civilizations, 19 civilizations perished because of the loss of character of their respective civilizations. In fact, a character of the nation is reflected through its culture of the nation, culture of the people. I must tell you that today’s debate has really reflected the culture of this great nation. That is why, I salute all of you. I am really moved by the level of deliberations which has been held. That is why, we always say: “It is a proud India and we continue to be the proud Indian”.

First of all, let me deal with the situation as to why this Ordinance was issued. Yes, it is not an ideal thing to issue an Ordinance. Ordinances are issued only under inevitable situations. There are a number of litigations going on all over the country, in many of the High Courts and also including the Supreme Court.

In fact, the Delhi High Court ordered Show Cause Notice, asked them to stop the work, issue the notices as against the permission issued by the Archaeological Survey of India (ASI). In fact, there are nine Commonwealth Games sites. In total, there are as many as 33 pubic projects including the Metro of Delhi, Metro of Bangalore and many other projects. They would have come to a grinding halt.

In fact, the option to file an SLP before the Supreme Court was also thought about, but as the Supreme Court was to be opened only on 4th January, 2010, it was not possible even to file an SLP and obtain stay. So, as a last resort, this Ordinance was attempted to.

When the Ordinance was issued, certain concerns had been raised by many important persons. That is why instead of only dealing with the technical aspect of the permission granted or the validation to be obtained, I think, this Bill has travelled beyond those technical objectives.

There were some concerns raised after the Ordinance was issued. The first concern was ‘that the definition of prohibition areas and regulated areas lack clarity and that there are certain elements of open-endedness; the provisions may further accelerate encroachment and unauthorised construction in the prohibited areas.’ That is how, you can find in the Bill that these questions have been totally addressed.

The second concern was ‘that the Ordinance might be construed as not fully safeguarding the interest of ancient monuments and archaeological sites.’ We have made absolute provisions for this.

The third concern was ‘that the Ordinance validates all constructions including those that were granted ex post facto permissions.’ The ex post facto permissions granted by the Empowered Committee have not been validated in this Bill and also by the Ordinance.

The fourth concern was ‘that the Ordinance lacks punitive provisions’. What was provided was only three months punishment. We have now extended it to two years.

The fifth concern was ‘that it does not impose any obligation upon the Archaeological Survey of India for identification of unauthorised construction.’

So, these were the five concerns, which were raised. Instead of purely limiting to the validation of the permissions granted, we have dealt with that thoroughly.

I can just elaborate some of the provisions, which have been made in this Bill. I do not say that this is the cure of all diseases. I do not say that. But this has definitely given a very positive, appropriate and clear-cut direction for the future to building up, preserving and conserving our monuments.

‘One hundred metres in all directions shall be the prohibited area.’ -- there was no clarity here. Now, we are providing that the Central Government can increase this 100 metres a little more and that would be monument specific. In fact, Mr. Chacko has already mentioned it. Many of the hon. Members have expressed that waiting for a Bill or leaving things as it is, would have led to a lot of vacuum. The classification, the gradation of the monuments is an easy job, which has not been done all these 100 years. The idea is that we need to get into that area of classification, monument-specific. Ultimately, we will be getting into the domain of absolute protection of the monuments.

Then, we have, now, totally prohibited any permission within the prohibited areas, which was not so. That is how, now even including the public projects in future, the Government should plan the projects in such a way that none of them will come within the prohibited areas. This is a great and radical change which we have injected in this Bill.

Repair or renovation in prohibited areas can be allowed, and that too for basic things, basic amenities like sanitation and water supply. Even with regard to the limits of regulated area, we have modified it. Two hundred metres in all directions shall be the regulated area in respect of such protected area or protected monument. The Central Government can even increase the limit of 200 metres of the regulated area. This was never done. I can just incidentally tell you that earlier even the Monuments Act of 1958 did not provide any substantive Act with regard to the prohibited area or the regulated area. It was provided only under the rules. Now, we have strengthened it by including and incorporating this Act, even though it was not necessary for the limited purpose of regularly validating those permissions.

That demonstrates the fact that the Government has absolute bona fide intention in bringing out this Bill so that no meddling of these monuments could take place by anyone at any point of time. ‘Categorisation and classification of ancient monument’ is a new Section which has been added under Section 4A. The Government can prescribe categories and classification of ancient monuments or archaeological sites and remains declared as of national importance under Sections 3 and 4, and exhibit the same on its website and also in such other manner as it may deem fit. We have injected the transparency in that. Every public will know about it.

