THE MINISTER OF EDUCATION, SOCIAL WELFARE AND CULTURE (PROF. S. NURUL HASAN):2 Sir, I beg to move:

"That the Bill to provide for the registration of architects and for matters connected therewith, be taken into consideration."

Sir, as the House knows, this question of the registration of architects and regulation of the profession of architects has been under the consideration of the Government of India for a long time. After a careful consideration of all aspects of the matter, the Central Government prepared the draft of a Bill which was discussed in all Ministries of the Government of India, the State Governments, professional bodies, and the All-India Council of Technical Education, and on that basis a Bill was introduced in this House on the 10th December, 1968. Then the House discussed it on the 15th May, 1969 and decided on a motion of the then Education Minister to refer it to a Joint Committee of Rajya Sabha and Lok Sabha. And the other House concurred in this decision and therefore, a Committee of 15 Members of Rajya Sabha and 30 Members of Lok Sabha under the Chairmanship of my late friend, the honourable Shri Henry Samuel, went into the details of this Bill. It received representations and references from a large number of professional organisations, individuals, and finally submitted its report on the 20th November, 1969. The amendments by the Joint Committee to the provisions of the original Bill were passed by Rajya Sabha on the 7th May, 1970. Then the Bill, as amended by Rajya Sabha, came-up for a detailed discussion before the Lok Sabha on the 25th, 26th and 27th November, 1970. The Lok Sabha approved of all the amendments which the Rajya Sabha had accepted on the basis of the report of the Joint Committee, but it also decided to make certain other amendments. Now, these amendments we were hoping would be also accepted by Rajya Sabha. But before this could happen, the fourth Lok Sabha was dissolved and the Bill lapsed. The Government have, therefore, taken this opportunity of bringing before the House this Bill which incorporates all the amendments made by the Joint Committee as also the amendments accepted by Rajya Sabha and the amendments accepted by the previous Lok Sabha. It is now in a final form and I would crave your indulgence, Mr. Vice-Chairman, to appeal to the House to accept it without further discussion in depth since all aspects have been discussed in this long process which I have placed for your consideration.

SHRI JAGDISH PRASAD MATHUR: The Lok Sabha changed it.

PROF. S. NURUL HASAN: I would briefly refer to two or three points which seem to be of particular significance. One is who is an architect. This question is naturally of considerable importance. Under the present Bill which has been presented on the basis of amendments, architect is a title that can be used by all persons irrespective of their qualifications whose names are borne on the register of architects maintained by the Council for Architecture. In this register not only those who possess the necessary architectural qualifications can be registered, but also all those who have been actually engaged in the profession of architecture for a minimum period of five years, even though they may not be possessing the architectural qualifications, can be registered. Apart from that, any engineer or other qualified pro- fessional persons can continue to engage himself in design, supervision and construction of buildings as long as he does not style himself as an architect. This form in which the Bill is now before you, I think, meets with the objections and wishes which have been expressed by the leading professional bodies concerned.

Another change that has been introduced is that in the Council of architecture.

Originally it was visualised that the State Governments will be represented only by persons who are in the service of the government. Now the State government has the discretion to engage any architect from the State, whether he is serving or he is not serving.

The Bill provides for representation to the Institution of Engineers and Institution of Surveyors of India. It also provides for inspection committee to go into the question of education and training of architects and the Central Government have been given the power on the basis of the recommendation of the Inspection Committee and the Council to remove any particular qualification from the Schedule in case the report is adverse to the training.

One other point I would like to mention is with regard to foreign degrees. 'Originally a number of foreign degrees were listed, but this created certain degree of confusion in so far as we did not have a complete list of all the foreign universities and institutions and therefore when the Architectural Council comes into being an expert committee will examine all the qualifications and on the recommendations of the Council, the Central Government may notify them as recognised qualifications for registration. Sir, I hope the House will accept the Bill.

श्रीजगदीशप्रसादमाथुर : उपसभापति महोदय, इस सदन में इस विधेयक पर विचार हुआ था और यह विधेयक लोक सभा के सम्मुख गया, लोक सभा ने इसमें कुछ परिवर्तन किया, लेकिन जब लोक सभा में इसमें परिवर्तन किया जा रहा था तो एक महत्वपूर्ण बात माननीय मंत्री महोदय के भी ध्यान में आई होगी, वह यह थी कि जो शेड्यूल क्वालिफिकेशन का हमने तैयार किया है और जो आपने इसमें लिखा है इसके सम्बन्ध में लोक सभा में चर्चा हुई और यह कहा गया कि इस शेड्यूल को तय करने के पहले कौन-कौन सी क्वालिफिकेशंस के आधार पर हम किसी को आर्किटेक्ट मानें या नहीं मानें इसका निशचय करें तो उस समय जो शिक्षा मंत्री थे, श्री राव साहब, उन्होने सदन के अन्दर एक आश्वासन दिया थआ और उसका जो रिलेवेंट पोर्शन है, जो उन्होने लोक सभा में बोला, मैं माननी मंत्री महोदय की जानकारी के लिए पढ़ कर सुनाता हूँ :

"The qualifications suggested for inclusion must be examined carefully before the decision can be taken. I would, therefore, be prepared to set up an Expert Committee to examine all those qualifications, and upon the recommendations of the Committee, revise the Schedule even before the first Register is compiled. I am personally anxious that no injustice should be done to any individual because he possesses a qualification that is not at present included in the Schedule. I am therefore, proposing an amendment to subsection (2) of Section 14 for the appointment immediately of an Expert Committee to examine all the qualifications, and upon the recommendation of the Committee, revise the Schedule wherever necessary even before such a Register is compiled."

