THE MINISTER OF HUMAN RESOURCE DEVELOPMENT AND MINISTER OF COMMUNICATIONS AND INFORMATION TECHNOLOGY (SHRI KAPIL SIBAL):  Upadhakshya ji, yesterday I indicated as to what the intention of the legislation is. We all know that in the 21st Century, unless you are able to embrace quality in education, our children will not be able to compete with the rest of the world.I want to in about a few minutes explain to you as to what is the structure that exists at present in the educational system and how we want to change it. 

At the moment I know that there are several statutory regulatory authorities like University Grants Commission, All-India Council for Technical Education, Bar Council of India, Central Council of Homeopathy, Central Council for Indian Medicine, Council of Architecture, Dental Council of India, Nursing Council, Medical Council, Pharmacy Council. Now, all these regulatory authorities are authorities which set minimum standards for educational institutions. They also are the approval granting authorities for the purposes of allowing institutions to run.  Not only do they set standards but they also inspect institutions.  It is the duality of this role combined in one authority that leads to a lot of problems and that is where a large number of allegations of wrongdoing have come to our notice in respect of each of these bodies.  There are, of course, accreditation councils.  You have the National Assessment and Accreditation Council; you have the National Board of Accreditation for AICTE and engineering colleges; the Accreditation Committee for Bar Council of India, you have a Committee in the Bar Council which accredits; Department of Electronics accreditation of computer course which is called DOEACC; and National Board of Examination (NBE).  But accreditation is not mandatory.  It is all voluntary.  So, most institutions do not want to accredit themselves because they do not want assessments to be made of their quality. 

One thing we want to do is that make sure that accreditation is mandatory for every institution for higher education that is set up in India whether it is set up pursuant to an Act of the State or set up pursuant to an Act of the Union Government under the UGC. At the moment only one-third of the Universities for example are accredited and two-thirds are not accredited. The first thing that we want to do is to make accreditation mandatory. 

The second thing we want to do is to assign the role of accreditation to professional bodies not to the Government or to regulatory bodies. There should be accreditation agencies but not private accreditation agencies. In that case, the allegations would be much worse.  They must be either professional bodies that are set up here or State agencies or Central agencies consisting of professionals who know what the processes of accreditation are; who will work under the norms set up by the Accreditation Authority of India.  The norms will be determined by the Authority.  The processes of accreditation are given effect to by a professional agencies and the regulatory authorities is kept far away from them That is the new structure that we are trying to set in place. 

Therefore, every agency that seeks accreditation or seeks to accredit will have to go through certain very stringent tests as set out in the Act. Each agency must register itself as an accreditation agency.  It must demonstrate to the authority that it has the financial wherewithal to actually deal with issues of accreditation, it has the necessary professional expertise to deal with accreditation;   it. It  has the necessary human resource to deal with the accreditation.  There is a whole process that has been set out under the Act before an agency is registered.  If an advertisement is made for registration you apply for it.  You give details as set out under the form. The Authority will indicate what facts are to be set out.  Then there is a public hearing.  Anybody may  object to the fitness of the agency for accreditation. Those objections are considered.  Then it is decided under what terms and conditions the accreditation will be granted.  If the agency which is accrediting actually goes and accredits an institution and it is found that the accreditation procedure was not followed or that the norms were not followed that agency itself will be liable not just for cancellation of its registration but also for punitive damages and in some cases also for prosecution.       So, there is a whole Chapter dealing with registration for the purposes of accreditation.  But I would like to indicate to you as to what is meant by quality under the Bill. I will read out the definition of quality because that is ultimately what must be judged. 

Academic quality – it is set out in the Section itself – means the quality of teaching, learning and research, and consequently their contribution to enhancement of knowledge and includes physical infrastructure, human resources including faculty, administration, course curricula, admission and assessment procedures, governance structures of the higher educational institution.  Pursuant to the recommendations of the Standing Committee, we have added another criterion because, I think, that an institution must also be judged for the purposes of accreditation if it furthers the cause of equity and inclusion in this country.  The time has come that the backward communities, the Scheduled Castes and the Scheduled Tribes, and the disadvantaged communities are also included in the educational structure of our country.  The accreditation of an institution will also indicate whether it follows those inclusive policies or not.  That is a very important factor that we have included in the definition of quality itself; to what extent that institution approaches equity and inclusion through affirmative action. 

Now, Sir, as you know, when an institution is set up in our country, most of the time without approval of the Regulatory Authority students are admitted.  Then, you go to the regulatory authority and you say: “Look; now you grant me the approvals.”  The regulatory authority says: “You are deficient in infrastructure; you do not have the faculty; you do not have laboratories; you do not have a library; you do not have the requisite quality of rooms that should be available.”  Then you say: “Now I have admitted students. What am I to do?” This is a refrain I hear everyday.   Now, this must stop.  In the process of accreditation, there should be two stages.  One is the assessment of the institution in terms of infrastructure and faculty, and then is the assessment of the institution for the purposes of accreditation with respect to quality of courses and programmes.  Therefore, when you set up an institution and you have the infrastructure complete, then the agency will say: “Yes, your infrastructure is complete, your human resource and faculty are complete, and you can admit students.”  That is the first stage. I think, the institution should be given sufficient time.  So, the Act says: “If it is a new institution, you seek accreditation at the end of six years or two batches of students must pass before the quality can be judged.”   If it is an old institution which has already been there for more than six years or whatever, then another three years would be given to it for the purposes of accrediting itself because they must adhere to the standards set out in the Act.  This is the kind of structure that we are putting in place.