We have provided provision for preparation of Heritage byelaws in respect of each protected monument or protected area. We have provided for preparation of the technical inventory. We do not have the data. We want to reflect what is there in that particular monument. None of the description was available. Inventory was not available. It means, if we allow the same situation, the time will come that ultimately the monuments will remain only in paper and not in the actual monuments demonstrated in the public.

Another is constitution of the National Monuments Authority. There was no National Monuments Authority at all. This will consist of archaeological experts and heritage experts. Yes, we have deliberately avoided even a former or a present judge presiding over it, nor even a civil servant will be in it and not even a legal officer will be in it. It will be absolutely composed of people who are experts in archaeology and also in heritage monuments. This is how it was done so that no outside interference, no outside forces can interfere at any point of time.

Regarding the functions of the Authority, it will recommend grading and classification of the protected monuments and will be preparing the inventory. Regarding the competent authority, whoever it may be, maybe, at the State level there may be a competent authority and at the Central level, there may be a competent authority. They will strictly work, not under the bureaucracy, but within the domain and jurisdiction of the National Monuments Authority. At no point of time, these things could be diluted. Then, we will also consider the impact of large scale development projects, including public projects and projects essential to the public which may be proposed in the regulated area. There was no absolutely any kind of restriction for construction in the regulated area.

Now we have injected that also, so that even in the regulated areas, ultimate permission will have to be obtained from the National Monument Authority to make recommendation to the competent authority for grant of permission for construction or reconstruction, for repair or renovation in any regulated area allowed after the permission by a competent authority. These are some of the provisions we have specially made, so that there can be no mistake committed at any point of time, so that the Government as such will have no authority. In fact, the National Monument Authority is autonomous to deal with any situation which is required.

Even the existing penal provisions have been amended and we have provided this thing – obligation upon the Director General to survey the protected, prohibited area and regulated area, and identification by the Director General of unauthorised construction on or after 16th June 1992. The permission which was granted is not from 1992; the permission is granted from 2006 to 2009 where the only matter of concern is that the earlier permission is not validated at all. Validation of certain construction within the prohibited area during the period from the construction was prohibited. Then comes the omission of provisions which we have considered in Section 20C in the ordinance relating to repair or renovation, reconstruction or construction in prohibited or regulated area is committed. That has been omitted so that in the name of reconstruction within the prohibited area, nothing should come up. That has been strictly avoided in the ordinance replacing Bill. Section 20D in the ordinance relating to Expert Advisory Committee is omitted. So far as the Expert Advisory Committee is concerned, it has no place in this particular Bill.

I would like to deal with some of the subjects which have been referred to by our friends. One of the questions was whether the Bill has a provision for already existing unauthorized buildings. Section 35B of the Bill deals with that –

survey of unauthorized structures, action against those prescribed in Rule 38. Punishment has also been provided appropriately.

With regard to Konark, a mention was made by hon. Member Shri Arjun Charan Sethi. Major works done by ASI in the last more than eight years have helped the monument to survive. ASI is very sensitive for its greater preservation and also holding on to the international workshop on 20th and 21st March 2010 to plan for major conservation and preservation of the monument in a phased manner. Under the National Culture Fund Scheme, ASI has tied up with the Indian Oil Corporation for comprehensive development of the complex.

SHRI ARJUN CHARAN SETHI (BHADRAK): What about Lord Jagannath Temple in Puri?

SHRI VEERAPPA MOILY: I am temporarily holding the charge of the Minister of Culture, only for the purpose of this Bill.

SHRI ARJUN CHARAN SETHI: We are all here with the blessings of Lord Jagannath. Please consider doing something for Lord Jagannath.

SHRI VEERAPPA MOILY: Shri Kalyan Banerjee has referred to the Victoria Memorial. In fact, that has not been considered because it has not exceeded 100 years. It is not classified as an ASI heritage site. That is the problem.

In fact, a Committee was constituted by the hon. Prime Minister under my Chairmanship to look into the lacunae of this Ordinance and address the concerns after examining the issues involved and appropriate legislation thereof in the light of the firm resolve of the Government of India to protect the monuments and heritage sites of national importance. The Members of this Committee are – Shri S.K. Mishra, Chairman, Indian National Trust for Art and Cultural Heritage, INTACH and Prof. (Mrs.) Nayanjot Lahiri, Professor of History and Dean of Colleges, Delhi University. I think all the hon. Members would not have got copies of this. We can make it available to you. We have submitted a report. I think we have already supplied copies of that report to a number of hon. Members. That holds out the entire gamut of the concerns, issues and also the way forward to deal with the situation like this.