उपसभापति महोदय, आज जो विचारणीय विषय है, जिसके कारण से आज देश के एक बहुत बड़े वर्ग के अन्दर इस विधेयक के कारण से चिन्ता पैदा हुई है वह यह परिभाषा है जो कि आर्किटेक्ट की इस वर्तमान विधेयक में दी है । पहले राज्य सभा ने जो परीभाषा स्वीकार की थी वह दूसरी थी लेकिन लोक सभा में जाने के बाद इस परिभाषा में अन्तर हुआ और अब केवल यह उन्होने लिखा है :

"An architect means a person whose name is for the time being entered in the Register."

अब प्रश्न यह है कि रजिस्टर में जिसका नाम लिखा गया वह आर्किटेक्ट माना गया, किन्तु यह रजिस्टर कम्पाइल करने के पहले भूतपूर्व शिक्षा मंत्री महोदय ने लोक सभा को आश्वासन दिया था कि वह एक एक्सपर्ट कमेटी बनायेंगें और वह एक्सपर्ट कमेटी एग्जामिन करेगी कि कौन-कौन सी क्वालिफिकेशंस शेड्यूल में देने वाले हैं और उनमें क्या एडिशंस, आलटरेशंस और डिडेक्शंस हों, तो मैं माननीय मंत्री महोदय से पूछना चाहूंगा कि इस विधेयक को प्रस्तुत करने से पूर्व क्या उन्होने लोक सभा में दिये गये भूतपूर्व शिक्षा मंत्री के आश्वासन के सम्बन्ध में कोई जानकारी प्राप्त की । चूंकि लोक सभा डिजाल्व हो गई, आज एक साल हो गये और इस विधेयक को वापस ले कर आये हैं, तो क्या यह बात उचित नहीं होती कि इस बीच के काल में जिस एक्सपर्ट कमेटी की बात भूतपूर्व शिक्षा मंत्री ने कही थी उस कमेटी का एप्वाइंटमेंट किया जाता और उसके बाद में शेड्यूल बनाया जाता तो मैं समझता हूं कि जो आश्वासन सदन को दिया गया था, उस आश्वासन की पूर्ति होती । आज इस रूप में इस विधेयक की चर्चा करने के बजाय एक एक्सपर्ट ओपीनियन हमारे सामने होती तो कितना अच्छा होता । माननीय मंत्री महोदय ने क्यों नहीं भूतपूर्व मंत्री जी की राय को मानना उचित समझा, क्यों उन्होने उसको बाई-पास किया, कौन से कारण पैदा हो गये, वह क्यों इसको ले कर आए हैं । और मैंने जो पब्लिक ओपीनियन जानने के बारे कहा है तो इसलिए कि जैसा आज है चाहे नई दिल्ली में देखिए या दिल्ली कारपोरेश्न में जाइए, आज वहां पर आर्किटेक्ट का काम करने वाले विभिन्न रूप में जाने जाते हैं – इंजीनियरिंग का डिप्लोमा लेकर आने वाले हैं, ड्राफ्ट्समैन हैं, सरवेयर हैं और भी कई प्रकार के लोग हैं जो बहुत बड़े पैमाने पर आर्किटेक्ट का काम करते हैं । तो इसमें जो केवल एक संस्था को इतना वजन दिया है माननीय मंत्री महोदय ने – इंडियन इन्सटीट्यूट आफ आर्किटेक्ट्स को – इससे ऐसा लगता है कि उन्ही लोगों के सुझाव पर इस विधेयक में परिवर्तन किया गया है । अभी भी आर्किटेक्ट्स जो क्वालिफाइड हैं, वह इसमें रहना चाहिए, इसमें आपत्ति की बात नहीं है । लेकिन सरकार ने कहा है जो सरकारी नौकर हैं, गवर्नमेंट सर्विस में जो आर्किटेक्ट्स हैं, वे इस विधेयक के आने से प्राइवेट रूप में काम नहीं कर सकते, तो अधिकांश जो लोग आर्किटेक्ट्स हैं, वे सरकारी नौकरियों में ज्यादा हैं, बहुत कम मात्रा में ऐसे हैं जो गवर्नमेंट सर्विस में नहीं हैं । इस नाते से आज हिन्दुस्तान के अन्दर जो मकानों की कमी है, सरकार के आंकड़ों के अनुसार लगभग 60 लाख मकानों की कमी है, ऐसी स्थिति में अगर बड़े पैमाने पर हाउसिंग प्रोग्राम को अपने देश में लाना है तो इन मकानों की प्लानिंग अगर आर्किटेक्ट्स चाहेंगे, उसमें अगर हमने केवल इन्डियन स्कूल आफ आर्किटेक्ट्स को आधार मान कर आर्किटेक्ट्स लिए, उसकी सदस्यता के आधार पर लिया, तो इस समय देश में बड़ी मात्रा में इंजीनियर