Sir, when the Bill was originally introduced, as you know, it went to the Standing Committee, and the Standing Committee, in fact, made 26 recommendations in the Bill.  Of the 26 recommendations, 22 recommendations have been accepted by us fully; three recommendations have been partially accepted; and only one recommendation has not been accepted.  So, we have also gone along and incorporated in the Bill almost all the recommendations of the Standing Committee.

One other thing that the Standing Committee said – we agreed with it – was about the composition of the Authority itself.  Originally, in the Act we have talked about one Chairman and four members of the Authority.  But the Standing Committee suggested a broad-based body, one Chairman plus eight members.  So, now, it is one Chairman plus 8 members.  So, now, it is one plus eight Members, of which two will be women; one will be a Member of the Scheduled Castes; and one Member will be a Member of the Scheduled Tribes… (Interruptions)   This is the recommendation of the Standing Committee of all political parties, which we have accepted… (Interruptions)

SHRI KAPIL SIBAL :  Mr. Deputy-Speaker, Sir, the other thing that we have done is that as far as the appointment of members of the Authority is concerned, we believe that that Committee should be chaired by a National Research Professor instead of a bureaucrat. In the original Bill, that was to be chaired by a bureaucrat. We think that is not appropriate and that is also the recommendation of the Standing Committee. So, instead of the Cabinet Secretary chairing such a committee, we will have a National Research Professor who is either a person, who has been a National Research Professor, or a person who is presently a National Research Professor. The individuals who will be appointing or recommending the members of the Authority will consist of various disciplines from law, medicine and people who had been Vice-Chancellors of Universities. 

The Standing Committee also recommended that the role of the NAAC and NBA in providing research and development accreditation to the regulator should continued to offer their expertise and we have accepted that recommendation also. To prevent the overlapping of role; it has been made clear that academic standards will be laid down by the appropriate regulatory authority, namely AICTE, MCI and BCI. The norms and the guidelines on the process of accreditation would be provided by the Accreditation Regulator. That is really the format of this Bill.

Since registration is granted for a period of 10 years, the Standing Committee recommended that it should be only for a period of five years. We have also accepted that recommendation. The Standing Committee further said that for contravention of the provisions of the Bill, instead of two years imprisonment and Rs.10 lakh fine, the imprisonment should be reduced to three months and Rs.5 lakh fine. We have accepted that recommendation also

Most of these recommendations, as I have indicated, have been accepted by us. The constitution of the Committee, the functions of the Authority, the registration of accreditation agencies, all have been described in great detail in this Bill and the duties and obligations of accreditation agencies have also been set up as well as offences and penalties.

I state that this will bring about a sea change in the present education structure of our country. It will bring about quality. All institutions of higher education would be subject to very strict regulations and standards. Only then, will our young get quality education, which is our dream and when we get quality education, we will be able to compete with the best in the world.

With these words, Sir, I commend this Bill to the distinguished Members of this House.

श्री अनंत कुमार हेगड़े (उत्तर कन्नड़): उपाध्यक्ष महोदय, मैं मंत्री जी का भाषण सुन रहा था। रास्ते में 4-5 रुपये में जो कंगन मिलता है, उसे हमारी मां, बहनें खरीदकर घर लेकर आती हैं क्योंकि वह सोने जैसे दिखता है। घर में लाने के बाद पता लगता है कि वह मिट्टी, प्लास्टिक का यानी नकली है। मंत्री जी का भाषण सुनते वक्त ऐसा लग रहा था कि यह सोने का कंगन है, लेकिन अंदर जाकर देखें तो इस बारे में क्या कहें, वह शब्द आप पर छोड़ देता हूं।

