Decision

The Commission has received two complaints u/s 18 (1) (b) & (c) from Ms Gita Dewan Verma, Planner of Vasant Kunj, New Delhi that her requests for information assigned ID nos. 22(DDA), and 738(MCD) under RTI Act-2005 on approval/regularization/exemption from sealing/demolition of Delhi Govt. shopping complex in ‘Garden of the Five Senses’ submitted to the CPIO in office of Principal Commissioner cum Secretary DDA, and forwarded therefrom by Sh PS Uttarwar, Director (Planning) UC, DDA u/s 6(3) to DTDC in regard` to two items and Chief Town Planner, MCD regarding a third by a letter of 9.2.’07, has not been responded to by the public authorities to whom transferred, even though the same was duly submitted along with the requisite fee dated 02.1.2007. In the case of MCD the matter was further transferred to the Engineer-in-Chief, MCD on 23.2.’07, who in turn transferred this to DC (South Zone) on 1.3.’07 ‘as no such information is available with this (AE Bldg. HQ-IV) office’. No further reply has been received by complainant

On the basis of this complaint, the Commission hereby directs the PIOs, DTDC, Delhi and office of DC (South), MCD to each provide the information sought to applicant Ms Gita Dewan Verma within 10 working days from the date of receipt of this decision.

The PIOs, DDA (UC), DTDC and o/o DC (South), MCD are further directed to appear personally before the Commission on 14.09.2007 at 9:30 a.m. to show cause as to why a penalty of Rs.250/- per day from the date when the information became due to the date when it was transferred i.e. 2.2.’07 to 9.02.’07 amounting in the case of Sri PS Uttarwar, PIO DDA to Rs 1750/-, from 20.4.’07 DC (South), and from the date when the information became due from DTDC, i.e. 9.3.’07 to the date when the information is actually supplied, not exceeding Rs.25, 000/- should not be imposed on each of the latter two, under Section 20(1) of the RTI Act. The PIOs may in the alternative submit their written submissions to this Commission on or before 10.09.2007.

Notice of this decision be given free of cost to the parties.