बेकार हैं, नए नए इन्जीनियर्स भी निकर रहे हैं, अगर उनको इस विधेयक से लाभ नहीं मिला, तो उन्हे स्वाभाविक रूप से शंका होगी और उन्होने शंका प्रगट की है, कि हम लोगों को दूर रखने की नियत से ऐसा किया जा रहा है । अभी मंत्री महोदय ने कहा जो क्वालिफाइड हैं नहीं, वे काम कर रहे हैं । लेकिन जब कौंसिल बनेगी उसमें सरकारी अधिकारियों का बहुमत है या जो इंडियन इन्स्टीट्यूट आफ आर्किटेक्ट हैं, उनका बहुमत है और ऐसी स्थिति eक अंदर इंजीनियर्स, सरवेयर्स, रिटायर्ड इन्जीनियर्स और जो नए पैदा होने वाले इन्जीनियर्स हैं, जिनको अगर सरका नौकरी नहीं दे सकती तो वे अपने आपको बड़े पैमाने पर हाउसिंग स्कीम में लगा सकती है और हाउसिंग स्कीम को आप प्रोत्साहन भी देना चाहते हैं, तो वह स्कीम अगर लागू होती है तो ये लोग भी रजिस्ट्रेशन करवा करके आजादी अपना रोजी रोजगार कमा सकते हैं । लेकिन वर्तमान विधेयक के लागू होने के बाद इंजीनियर्स का यह कहना है कि हमारे ऊपर यह प्रतिबन्ध आएगा कि हम दूसरी श्रेणी के लोग हो जाएंगे और जो आज केवल शुद्ध आर्किटेक्ट हैं, जिनकी संख्या सारे देश के अंदर चार-पाँच हजार से ज्यादा नहीं होगी और उनमें भी ज्यादातर गवर्नमेंट सर्विसेज में हैं, तो इन्डिपेन्डेन्ट काम करने के लिए सरकार को हजार या पाँच सौ से ज्यादा लोग नहीं मिलेंगे और ऐसी स्थिति में जबकि हम आज देखते हैं बड़े मकानों की प्लानिंग वगैरह में सरवेयर्स भी, ड्राफ्ट्समैन भी, इंजीनियर्स भी, वे सब काम करते हैं, इनका एक बहुत बड़ा तबका है, उनमें ऐसा संदेह है कि कहीं इस विधेयक के कारण से वह काम-काज से, अपने रोजगार से वंचित न हो जाएं । अगर ऐसा हुआ तो एक बहुत बड़ा प्राबलम सरकार के सामने आने वाला है, क्योंकि थोड़े से लोग जो रजिस्टर्ड आर्किटेक्ट हैं, जो सरकारी नौकरियों में नहीं हैं, जो प्राइवेट रूप में धंधा करते हैं, वे कम संख्या में होने के कारण बड़े रूप में सिचुएशन को एक्सप्लाइट करेंगे और थोड़ा होने के बावजूद सारी संस्था की बागडोर उनके हाथ में आ जाएगी । तो एक मुख्य बात मैंने कही कि भूतपूर्व शिक्षा मंत्री ने जिस एक्सपर्ट कमेटी की राय दी, उन्होने सदन में माना था कि हम शेड्यूल तय करने से पहले एक्सपर्ट कमेटी एपोइन्ट करेंगे, उसकी जांच करवाएंगे, दूसरे एक ही संस्था को इतना वजन क्यों दे रहे हैं, तीसरे, बाकी जो इंजीनियर्स हैं, उनकी स्थिति और जो कमेटी आप बनाने जा रहे हैं, उसमें सरकार का कितना ज्यादा भारी बहुमत हो जाएगा और उसके कारण इन्डिपेन्डेन्टली वे लोग काम नहीं कर सकेगे, इन्ही कारणों से हम चाहते हैं कि इस बिल पर पब्लिक ओपीनियन जानने के लिए भेजा जाए । जो आर्किटेक्ट के धंधे में काम करने वाले इन्जीनियर्स हैं, ओवरसियर्स हैं, डराफ्टमैन हैं, उनको उसकी परिभाषा में रखना चाहिए । जो परिभाषा सिलेक्ट कमेटी ने स्वीकार की थी उसको बदल दिया गया है, जो परिभाषा राज्य सभा ने स्वीकार की थी उसको बदल दिया गया और लोक सभा में जाने बाद जो परिभाषा स्वीकार की गई थी और उसके माननीय मंत्री जी ने जो आश्वासन दिया था उसको टाल कर यह विधेयक लाया गया है । इसलिए मेरा सुझाव है कि इस विधेयक को जनमत जाग्रत करने के लिए, प्रसारण करने के लिए, एक्सपर्ट लोगों की राय जानने के लिए प्रवर समिति में भेजा जाय ताकि वहां पर जो सही राय बनेगी, वह सब लोगों की राय को मालूम करके बनेगी तथा सही ढंग की राय बनेगी । इसलिए मेरा जो सुझाव है, आशा है, माननीय मंत्री जी उसको स्वीकार करेंगे ।