हमें एजुकेशन सैक्टर में रिफार्म्स चाहिए। आपकी सोच सही है और हम भी इसी ढंग से सोचते हैं। रिफार्म्स आना ही चाहिए। आजादी के तुंत बाद हमने संविधान संशोधन के वक्त जो सोचा था, आज भी हम उसी हिसाब से जा रहे हैं। अगर इससे पहले अपने इफ्रास्ट्रक्चर, स्टेटस के बारे में सोचें तो पता चलेगा कि यह कंगन सोने का है या मिट्टी का है। हम किस चीज को मार्किट में बेचने जा रहे हैं। हम किस चीज को अपने देशवासियों के सामने रखने जा रहे हैं, तब पता चलेगा। जब आजादी मिली थी, तब हमारे देश में करीब 20 यूनीवर्सिटीज, 500 कॉलेज थे। अब हम बढ़ गए हैं। अब करीब 504 यूनीवर्सिटीज हैं और लगभग 30 हजार कॉलेज हैं। एक्रिडिटेशन की बात तो उठती है, लेकिन एक-तिहाई एक्रिडिटेशन भी नहीं हो पाया है। हमने 1956 एक्ट के तहत यूजीसी का गठन किया। उसके अंदर नैट, एमबीए का हुआ। उसके बावजूद हम एक-तिहाई कॉलेज, यूनीवर्सिटीज का भी एक्रिडिटेशन नहीं कर पाए। कुल मिलाकर 504 में से अब तक 140 यूनीवर्सिटीज एक्रिडिटेड हैं। लगभग 30 हजार कॉलेज में से 3,492 कॉलेज ऑलरेडी एक्रिडिटेड हैं। हम इतने पीछे क्यों रह गए, यह सोचने की बात है। पहले मैनडेटरी नहीं था, हम मैनडेटरी करने जा रहै हैं। इसका स्वागत है। मैनडेटरी करना चाहिए। अगर हम इंटरनैशनल स्टैन्डर्ड के हिसाब से देखें तो दुनिया के किसी भी देश में, चाहे यूएस, यूके, जापान, जर्मनी हो, एक्रिडिटेशन मैनडेटरी नहीं है। फिर भी हम इंडिया का ब्रांड साबित करने जा रहे हैं, एक्रिडिटेशन मैनडेटरी करने जा रहे हैं। हम कहते हैं कि इसका स्वागत है, मैनडेटरी कर लीजिए

इस बिल में बहुत सारे विषय बताये गये हैं। लेकिन पहला मुद्दा यह है कि हमारी क्या स्थिति है? हम चाहते हैं कि हमारे देशवासियों को अच्छी शिक्षा मिले और वह उन लोगों की पहुंच में हो। यह सराहनीय बात है, लेकिन स्टेटस क्या है? हमारा जीईआर यानी ग्रास ऐनरोलमैंट रेशियो क्या है? हम जो भी बात करते हैं, हर वक्त इंटरनैशनल स्टैंडर्ड का जिक्र करते हैं। हमारे देश की क्या स्थिति है? हमारा ग्रास ऐनरोलमैंट रेशियो, मेरे पास प्लानिंग कमीशन की रिपोर्ट, डाटा है। मैं किसी अखबार में आया हुआ डाटा लाकर आपके सामने पेश नहीं कर रहा हूं, यह प्लानिंग कमीशन का डाटा है। हमारा 12.6 परसेंट जीईआर यानी ग्रास ऐनरोलमैंट रेशियो है। हमारे यहां सौ में से सिर्फ 12.8 परसेंट बच्चे पढ़ाई के बाद हायर एजुकेशन में दाखिल होते हैं। यह हमारे देश की स्थिति है। नॉलेज कमीशन और यशपाल कमेटी की रिपोर्ट, दोनों ने कहा था कि यह  रेशियो बढ़ना चाहिए। खुद मंत्री जी ने मान लिया था कि हम कम से कम 15 प्रतिशत तक पहुंच पायें। इंटरनैशनल स्टैंडर्ड तो और भी अलग है। यू.एस. में 80 परसेंट है, यू.के. में 49 परसेंट है, मलेशिया में 27 परसेंट है और फिलीपिंस में 31 परसेंट है। इसके साथ एक कैब कमेटी की रिपोर्ट है।  वर्ष 2005 में कैब कमेटी ने रिपोर्ट दी थी, जिसमें कहा गया है --

“Courtry-wise evidence shows that no country could become an economically advanced country if the enrolment ratio in higher education was less than 20.”

हम हमेशा जीडीपी की बात करते रहते हैं, जिसका असली जिंदगी से कोई मतलब नहीं है। यह सिर्फ आंक़ड़ों का खेल है। इसे हर कोई जानता है। हम हर वक्त जीडीपी का जिक्र करते रहते हैं, लेकिन इकोनॉमिक डेवलपमैंट के लिए मिनिमम 20 परसेंट ऐनरोलमैंट रेशियो होना चाहिए, यह वर्ष 2005 की कैब कमेटी की रिपोर्ट है। हमें 20 परसेंट तक पहुंचने के लिए कितना वक्त चाहिए, यह सोचने की जरूरत है। आज हकीकत क्या है, जानने मे क्या दिक्कत है, कितना समय चाहिए, क्या रोड मैप है, वह हमारे सामने नहीं है। अगर हम अपनी स्थिति बतायें, स्टेट यूनीवर्सिटीज का तो छोड़ दीजिए। 15 सैंट्रल यूनीवर्सिटीज हैं, जिसमें से आठ यूनीवर्सिटीज के  लिए हम अभी तक जगह नहीं दे पाये। इसी सदन में बिहार की मोतिहारी यूनीवर्सिटी का जिक्र आया था। उसके लिए अब तक स्थल नहीं मिल पाया। ...( व्यवधान) गया भी है, कई सारे हैं। 15 यूनीवर्सिटीज में से आठ यूनीवर्सिटीज को हम अभी तक जगह नहीं दे पाये। ...( व्यवधान) वह अलग बात है। ...( व्यवधान)

