O R D E R

By our decision of 27.8.2007 we had directed as follows:

“On the basis of this complaint, the Commission hereby directs the PIOs, DTDC, Delhi and office of DC (South), MCD to each provide the information sought to applicant Ms Gita Dewan Verma within 10 working days from the date of receipt of this decision.

The PIOs, DDA (UC), DTDC and o/o DC (South), MCD are further directed to appear personally before the Commission on 14.09.2007 at 9:30 a.m. to show cause as to why a penalty of Rs.250/- per day from the date when the information became due to the date when it was transferred i.e. 2.2.’07 to 9.02.’07 amounting in the case of Sri PS Uttarwar, PIO DDA to Rs 1750/-, from 20.4.’07 DC (South), and from the date when the information became due from DTDC, i.e. 9.3.’07 to the date when the information is actually supplied, not exceeding Rs.25, 000/- should not be imposed on each of the latter two, under Section 20(1) of the RTI Act. The PIOs may in the alternative submit their written submissions to this Commission on or before 10.09.2007.”

Accordingly we have received a response from Sh. Suman Sharma, SPIO dated 10.9.2007 in the case under File No. CIC/WB/C/2007/00138 in which

reference has been made to letters exchanged with DDA on the subject. The matter was heard on 14.9.2007. The following are present:

Ms. Gita Dewan Verma appellant has explained that on the subject concerning DDA & DTTDC, a separate complaint is pending hearing, registered with us on 23.2.2007, which also concerns DTTDC and DDA. She requested that these two complaints might be clubbed together since both concern the Garden of Five Senses. In the matter concerning MCD, she stated that she has already obtained information pertaining to that Department consequent upon our orders in the 2nd Adjunct to Appeal No. CIC/WB/A/2006/00349 of 21.5.2007 Ms. Gita Dewan Verma Vs. DDA, MCD and DC (Revenue). In that case we had directed as follows:

Shri S.K. Jha, DC (South) has indicated that the information pertaining to him has been provided on 3-5-07. However, there appears to be an error in the response to the show cause notice received by us from Shri Ravi Das, Engineering-Chief in his letter dated 30-4-2007 since the action taken with regard to our decision of 12-4-2007 described in that letter does not pertain to file No.349 of 20-6-06, upon which that order was issued. In that case Ms. Gita Dewan Verma appellant has pointed out that in fact the application had been transferred to DC (Najafgarh Zone) and not DC (South). It is also a fact that in our initial decision in this case on 12-4-2007, the reference had been to a note dated 21.12.’06 of the DC (Najafgarh Zone) stating that information was awaited from C.E. (Bldg.) Hq.”

Ms. Verma indicated that the information stated to have been supplied has been in fact received from Shri SK Jha.

In light of the above, whereas the complaint with regard to MCD stands disposed of, the complaint with regard to DTTDC Delhi and DDA is adjourned to be heard together with a hearing in complaint No. CIC/WB/C/2007/00071, which will be held on 19th Oct. 2007 at 12.00 noon.

Announced in the hearing. Notice of this decision be given free of cost to the parties.