श्रीनागेश्वरप्रसादशाही : उपसभाध्यक्ष महोदय, मंत्री जी ने विधेयक प्रस्तुत करते समय यह कहा कि चूंकि यह विधेयक राज्य सभा पहले ही पास कर चुकी है, लोक सभा के सम्मुख गया था, इसलिए इस पर गम्भीरतापूर्वक विचार नहीं होना चाहिये तथा हल्के ढंग से इसको पास कर दिया जाना चाहिये । मैं मंत्री जी को, जैसा माननीय माथुर जी ने कहा, उन्हे याद दिलाऊंगा कि उन के सहयोगी जो उनके पहले इस विभाग के मंत्री रह चुके थे, उन्होने 3-12-70 को लोक सभा में यह कहा था :

"That the Experts Committee which will be appointed immediately in the next few days will go into all these various new qualifications which have been suggested."

नेक्सट फ्यू डेज में एक एक्सपर्ट कमेटी बना देंगे और वह उन आर्किटेक्टों को जिनके पंजीकरण करने की बात है, उनकी योग्यता पर विस्तार से विचार करके राय देगी । आज तक वह कमेटी नियुक्त नहीं हुई, बनी नहीं और न उसकी राय ही आई । पता नहीं क्यों सरकार भूतपूर्व मंत्री महोदय के वचनों की अवहेलना कर रही है और बिना कमेटी बनाये ही, बिना उसके राय लिये ही पुन: इस विधेयक को उसी रूप में इस सदन के सम्मुख पास करने के लिए लाई है ।

मैं उन कारणों को बतलाऊंगा जिन कारणों की वजह से इस विधेयक को संयुक्त समिति में जाना आवश्यक ह । एक तो श्रीमन्, इस तरह का विधेयक आना नहीं चाहिये था । इस देश में अभी जिस तरह से मकानों की कमी है, मकान बनाने की समस्या है, उसको देखते हुए आपको इस तरह के विधेयक को नहीं लाना चाहिये था । हमारे देश में गरीबों की संख्या काफी है और मकान के निर्माण में किस तरह की कठिनाइयाँ होती हैं, वह सब लोग अच्छी तरह से जानते हैं अधिकांश लोग आर्किटेक्ट का सहारा नहीं ले सकते हैं । आज जो साधारण आर्किटेक्ट है उसकी एक साधारण मकान बनाने की फीस करीब 500 रु0 से लेकर 1000 रु0 तक है । इस विधेयक के द्वारा आप उस संख्या को सीमित करने जा रहे हैं जो आज यह कार्य कर रहे हैं । आज इस कार्य को इंजीनियर्स, ड्राफ्ट्समैन, सभी लोग कर रहे हैं, कोई बंदिश नहीं है। इस विधेयक के द्वारा अधिक से अधिक संख्या जो पंजीकृत होगी और जिन्हे अधिकार होगा यह कार्य करने वह संख्या लगभग 4 हजार की होगी । इस 4 हजार की संख्या में लगभग साढ़े 3 हजार लोग सरकारी, अर्द्ध-सरकारी और इस तरह की संस्थाओं के काम कर रहे हैं । इस समय उन्हे छूट नहीं है कि दूसरों का काम करें । बचे हुए लोग जिनकी संख्या केवल 400-500 होगी वे मनमाने तौर पर फीस चार्ज करेंगे और उनकी संख्या इस बात के सक्षम नहीं होगी, काफी नहीं होगी कि वे सबका काम कर सकें ।

श्रीमन्, मैं आपका ध्यान खींचना चाहूंगा ‘वास्तुविद’ की परिभाषा कि ओर । वास्तुविद से इस प्रकार का व्यक्ति अभिप्रेत है, जिसका नाम तत्समय रजिस्टर में प्रविष्ट हो । प्रविष्ट करने का काम, नियमों को बनाने का काम एक परिषद् को सौंपा है, जो धारा 3 के अन्दर गठित की गई है । इस परिषद् के गठन की व्यवस्था ऐसे की गई है कि उसमें सरकारी लोग ही ज्यादा होंगे या अर्द्ध-सरकारी लोग, जिनकी मनोभावना ऐसी होगी कि सीमित संख्या में लोग पंजीकृत हो सके और कुल लोगों के लिए ही यह पेशा सीमित रह जाय । श्रीमन्, देश के नए इंजीनियरों के मन में इस विधेयक से जो भावना पैदा हो रही है, उसकी ओर भी मैं सदन का ध्यान दिलाना चाहूंगा । इंजीनियर यह समझते हैं कि इस विधेयक के आने पर और पास हो जाने पर उनका दर्जा दूसरा हो जायेगा और आर्किटेक्ट्स का दर्जा एक नम्बर पर हो जाएगा, वे सेकिन्ड केटेगरी के लोग समझे जाएंगे । आज जो लोग उनकी मातहती में काम कर रहे हैं, जिनकी योग्यता और जिनका अधययन इंजीनियर्स के मुकाबले कम है, वे पहली केटेगरी में माने जाएंगे और इंजीनियर्स दूसरी केटेगरी माने जाएंगे । ऐसा, श्रीमन्, इस विधेयक से आभास भी निकलता है कि किन्हीं लोगों को सुरक्षा प्रदान करने के लिए और किन्हीं लोगों के हितों की रक्षा करने के लिए इस विधेयक को लाया गया है । कहा जाता है और कहा भी गया है इसकी भूमिका में कि यह विधेयक जनता के हितों की रक्षा करने के लिए और आर्किटेक्ट्स के हितों की रक्षा के लिए प्रस्तुत किया जा रहा है, लेकिन सचमुच यह थोड़े से लोगों के हितों की रक्षा के लिए प्रस्तुत किया गया है । जैसा कि इसमें परिषद् की गठन की व्यवस्था से प्रकट होता है । बंबई में जो संस्था है, जिस में कुछ बहुत ही प्रभावशाली लोग हैं उसके लिए यह सब किया गया है । जिनकी यह संस्था है मैं उनका नाम नहीं लेना चाहूंगा …

श्रीनागेश्वरप्रसादशाही : मैं वह आपके लिए छोड़ रहा हूं; क्योंकि आप समर्थ हैं । तो उनके इशारे पर, उस संस्था के हितों की रक्षा करने के लिए इस विधेयक को प्रस्तुत किया गया है । मैं श्रीमन्, कहना चाहूंगा कि जो इसमें योग्यता रखी गयी है उसमें आखिरी योग्यता जो है, विदेश से जो प्राप्त की जाती है, जिस संस्था से वह प्राप्त की जाती है, वह संस्था आज एक्जिस्ट भी नहीं करते हैं और केवल पत्रों के द्वारा उस संस्था के नाम पर कुछ लोग सर्टिफिकेट भेज दिया करते हैं । क्योंकि एक व्यक्ति विशेष जो कि शायद सेंटरल पी0 डब्लू 0 डी0 में आर्किटेक्ट है, उनकी डिग्री उस संस्था की है, इसलिए उन्हे इसमें रखने के लिए और उनको इसमें शामिल करने के लिए उस डिग्री को भी क्वालिफिकेशन्स में शामिल कर लिया गया है ।

प्रो0 एस0 नूरुलहसन : किस क्वालिफिकेशन का जिक्र कर रहे हैं आप ?