श्री अनंत कुमार हेगड़े:हमने पिछड़ी जनजातियों का जिक्र किया। एससी, एसटी, माइनॉरिटी और ओबीसी का जिक्र किया। यह तस्वीर हमारे सामने है। ओबीसी का ऐनरोलमैंट रेशियो सिर्फ 8 परसेंट है। इंटरनैशनल स्टैंडर्ड सपनों की बात लगती है। वह बहुत दूर की बात है। हम ओबीसी में नैशनल स्टैंडर्ड तक भी नहीं पहुंच पाये, एससी और एसटी का तो बहुत चिन्ताजनक विषय है। उनका रेशियो  सिर्फ 5.4 परसेंट है। हमें 20 परसेंट तक पहुंचने के लिए  कितना समय चाहिए, यह जवाब हम मंत्री जी से चाहते हैं। हमारा ऐनरोलमैंट रेशियो अर्बन एरिया में ज्यादा है, देहातों में बहुत कम है  देहात के लोग पहुंच नहीं पाते हैं क्योंकि वहां का जो फीस स्ट्रक्चर है, डोनेशन है, वह उन लोगों की पहुंच से बहुत दूर है। इसलिए अर्बन एरिया के, नगरवासी वहां पर हायर एजुकेशन पा सकते हैं, लेकिन देहात के लोग अब तक हायर एजुकेशन से बहुत दूर हैं। उन लोगों का रेशियो है - देहात से आए हुए लगभग तीन प्रतिशत हायर एजुकेशन में एनरोल होते हैं और अर्बन एरिया से आने वाले करीब 15.9 प्रतिशत एनरोल होते हैं। इसका फर्क आप देख सकते हैं। ...( व्यवधान) हायर एजुकेशन में हमें इन सभी चीजों को देखने की जरूरत है - एक, शिक्षा तक पहुंच, समानता, सभी को शिक्षा मिले चाहे वह देहात का हो या नगर का निवासी हो। सभी को शिक्षा मिले, इसको भी देखने की जरूरत है। लेकिन अब तक हम पीछे मुड़कर देख ही नहीं पाए कि कहां तक हमारी पहुंच है और कहां तक सरकार पहुंच नहीं पाई है। देहात के लोग अब तक शिक्षा नहीं पा सके, यह चिंताजनक विषय है। अगर राज्यों के हिसाब से देखें। राजस्थान, मध्य प्रदेश, ओडिशा, छत्तीसगढ़, बिहार, मेघालय, त्रिपुरा, अरूणांचल प्रदेश, सिक्किम आदि राज्यों में एनरोलमेंट रेशियो औसतन 8.8 प्रतिशत से कम है। ओबीसी, एससी, एसटी को छोड़कर 8.8 प्रतिशत से नीचे है। गुजरात, कर्नाटक, आंध्र प्रदेश, पश्चिम बंगाल, उत्तर प्रदेश आदि राज्य दूसरी कक्षा में आते हैं जहां पर एनरोलमेंट रेशियो 8.8 से 12.8 प्रतिशत तक है। जम्मू-कश्मीर, हरियाणा, पंजाब, दिल्ली, महाराष्ट्र, तमिलनाडु, केरल, मिजोरम और नागालैण्ड में एनरोलमेंट रेशियो 12.8 प्रतिशत से ऊपर है। यह हमारे देश की स्थिति है। इस स्थिति को सामने रखते हुए हमें एक रोडमैप बनाना है। हायर एजुकेशन को देहात तक पहुंचाने के लिए, गरीब लोगों तक पहुंचाने के लिए, पिछड़े-जनजातीय लोगों तक पहुंचाने के लिए एक रोडमैप चाहिए। क्या ऐसा रोडमैप आपके पास है? ...( व्यवधान) इस देश में एक करोड़ 65 लाख से अधिक विद्यार्थी हर साल एनरोल होते हैं। हम ढंग से शिक्षा कितने लोगों को दे पाए हैं? अब तक अपनी स्थिति यह है कि कहीं तहसीलों में एक कॉलेज भी नहीं है, प्राइमरी एजुकेशन में हम 80 प्रतिशत तक पहुंच गए हैं, लेकिन ऐसी कितनी तहसीलों में कॉलेज नहीं हैं? क्या हमने इस विषय को सामने रखकर चर्चा की थी? क्या रोडमैप है? अपना रिसोर्स क्या है, रिर्सोस मोबलाइजेशन हम कैसे करते हैं? कैसे उसका इस्तेमाल होगा, कैसे हम उसको खर्च करते हैं, क्या इसका सही रोडमैप हमारे पास है? इसके बावजूद भी हम इंटरनेशनल एक्रिडिटेशन, फॉरेन एजुकेशन और हायर एजुकेशन की बात करते हैं। एक कहावत है - नीचे नंगा सिर पर पेटा। नीचे कुछ नहीं है और हम इंटरनेशनल स्टैंडर्ड की बात कह रहे हैं, एक्रिडिटेशन की बात कर रहे हैं। पहले अपना मान बचाएं, बाद में देखा जाएगा। रिफार्म्स तो चाहिए, लेकिन इस सेक्टर में रिफार्म्स चाहिए। जब खड़े होने के लिए मेरा पांव ही ठीक नहीं है, तो सिर का क्या होगा।...( व्यवधान)

