Vide this Commission’s decision dated 18.11.2009, notice was issued to Smt Nimo Dhar, Director (PR) and Shri Manoj Kumar Agarwal, Commissioner (Land Disposal) to show-cause why penal action should not be taken against them for not responding to the RTI application dated 28.4.2008 of appellant Smt Geeta Dewan Verma.
As scheduled, the matter is called for hearing today dated 22.12.2009. Appellant present. Smt Neemo Dhar is present along with Lt Col N.S. Verma. Smt Dhar has submitted a written representation dated 17.12.2009 which is taken on record. It is her submission that the issues raised in the RTI application in hand do not involve PR Department and that they involve several other departments viz. Department of Land Costing as also Department of Land Disposal etc. She would also submit that the Department of Land Costing comes under the administrative control of the Finance Member and the Department of Land Disposal is headed by Shri Manoj Kumar Agarwal, Commissioner (LD). She suggests that the matter may be entrusted to such senior officer of DDA as has overarching authority on these Departments.
DECISION
As the matter in hand involves multiple Departments and as Shri V.M. Bansal, Principal Commissioner-cum-Secretary, DDA, has authority over all Departments of DDA apart from being the head of the RTI cell, we think it expedient to direct him to coordinate with the concerned Departments of DDA and have the requisite information provided to the appellant in 04 weeks time.
Let the following documents be enclosed with this decision :-
Copy of RTI application dated 28.4.2008;
Copy of the first appeal dated 26.5.2008 filed by the appellant;
(iii) Copy of he Interim Decision dated 18.11.2009 of this Commission;
&
(iv) Copy of the representation dated 17.12.2009 filed by Smt Neemo Dhar.
A decision regarding the show-cause notices issued to officers referred to above will be taken after the implementation of this
decision of the Commission by Principal Commissioner-cum- Secretary, DDA.