श्रीजगदीशप्रसादमाथुर: इन्दिरा जी का फार्म जिसने डिजाइन किया था, उस को हटा दिया है ।

श्रीनागेश्वरप्रसादशाही : आप कहिए, मैं नहीं कहता । तो मैं यह निवेदन करूंगा श्रीमन्, कि जिस रूप में विधेयक आज आया है, उस रूप में इसको संयुक्त समिति में जाना आवश्यक है और मैं मंत्री जी से निवेदन करूंगा कि वह इस बात में हम से सहमत हों।

DR. R. K. CHAKRABARTI (West Bengal): I welcome this Architects Bill providing for the registration of architects but at the same time I would like to draw the attention of the hon. Minister to the fact that the engineers are trying to get their registration numbers through the Institution of Engineers (India) for a long time. I feel that this is really a discrimination to just have a Bill for the architects only because I feel the engineers should also have a registration number just like the registration number for medical practitioners. Otherwise, I should like to point out certain facts here, if there is a collapse of a bridge or a building, sometimes it is due to materials or mixing but many a time it is found that it is due to the lower qualifications or the sub-standard staff of the supervisory personnel because in the architect firms, construction firms or engineering firms there is no distinction practically between the qualified degree- holder engineer and a licentiate or just an apprentice. I would therefore like to request the hon. Minister to come up with a comprehensive Bill as soon as possible to cover the registration of engineers also so that a firm is liable to employ only such registered persons in any qualified technical position. Unless an engineer has got a registered number he should not be given a chance to work in any supervisory capacity which entails full responsibility for the execution of certain type of jobs.

There is another point mentioned by my colleague over here and that is about the fees. I also feel that the fees charged by the architects are enormous. As the Government has progressed in the direction of having a ceiling on land holdings and also a ceiling on urban property I feel in the same way there should be a limit on the fees demanded by a firm of architects. It should be a certain percentage of the total valuation of work and that percentage should not exceed a certain limit to be fixed by Government.

PROF. S. NURUL HASAN: Sir, the most important point which has been raised by two hon. Members relates to the assurance which the former Education Minister, Prof. V. K. R. V. Rao, gave in the House. In this connection I would like to bring to your notice, Sir, Clause 14 (2) wherein we have tried to incorporate that assurance. Clause 14 says that the qualifications which are included in the Schedule, or notified, shall be recognised as qualifications for this purpose, and the proviso i n bold letters says:

"Provided that until the first Council is constituted, the Central Government shall, before issuing any notification as aforesaid, consult an [text illegible in the original]of three members to be appointed by the Central Government by notification in the Official Gazette."

Sir, as soon as this Bill is passed, the expert committee will be appointed and it will go into this matter, I do not think any of the hon. Members, who were kind enough to speak on the Bill, had suggested that there are too many or any wrong qualifications which have been entered in the Schedule. And so far as additional qualifications are concerned, we will certainly appoint an expert committee, which will go into this whole matter.

As regards the question of taking away the livelihood of the young engineers, I am afraid, Sir, this is a fear which is not founded on the reality of the situation. There is no law which prohibits a private person from having his house designed by a non-architect except in certain municipal areas where the municipal bye-laws provide that before a plan can be approved it must be countersigned by an architect.

SHRI JAGDISH PRASAD MATHUR: You may like to have a master plan for every city, for every city to be well planned, then this problem will arise.

PROF. S. NURUL HASAN: Maybe after some time it may arise, but in that case, as and when diversification of technical education is undertaken, the All India Council of Technical Education, which incidentally has a majority of engineers on it will be continuously seized of this problem, and would be ensuring, depending on the capacity of society to utilise the services of different types and categories of technical personnel, that the courses are varied. I do not think, Sir, this fear is likely to be of any serious nature.

I do not think again it would be right to say that architects would be deemed to be first category persons, and engineers would be deemed to be a second category. Engineers have their own value and importance, and no one, I am sure, is going to underrate the status or the expertise of engineers.

Sir, with regard to the suggestion which has been made by the hon. Member, Dr. Chakrabarti, that there should be another Bill for the registration of engineers, it is an interesting idea, Sir, and I will certainly look into this matter.

यह एक बिल्कुल डिफरेन्ट बात है कि किसी आदमी का नाम रजिस्टर में इन्टर्ड है । राज्य सभा ने पिछली बार स्वीकृत किया था जो कि जो आदमी डिजाइनिंग करने में, सुपरवाइज करने में, बिल्डिंग के इरेक्शन में लगा हुआ है वह आदमी आर्किटेक्ट है । अब आप केवल एक रजिस्टर का नाम देकर सदन से पास करवाना चाहते हैं – एनीबाडी हूज नेम इज इन्टर्ड इन द रजिस्टर । अब वह रजिस्टर की भी कहीं आपने परिभाषा की हो क्योंकि आज तो रजिस्टर तैयार नहीं – कौंसिल बनेगी, कौंसिल बनने के बाद रजिस्टर बनेगा । वह कौंसिल हो या आपका इंडियन इन्स्टीट्यूट आफ आर्किटेक्ट हो, जो एक बाडी है, उसके जो मेम्बर हों, यह एक ऐसी चीज है कि – it may create confusion. आपने कह दिया, आपकी मन्शा दूसरी हो सकती है, लेकिन आज इसको स्पष्ट रूप से यह समझा जाएगा कि हमने जिस परिभाषा को स्वीकृत किया था उसको आपने बदल दिया, सिम्पली एक लाइन लिख दिया – नेम इन्टर्ड इन द रजिस्टर – उससे कन्फ्यूजन क्रिएट किया हुआ है इन्जीनियर्स के अंदर और बाकी लोगों के अंदर जो इस धंधे के अंदर लगे हुए हैं इन्डियन इन्स्टीट्यूट आफ आर्किटेक्टस से मिल कर गवर्नमेंट ने जो इस प्रकार से परिभाषा बदली है उससे बाकी लोगों के ऊपर बुरा असर पड़ेगा । इस बारे में मैं मंत्री महोदय से स्पष्टीकरण चाहूंगा ।