श्री अनंत कुमार हेगड़े:पेटा का अर्थ है पगड़ी।  यह अपनी स्थिति है आज। इस स्थिति को सामने रखते हुए सोचना होगा कि क्या रिफार्म्स करना है।  सबसे अज़ीब बात यह है कि हमने बहुत क्रंतिकारी वेदना से इस बिल को सदन में पेश किया है और यह कहा है कि हम वह करेंगे, हम वैसा करेंगे, इंटरनेशनल स्टेंडर्ड के स्तर पर अपने देश के एजुकेशन सेक्टर को लाकर खड़ा कर देंगे, इतनी युनिवर्सिटीज़ होंगे? आपको कितनी युनिवर्सिटीज़ चाहिए, मैं बताना चाहता हूं कि हमें कम से कम 40,000 कॉलेज़ चाहिए और कम से कम पांच से छः हजार युनिवर्सिटीज़ चाहिए। यह आपका ही बयान है और आपने ही माना था कि कम से कम इतना चाहिए। लेकिन हम अभी तक 500 तक ही नहीं पहुंच पाए, पांच हजार युनिवर्सिटीज़ तक कैसे और कब पहुंचेंगे? यह मैं असलियत बता रहा हूं।

यह सदन साक्षी है, जब इस सदन में रानी झांसी बाई एग्रीकल्चर युनिवर्सिटी का बिल आया था तो सभी सदस्यों ने मिलकर उसका विरोध किया था, क्योंकि वह असंवैधानिक था। उसी ढंग से आपने इस बिल को पेश कैसे किया, यह समझ में नहीं आता। मंत्री महोदय सुप्रीम कोर्ट के जाने-माने सीनियर एडवोकेट हैं। आपके सामने मैं बहुत छोटा हूं, मैंने आपके जितना कानून नहीं पढ़ा है, फिर भी मैं कह सकता हूं कि बिना कानून समझे आपने इस बिल को सदन में कैसे पेश किया। यह सिर्फ हम नहीं कह रहे हैं।...( व्यवधान) मैं कोई पार्टी की बात नहीं कर रहा हूं, यह एजुकेशन के संवैधानिक दर्जे की बात है। इस देश के सुप्रीम कोर्ट के भूतपूर्व मुख्य न्यायाधीशों, सर्वश्री मदन मोहन पूंछी, के.एन. सिंह, आर.सी. लाहोटी, ए.एस. आनन्द आदि की रिकमंडेशन है कि यह अंसवैधानिक है, यह सदन के सामने रख ही नहीं सकते और यह आप पारित ही नहीं कर सकते। फिर क्यों रखा गया है, मैं कोई भावनात्मक पहलू से बात नहीं कर रहा हूं। ये लोग चाहते हैं कि युनिवर्सिटी सेवंथ शिडय़ूल में आती है, संविधान के सेक्शन 249 के तहत संशोधन कर लेंगे, तो फिर सब कुछ ठीक हो जाएगा। संविधान में साफ लिखा हुआ है, आपको भी मालूम है और इस बारे में चिट्ठी भी आई है। आर्टिकल 246 में लिखा है, मैं कोट करना चाहता हूं-

“Notwithstanding anything in clause (3), Parliament and subject to clause (1), the Legislature of any State also, have power to make laws with respect to any of the matters enumerated in List III in the Seventh Schedule (in this Constitution referred to as the “Concurrent List”).”

इसमें युनिवर्सिटीज़ है ही नहीं। सेवंथ शिडय़ूल में सम्बन्धित आर्टिकल में 42वां अमेंडमेंट लाए थे सेक्शन 44 में तो उसके बाद संविधान ने कहा है कि वह स्टेट लिस्ट में है इसलिए उसे नहीं कर सकते।

Article 248:-Parliament has exclusive power to make any law with respect to any matter not enumerated in the Concurrent list or the State list. It was mentioned in Article 248.   आर्टिकल 248 के तहत आप रख ही नहीं सकते। संविधान संशोधन किये बिना यह बिल पारित हो ही नहीं सकता, गैर-संवैधानिक होगा और यह हम नहीं कह रहे हैं यह बात पहले वाले पांच-पांच चीफ जस्टिस कोर्ट केस का सबूत रखकर कह रहे हैं कि यह हो नहीं सकता है। इसके बाद भी पेश किया गया क्योंकि इस देश में कुछ भी हो सकता है।