Members after Members in this House have raised the issue of funding. Of course, it is one thing to say and attribute that ASI and the Archaeological Department should work; but the kind of funding is being done is to be seen. It is already stated by many of the hon. Members that the Budget for the Ministry of Culture, as a percentage of the total Central Budget, given to the monuments is 0.12 per cent and ASI’s share is about one-third of the Ministry’s share. How do I expect things to go on? In fact, the problem of enforcement of the law was emphasised by the Ministry of Culture and they have to guard more than 2,500 of a total number of 3,675 Centrally protected monuments of India. They do not have the staff, they do not have the fund. We have very strongly recommended that appropriate budgeting process will have to be done to protect the national monuments.

There are State monuments which are notified by the State Governments; there are national monuments which are notified by the Government of India. I think even the Planning Commission will have to ensure that while the Annual Plan is finalised, appropriate grant should be given to the State monuments because the State monuments are also as important as the national ones. I think Mr. Narayanasamy who is also in charge of culture on the floor of the House, will definitely look into this matter.

We have also suggested about the environmental impact assessment which is to be done. Mr. Jairam Ramesh will have a role to play here and this will have to be carried out. It does not make it mandatory for large projects to get dedicated land vetted and documented by archaeologists. I think we need to do many things. We have suggested that these things will have to be done.

In fact, the Committee noted that the current framework is silent on protecting historic landscapes. Monuments and structural ruins are integral elements of much larger settings. In fact, in many countries, landscapes with historic associations are now treated on par with monuments and landscapes which were totally neglected. This is the new domain of the conservation of heritage. In fact, the heaths of Dorset (England) and their association with the English novelist Thomas Hardy, when threatened by a nuclear power plant, were described as being as irreplaceable as a Gothic Cathedral. This is the kind of an importance they render to this.

The landscapes that are associated with India including those of our tallest leaders like Mahatma Gandhi should also be preserved in a similar way. However, heritage legislation and archaeological departments in India have not taken note of the need to protect and preserve such landscapes.

With regard to raising finances, we may also consider innovative models.

We may study schemes which are there in other countries, like mechanism of the national lottery. Of course, we need not raise money through a lottery. What I mean to say is that we have to go for an out of box thinking in finding out finances.

The proposed legislation, according to the Committee, is an important first step in creating better heritage laws and also the practices. This should be followed – this is what we have suggested – by the preparation of a comprehensive study of India’s Heritage Report, which can become the basis for the National Action Plan on Heritage to be made by the Government. I think, this is the thing which has to come. All the points raised by the hon. Members in the debate can be contained in the comprehensive National Action Plan on Heritage.

I do not want to take more time of the House. In fact, we have now put ourselves on this great roadmap to consider ways of meaningfully integrating the study of the material and monumental past of India into our education system.

Civil society partnerships should also find a place in that. The environmental aspect should also find a place in that. It is a comprehensive action that we need to think of. It is not confined only to Archaeological Department.

With these words, I commend the Bill to the House for passing.

श्री रमेश बैस (रायपुर): सभापति महोदया, मेरा बिल पर विरोध इसलिए था, क्योंकि मैं मानता हूं कि देश में जितने भी पुरात्व विभाग हैं, उनसे देश की संस्कृति और इतिहास मालूम होता है। जब कभी हम भी विदेश जाते हैं, तो ऐतिहासिक भवन देखने के लिए जाते हैं। मेरा बिल पर विरोध सिर्फ इतना ही था कि लोक सभा सत्र प्रारंभ होने से पहले अध्यादेश लाया गया। अगर अध्यादेश की जगह यह बिल सीधा लोक सभा में आता, तो इस पर कमेटी में चर्चा होती और अच्छी बातें सामने आतीं। मेरा बस इतना ही विरोध है।

SHRIMATI SUPRIYA SULE (BARAMATI): Madam, he has mentioned in the reply that the violators may be extended imprisonment of two years and a fine of one lakh rupees, while the next Bill, which is just coming – National Green Tribunal Bill – says that the violator will get imprisonment for three years and a fine of Rs. 10 crore. There is a huge disparity between the two. That just looks a little more committed and a stricter action. If the State Government has to pay one lakh rupees, it will just pay it, but if they have to pay Rs. 10 crore, they will think twenty times before doing anything.

SHRI M. VEERAPPA MOILY: Madam Chairman, I do appreciate the sentiments expressed by the hon. Member. In fact, our idea was to make it a cognizable offence with three years imprisonment and all that. That was the right step, but the question arose of lack of information. There is no data of monuments, no site plan and no inventory. In the absence of that, there may be lakhs and lakhs of people who may have to be punished. I think, we have already given a deadline by which all these things will have to come up. Once this is available - I think within a couple of months - maybe the punishment she thinks of can be envisaged.