श्रीमानसिंहवर्मा(उत्तर प्रदेश) : रजिस्ट्रेशन के लिए क्या क्वालिफिकेशन्स हैं, यही बता दीजिए ।

प्रो0 एस0 नूरुलहसन : जनाबेवाला, इस वक्त जो सूरत है वह मैं अर्ज कर दूं तो गलतफहमी दूर हो जाएगी । पहली बात तो यह है कि कुछ क्वालिफिकेशन्स शेड्यूल में दी हुई हैं । जिन लोगों के पास ये क्वालिफिकेशन्स हैं उनका नाम दरियफ्त कर लिया जाएगा । हर शख्स जो 5 बरस या इस से ज्यादा प्रोफेशन में रह चुका है उसकी कोई क्वालिफिकेशन हो, चाहे वह इन्जीजियर हो, ओवरसियर हो, आर्किटेक्ट हो, कोई हो – उसे सिर्फ यह साबित करना होगा टराइब्यूनल के सामने कि वह वाकई 5 बरस प्रोफेशन में रह चुका है – उसका नाम पहले रजिस्टर में दर्ज कर लिया जाएगा । दूसरी बात यह है, जो मैंने पढ़ कर सुनाया, कि एक एक्सपर्ट कमेटी बनायी जाएगी जो इन क्वालिफिकेशन्स के अलावा गौर करके सेन्टरल कौंसिल को राय देगी कि क्या-क्या क्वालिफिकेशन्स इसमें दर्ज कर ली जाएंगी । मेरे ख्याल में माननीय सदस्य का जो पोइन्ट था वह इससे पूरा हो जाएगा और अब मैं उनसे दरखास्त करता हूँ कि वे अपना अमेंडमेंट वापस ले लें ।

आदमी जाते हैं, लेकिन अगर हम एक्चुअली देखें तो इस व्यवसाय में जो लोग लगे हुए हैं, जो आज एक्चुअली यह धन्धा करते हैं उनमें उन लोगों की संख्या ज्यादा है या बाकी लोगों की है जिनके द्वारा हम कौंसिल बना रहे हैं । इसलिए जैसा मैंने कहा कि उनको डर है कि हमारे साथ डिसक्रिमिनेशन होगा । इसके अन्दर तो आपने एक-एक तो प्रत्येक राज्य का आर्किटेक्ट लिया है ।

"(h) one person nominated by the Institution of Surveyors of India from among its members";

प्रत्येक राज्य सरकार एक आर्किटेक्ट को इसमें भेजेगी और वह सरकारी आदमी होगा । मिनिस्टरी का जो आदमी इसमें होगा वह सरकारी आदमी होगा ।

(a) five architects possessing recognised qualifications elected by the Indian Institute of Architects from among its members;"

इसमें इस तरह से 10 आदमी ऐसे होंगे जो गैर सरकारी होंगे और बाकी इसके अन्दर सरकारी प्रतिनिधि होंगे और उनका ही इसमें बहुमत होगा । इंडिपेन्डेंटली य संस्था वर्क कर सकेगी, इसमें मुझे संदेह है । इंजीनियरों का इसमें जो प्रतिनिधित्व होना चाहिये वह नहीं है । ऐसी परिस्थिति में मेरा यह सुझाव है कि इसमें जो लोग भेजे जा रहे हैं उनकी संख्या कम करें । इंजीनियर्स, सुपरवाइजर्स और डराफ्टमैन जो आज सारे इस व्यवसाय में लगे हुए है उनको ज्यादा प्रतिनिधित्व मिलना चाहिए, लेकिन दु:ख के साथ कहना पड़ रहा है कि इन लोगों कि उपेक्षा की जा रही है । आपने इसमें सरकारी प्रतिनिधि ही ज्यादा रखे हैं । आप कहेंगे कि इसमें स्टेटस के प्रतिनिधि आ रहे हैं । तो इस सम्बन्ध में यह निवेदन करना चाहता हूँ कि वे किसी प्राइवेट आदमी को इसमें नहीं भेजेगे । हां, इस शर्त में वे किसी प्राइवेट आर्किटेक्ट को भेज सकते हैं अगर वह उनकी पार्टी का हो और वह चुनाव में हार गया हो। इस तरह का जो आर्किटेक्ट होगा उसको जरूर भेज दिया जायेगा नहीं तो भेजने का सवाल ही पैदा नहीं होता है । इसलिये मेरा कहना है कि जो टेक्निकल आदमी हैं उनकी समस्या को विचार करके इस बारे में तय करना चाहिये । एक तो इसमें इंजीनियर का रिप्रेजेन्टेशन ज्यादा हो और इस नाते मुझे यह कहना है कि जो लोग इस व्यवसाय में लगे हुए हैं, पुराने इंजीनियर्स हैं, ड्राफ्ट्समैन हैं, इस तरह के सारे लोग हैं, उन लोगों का प्रतिनिधित्व इसमें ज्यादा होना चाहिये तथा इन लोगों को ड्यू रिप्रेजेन्टेशन मिलना चाहिये । इसमें सरकारी प्रतिनिधियों की संख्या कम हो, इस नाते मेरा संशोधन है ।