स्टेंडिंग कमेटी का जिक्र किया गया है। पिछली बार जब बिल पेश किया गया था। मेरी छोटी बेटी मैं मान सकता हूं कि कहानी बहुत अच्छी लिखती है लेकिन पहला बिल उससे भी खराब था, बिना सोचे-समझे, किसी से कोई सलाह किये बिना वह बिल सदन में पेश किया गया था। मंत्रालय को सभी के साथ मंत्रणा करके, चर्चा करके, संशोधन करके बिल सदन में पेश करना था उस काम को स्टेंडिंग कमेटी ने बहुत एलोबोरेटिड होम-वर्क करके किया, इसलिए हम स्टेंडिंग कमेटी के आभारी हैं। मंत्रालय के प्रति हम आभारी नहीं हैं क्योंकि मंत्रालय ने जो कुछ किया वह तमाशा किया। हिंदुस्तान के किसी भी बिल में ऐसा नहीं आ सकता है कि पैनल्टी क्लॉज में गवर्नर को लाकर जेल में बंद करे, इस बिल में वह भी था क्योंकि चांसलर वे ही रहते हैं, वाइस-चांसलर अलग-अलग होते हैं। चांसलर यूनिवर्सिटी के गवर्नर ही होते हैं। अगर यूनिवर्सिटी ने थोड़ी सी गलती की तो गवर्नर को ले जाकर कैद कर देंगे। मैं यह नहीं समझता हूं कि पढ़े-लिखे, जाने-माने सुप्रीम कोर्ट एडवोकेट यह गलती करेंगे, मंत्रालय यह गलती करेगा। यह सदन की अवमानना है कि परामर्श के बिना ऐसे बिल को पेश किया गया। क्या सदन में बैठे सभी लोग अनपढ़ हैं, अनजान हैं? ...( व्यवधान)  

The Standing Committee recommendation in 2.6 says the Committee has no option but to conclude that like in the other recently proposed legislation envisaged about major policy changes in the higher education sector, the Department has failed to initiate any meaningful dialogue with the major stakeholders on the present Bill also. यह स्टेंडिंग कमेटी ने कहा है।  इसके साथ ही 3.1 में कहा गया है कि  it would not be wrong to conclude that in the absence of a thorough consultation process with all the stakeholders which should have been mandatory on the part of the Department. यह भी स्टेंडिंग कमेटी ने कहा है। लेकिन बहुत आनंद से मंत्रालय ने मान लिया कि the Department is very grateful to the hon. Committee for undertaking wide ranging consultation with all the stakeholders. बहुत आनंद से, बिना जिम्मेदारी के मंत्रालय ने कह दिया। यह जिम्मेदारी स्टेंडिंग कमेटी की थी या मंत्रालय की थी? जो मंत्रालय को करना चाहिए था वह स्टेंडिंग कमेटी ने किया, इसलिए हम दुबारा स्टेंडिंग कमेटी को, उसके माननीय सदस्यों का आभार व्यक्त करते हैं। बिना परामर्श के सदन के सामने पेश करने की चेष्टा जो की गयी है उसे सदन के सदस्य मान नहीं सकते हैं। लोग हमारी हंसी उड़ाएंगे।

उपाध्यक्ष जी, किसी दबाव में आकर, जल्दबाजी में बिल बनाना, सदन में पेश करना, कैसे भी करना और यह समझना कि आंकड़ों का खेल है, बिल पास तो हो ही जाता है, लेकिन बाद में इस देश के लोगों के भविष्य के साथ खिलवाड़ करना सदन की आदत नहीं होनी चाहिए।  जल्दबाजी में इस बिल को सामने लाने की क्या जरूरत थी?...( व्यवधान) दबाव अलग है, पीछे से दबाव है। केंद्र और राज्यों के सम्बद्ध को नजरअंदाज करके, संविधान की संवेदना को भूल कर, हवा में उड़ा कर जो बिल पेश किया है, मुझे विश्वास है कि इसे सदन कभी पास नहीं करेगा। स्टेक होल्डर्स का तो कभी जिक्र ही नहीं किया गया। अब तक एक्रिडीटेशन करने वाला एक्ट था। अब हम नया बिल बनाने जा रहे हैं। यूजीसी एक्ट 1956 का क्या होगा? यूजीसी का क्या होगा और क्या यूजीसी को विश्वास में लिया गया था? It is an over-riding exercise. यूजीसी ही अभी तक करता था। यूजीसी के लिए डेढ़ साल से फुल टाइम चेयरमैन नहीं है। दस हजार करोड़ रुपयों से ज्यादा हम ग्रांट देते हैं, अभी तक वहां फाइनेंशियल एडवाइजर नहीं है। यूजीसी में फुल टाइम सैक्रेटरी नहीं है। यह हमारी स्थिति है। नई सोच के साथ हम गुजर रहे हैं। मैं इसीलिए कह रहा था " नीचे नंगा, सिर पर पेटा। " असलियत को न मान कर हम आगे दौड़ रहे हैं। यह हकीकत है। इसके बावजूद भी एक्रीडिटेशन मैनडेटरी बनाने जा रहे हैं। अगर मैनडेटरी करते हैं, तो मेरा सीधा सवाल है कि मैनडेटरी एक्रीडिटेशन का एजुकेशन सैक्टर में क्या लाभ होगा? हम एक्रीडेटिड हैं, यह सर्टीफिकेट दिखा कर मुझे क्या लाभ मिलेगा? क्या सरकार से एक्सट्रा लाभ मिलेगा या नया स्टेटस मिलेगा? पहले तो सरकारी यूनीवर्सिटीज बाहर थीं। जो एक्रीडिटेशन होता था, दस में से नौ एप्लीकेशन प्राइवेट इंस्टीटय़ूशंस की आती थीं। वे एक्रीडिटेशन सर्टीफिकेट ले जा कर मार्केट में दिखा देते थे कि हमें " ए " केटेगिरी का एक्रीडिटेशन मिला है, " बी " केटीगिरी का मिला है, हम अच्छे एजुकेशनल इंस्टीटय़ूशन हैं, इसलिए आप हमारे पास अपने बच्चों को पढ़ने के लिए भेजें। यूएसए में हो, यूके में हो या जर्मनी में हो, वहां प्राइवेट सैक्टर को एक्रीडिटेशन बाडी के नाते इन्क्लूड किया गया। वहां क्या हो रहा है? वहां यह बहुत बड़ा धंधा बन गया है। यहां पर भी हम एक्रीडिटेशन देते हैं। एक संस्था के बजाय कई सारी संस्थाएं होंगी, तो एक्रीडिटेशन ठीक होगा। हम मौजूदा हकीकत को समझ नहीं पाए, तो एक के बजाय कई लोग यहां आ कर क्या करेंगे? मार्केट में इससे सौदेबाजी का कम्पीटिशन बढ़ेगा। इसका कोई ज्यूरीडिक्शन तय नहीं किया गया। कर्नाटक की एक्रीडिटेशन एजेंसी कर्नाटक में रहेगी, गुजरात की गुजरात में रहेगी, यूपी की यूपी में रहेगी, ऐसा नहीं है और जो एक्रीडिटेशन देंगे उसे मानना ही पड़ेगा ऐसा भी नहीं है। एफलिएटिड ट्रिब्यूनल में हम जा सकते हैं। अगर कोई दिल्ली की एक्रीडिटेशन एजेंसी मुझे एक्रीडिटेशन देता है, उसे मानने की मुझे कोई जरूरत नहीं है। मैं केरल में जाऊंगा और वहां से खरीद कर ले आऊंगा तथा बाद में दिखाऊंगा कि मुझे " ए " केटिगिरी मिली है। भ्रष्टाचार रोकने के लिए क्या कदम उठाया जाता है? हम कानून बनाते हैं, लेकिन कानून के नीचे जो अंधाधुंध व्यवहार चलता है, उसे रोकने के लिए, पारदर्शिता लाने के लिए क्या प्रयास किया जाता है? कानून तो बन जाता है, कोई भी कानून बना सकता है। इसके पीछे जो अंधाधुंध व्यवहार चलता है, भ्रष्टाचार चलता है, क्या कहा जा सकता है कि भ्रष्टाचार नहीं है? मेडिकल इंस्टीटय़ूशन के बारे में आप देख सकते हैं। नैट के प्रति कितनी शिकायतें हैं? मेरे पास डेटास हैं। एआईसीटी, एमसीआई और नैट के प्रति कितनी शिकायतें आई हैं? किस नेचर की शिकायतें हैं? क्या हम ध्यान में रखकर ये कर रहे हैं? आज हम दो-तीन संस्थाओं को नहीं निभा पाए हैं, कल अगर सैकड़ों संस्थाएं आएंगी, एक्रीटेशन एजेंसी आएंगी, हम कैसे उनको संभाल पाएंगे? भ्रष्टाचार आज उंगलियों में गिन सकते हैं। उतना भ्रष्टाचार का केस अपने सामने दिखाई देता है लेकिन अगर सैकड़ों सस्थाएं आएंगी, क्या संस्थाओं को मैनेज करने के लिए दुबारा दूसरा संगठन क्या हम तय कर देंगे? कमेटी पर कमेटी बैठती रहती हैं। इस देश का क्या व्यवहार है, इस देश में यह क्या हो रहा है? यह सोचने की बात है। पिछले 50 सालों से हम एक्सपेरीमेंट के शिकार बनते जा रहे हैं। यह इस देश का दुर्भाग्य है। हर तरह से अपने मुल्क पर एक्सपेरीमेंट किया जाता है।

जो सदन के सामने यह बिल पेश किया गया है, यह बिल एक तो असंवैधानिक है और दूसरा इसका कोई रोड मैप नहीं है।...( व्यवधान)

SHRI KAPIL SIBAL:  I did not want to interrupt the distinguished Member. But the Constitutional validity issue has been discussed threadbare in the Standing Committee itself. There is a whole chapter on Constitutional validity of the Bill and the Standing Committee has said the following:

“The Committee is of the view that reservation of the Indian Council of Universities about the Constitutional validity of the proposed legislation does not seem to be well placed. As pointed out by the Department after insertion of Entry 15 of List 3, Parliament is fully competent to legislate on matters relating to higher education including universities. One must also not forget that the enactment of legislation proposing setting up of a regulatory authority for assessment and accreditation by various agencies is necessary to maintain the standards of higher education within the country as well as to protect the interests of students. Assessment and accreditation are the effective means of quality assurance in higher education the world over. Having such a mandatory system would go a long way in facilitating credible information about institutions and in the process assisting student mobility across institutions domestic as well as international. In such a scenario education being in the concurrent list, initiative taken by the Department for formulation of a Central law aimed at ensuring quality of education should be considered a welcome step by all concerned.”