PROF. S. NURUL HASAN: Sir, I deeply regret that I am unable to accept the amendment of my hon. friend. The Joint Committee went into the question of representation of the Institution of Engineers and suggested that the number of such representatives should be two, which is what appears in the Bill itself. Secondly, Sir, the hon. Member quite rightly pointed out that it is a technical body, and when we are thinking in terms of technical persons and experts, it becomes irrelevant whether they have been nominated by the Government or not, or whether they are servants of the Government or not. With the public sector activities increasing, more and more experts and scientists and technicians and engineers are now becoming either Government servants or quasi-Government servants, but that does not mean that they lose their stature as experts. Therefore, Sir, I am unable to accept this amendment.

क्योंकि यह आर्किटेक्ट्स के सम्बन्ध में बिल है, इस नाते से आप इसको इसी रूप में लिखना चाहेंगे और जहाँ तक आपने लिखा है उसमें आपकी नीयत में शंका नहीं है, लेकिन एक समस्या पैदा हो जाती है, दिल्ली म्यूनिसपल कौंसिल में जाइये, वहां उनको आर्किटेक्ट के नाते एपाइन्ट नहीं करते, वहाँ उन्हे ड्राफ्ट्समैन रखे हुए हैं ।

They are qualified to be architects but they are known as draftsmen, they are known as surveyors. But because they are known as draftsmen and surveyors, they are not known as architects and so they are not qualified, according to you. They are capable; they are holding the post; and they are working in certain institutions. They are doing all these things.उनको सर्वेयर, ड्राफ्ट्समैन के नाते से जानना चाहता हूँ और इस नाते से वे बी पोर्शन में कवर नहीं होते in spite of the fact that they are working as architects in the Delhi Municipal Corporation.

उस दृष्टि से यह समस्या पैदा हुई और इस नाते से मैंने कहा कि इस ‘बी’ के बजाय जो ‘बी’ मैं प्रोपोज की वह रखी जाय –

"(b) does not hold such qualifications as mentioned in the Schedule but, being a citizen of India has been engaged in architectural profession and/or holding licence of draftsman, architect, surveyor and/or Engineer in any Local Body or Government for a period of not less than five years prior to the date appointed under subsection (2) of section 24 . . .''

तो इसमें आपकी जो मंशा है वह तो इसमें आ जाता है लेकिन मेरी अपनी शंकाएं हैं और जिन लोगों के संबंध में शंकाएं हैं और जो लोग इसके पास हो जाने के बाद, जिनको यह धन्धा करने की अनुमति नहीं मिलेगी, जिनको रजिस्टरेशन नहीं मिलेगा, जिनके बारे में दस बातें होंगी उनको भी मेरे द्वारा प्रस्तुत अमेंडमेंट से प्रोटेक्शन मिलता है । इसलिये मेरी प्रार्थना है कि माननीय मंत्री महोदय मेरे अमेंडमेंट को स्वीकार करें ।

PROF. S. NURUL HASAN: Sir, I share the sentiments of the honourable Member. But all I would like to submit for your consideration is that in this Bill due care has been taken, firstly, that registration is not the duty of the Council but of a registration tribunal which the Government would appoint, and, secondly, there is provision for an appeal to an authority from the decisions of the tribunal. Therefore, due care has been taken to ensure that anyone who has been actually engaged in the profession of architecture for a period of not less than five years will find himself registered and I am not visualising that any category would be excluded. Therefore, I am unable to accept the amendment.

श्री डी 0 केपटेल(गुजरात) : श्रीमन्, इस विधेयक के पृष्ठ 21 में उद्देश्य और कारणों के कथनानुसार वास्तुविद् व्यवसाय को बदनामी से बचाने के लिये, ऐसे व्यक्ति जो स्वयं को वास्तुविद कहकर जनता को धोखा दे रहे हैं, इसलिये जनता अथवा वास्तुविद व्यवसाय को बचाने के लिये इस विधेयक द्वारा योग्य व्यक्तियों को वैध नियमों के अनुसार वास्तुविद् रजिस्टरेशन दिया जायेगा ताकि वास्तुविद् आवास, गृह, कारखानों अथवा इमारतें बनाने में अपना योग दे सकें । परन्तु दुख की बात है कि यह विधेयक न तो वास्तुकला और न ही जनता का शोषण होने से उसको बचाता है । हाँ, कुछ गिने चुने इंडियन इंस्टीट्यूट आफ आर्किटेक्ट्स के सदस्यों की सहायता अवश्य करता है । पृष्ठ 23 पर ‘वित्तीय ज्ञापन’ के अनुसार केवल 5000 के लगभग व्यक्ति वास्तुविद् के तौर पर रजिस्टर हो सकेगें जिनमें से अधिक संख्या सरकारी कर्मचारियों की है केवल । 200 से 300 तक ऐसे होंगे जो इस व्यवसाय के द्वारा रोटी रोजी कमा सकते होंगे और जनता का काम कर सकते होंगे । यदि सरकारी कर्मचारी जो 47000 होंगे उन्हे भी रजिस्टर किया गया जो कि सरकारी नियमों के अनुसार प्राइवेट व्यवसाय नहीं कर सकते तो उन्हे भी डाक्टरों की भांति प्रति व्यक्ति को 150 रुपये नान-प्रेक्टिसिंग एलाउंस हर माह देना होगा जिससे 70 हजार रुपये की हानि उसके बजाय 7 लाख 70 हजार रुपये हो जाएगी । आज हमारे देश में 8 करोड़ मकानों की कमी है । भवन निर्माण, फैक्टरियों तथा पंचवर्षीय योजना के लिए तो लगभग एक लाख से अधिक वास्तु-विद्याकला जानने वाले चाहिये । आज के आधुनिक ढग के वास्तु-विद् तो केवल पाश्चात्य देशों की नकल करके केवल सुन्दर व पश्चिमी ढंग के मंहगे भवन के निर्माण करने में व्यस्त हैं । हमारे देश की कुल जनसंख्या का 80 प्रतिशत तो गाँवों में बसता है और ये कथि पश्चिमी ढंग के वास्तुविद् गाँव में जाकर थोड़ी फीस लेकर उनके सस्ते भवनों का कैसे निर्माण कर सकेगे ? इसकी पूर्ति तो केवल इंजीनियर्स और ड्राफ्ट्समैन कर सकते हैं जो कि सस्ते और मजबूत ढंग के मकान-निर्माण की कला में निपुण हैं, जिनकी संख्या 50 हजार के करीब है ।भारतवर्ष में पाकिस्तान के आक्रमण करने पर यही इंजीनियर्स ही तो मैदान में आये थे जिन्होने बंगला देश नदियों पर घंटों में पुल बना दिया और पश्चिमी पाकिस्तान में घंटों में रेल की लाइनें बिछाकर पाकिस्तान पर विजय प्राप्त करने में सहायक हो सके । आल इंडिया एसोसिएशन आफ कंसलटैंट इंजीनियर्स एंड आर्किटेक्ट्स, नई दिल्ली, के सदस्यों ने भारत की सरकार को युद्ध के दिनों में बिना तनख्वाह लिये अपनी सेवायें देने का वचन दिया था । ऐसी-ऐसी संस्थाओं के अतिरिक्त इंस्टीट्यूट आफ चार्टर्ड इंजीनियर्स और इंस्टीट्यूट आफ आर्किटैक्ट्स जिनकी सदस्य संख्या 85 हजार है, जिनके सदस्य वास्तुकला की सेवा कई वर्ष से कर रहे हैं और अपनी रोजी कमा रहे हैं उन्हे भी इस विधेयद में पृष्ठ 19 व 20 में दी गई अहर्ताओं में शामिल नहीं किया गया है जब कि डा0 वी0 के0 आर0 वी0 राव जो भूतपूर्व शिक्षा मंत्री थे उन्होने संसद् में, लोक सभा में, 3 दिसम्बर, 1970 को वास्तुविद् विधेयक, 1970 ऊपर संसद् सदस्यों के आपत्ति उठाने पर कि शेड्यूल में कई एक वास्तुकला जानने वालों, उनकी संस्थाओं, कालेजों व पाठशालाओं को शामिल नहीं किया गया है, तो सबको विश्वास दिलाया था कि एक एक्सपर्ट कमेटी द्वारा जाँच करके शीघ्र ही सबको शेड्यूल में स्थान दिया जायगा और मंत्री महोदय ने पहले रजिस्टर करने के लिये गैर-सरकारी अनुभवी इंजीनियरों और डराफ्टस्मैंनो में से तीन व्यक्तियों का टराइब्यूनल बनाने का भी और विधेयक में संशोधन करने का वचन दिया था । इसी भांति ज्वाइंट कमेटी ने भी अपनी रिपोर्ट में, दिनांक 28 नवम्बर, 1969 में, सिफारिश की थी कि वास्तुकला जानने वाले सदस्यों को शामिल किया जाय, परन्तु न मालूम किस कारणवश मंत्री महोदय किसी का भी ध्यान न रखते हुए यह बिल ले आये हैं । भूतपूर्व शक्षा मंत्री के दिये गये वचनों की भी परवाह न करके इस विधेयक को – जो कि 7 जुलाई, 1970 को राज्य सभा ने पहले पास किया था – शीघ्रातिशीघ्र पास कराने की फिराक में हैं । इसमें कुछ गोलमाल दिखाई पड़ता है । इसकी जाँच करवा कर जिम्मेदार व्यक्तियों को दंड दिया जाय ।

आज भारतवर्ष में 90 प्रतिशत से भी अधिक भवनों का निर्माण इंजीनिययों, ड्राफ्ट्समैनों द्वारा हो रहा है । अगर इनको वास्तुविदों के रूप में न रजिस्टर किया गया तो इनकी अपनी रक्षा हेतु न्यायालय में जाना पड़ेगा । हमारी सरकार का गरीबी हटाओ, अन्याय हटाओ का नारा एक दिल को लुभाने वाला और वोट लेने वाला नारा तो लगता है परन्तु ये सब बेकार से मालूम होते हैं । यह बिल यदि बिना संशोधन के, जनता की राय लिये बिना, पास कर दिया गया तो लगभग 50, 000 लोग बेकार हो जाएंगे, इसलिये इस बिल को जनता की राय लेने के लिये, प्रजामत के लिये, और पुनर्विचार के लिये भेजा जाये ।

PROF. S. NURUL HASAN: Sir, I have already dealt with the points raised by the hon. Member. There is the provision for an Expert Committee in the Bill and there is the provision for a Tribunal for registering, a Tribunal of three persons, and I entirely agree with what the hon. Member has said that the overwhelming majority of our people live in villages and quite obviously, for constructing any building in villages this restriction on the definition of architects, is not going to be applicable. Therefore, I request that the House may pass the Bill.