SHRI ANANT KUMAR HEGDE:Therefore, the Parliament has the power to make law on a subject enumerated in the State List only in accordance with the provision of article 249 (1) of the Constitution. आप ही का रिस्पांस है। राज्य सभा में हम एक रिजोल्यूशन पास कर देंगे और उसके बाद हम कर लेंगे, यह रोडमैप है, यह इन्हीं का रिस्पांस है, इनके मंत्रालय का रिस्पांस हैं। आर्टिकल 249(1) क्या कहता है, उसकी वैलिडिटी सिर्फ एक साल होती है। राज्य सभा में अगर रेजोल्यूशन पास करेंगे तो एक साल के बाद क्या होगा। एक साल के बाद सदन में फिर से आना होगा। यह इन्हीं लोगों का कहना है। Therefore, the two ways by which the provisions of the legislation could extend to institutions imparting agriculture education are 1) by States voluntarily enacting laws that vests the power to undertake mandatory accreditation on State institutions or 2) by moving a motion for a resolution by the Rajya Sabha to extend the provisions of the legislation to institutions imparting agriculture and State institutions before doing so.

श्री अनंत कुमार हेगड़े: आप एग्रीकल्चर भूल जाइये। मैं प्राइवेट यूनिवर्सिटी का जिक्र कर रहा हूं, सैंट्रल यूनिवर्सिटी का जिक्र नहीं कर रहा हूं। नींद में सोये हुए को जगा सकते हैं, लेकिन नाटक करने वालों को जगा नहीं सकते। बिना सोचे-समझे अगर गलती हो जाती है तो हम मान लेते हैं, नीति खराब है, हम मान लेते हैं। लेकिन अगर नीयत खऱाब हो तो कुछ नहीं कर सकते। अगर सोच-समझ के बावजूद भी ये गलतियां हो जाती हैं तो इन्हें इन्टैंशनल कहा जाता है। मैं भाषा थोड़ी समझता हूं, अगर गलती हो जाए तो क्षमा करिये। एक ओर क्रिमिनल प्रोसीजर चलाते हैं, सिविल कोर्ट का जिक्र करते हैं। अगर किसी विद्यार्थी, किसी संस्था को इन लोगों के खिलाफ कोर्ट में जाना हो तो कोर्ट को इसका अधिकार नहीं है, उन्हें ट्रिब्युनल में जाना होगा। कितने लोग समझ पायेंगे कि ट्रिब्युनल कहां है, क्या है, कानून क्या है। अपनी तहसील में जो मौजूदा कोर्ट है, अगर वहां जाना हो तो हम जानते हैं, समझ सकते हैं, लेकिन ट्रिब्युनल हम कहां ढूंढेंगे। आम जनता के हित में यह बिल नहीं लाया गया है, यह बिल आम जनता को कंफ्यूज करने के लिए लाया गया है।

उपाध्यक्ष महोदय : माननीय सदस्य कृपया समाप्त करें, इस पर बोलने वाले बहुत माननीय सदस्य हैं और समय उतना ही है।

श्री अनंत कुमार हेगड़े :उपाध्यक्ष जी, मैं आपके माध्यम से सदन में कहना चाहता हूं कि अब तक जो चला था, यह खेल बहुत छोटा है, असली खेल यहां है, हकीकत यह है। चैप्टर - 4 मिसलेनियस में  ‘Power of Central Government to exempt’ यह 49 में इन लोगों का जो ऑप्शन है, जो भी संस्था हो, उसे इन कानूनों से बाहर रखने के लिए इन लोगों के पास सुविधा है। मैं आपको 49 पढ़कर बताता हूं।

क्लॉज़ 49 के तहत- “The Central Government can exempt any institution from the purview of the Bill.” मैं यह सब पढ़कर समय बर्बाद नहीं करना चाहता हूं, बिल में पूरी डिटेल्स हैं। केन्द्र सरकार के पास यह सुविधा है। इसमें क्लॉज़ 49 के तहत एग़ज़ैम्प्ट करने का अधिकार है, लेकिन फॉरेन एजुकेशन बिल के चैप्टर-4, मिसलेनियस में -

 “Notwithstanding anything contained in this Act, the Central Government may, by notification on the recommendations of the Advisory Board constituted under sub-Section 2 having regard to the reputation and international standing of Foreign Education Institution and such other criteria as may be prescribed, exempt such institutions from operation of any of the foregoing provisions other than sub-Section 3 of Section 5 and Section 8. ”

इसका मतलब क्या है? इतना सारा तमाशा करके पिछले दरवाजे से फॉरेन एजुकेशन इनस्टीटय़ूशन्स को पूरा माफ करके इस देश में लाकर बैठाया जाएगा।

श्री अनंत कुमार हेगड़े :यह आपका बिल कह रहा है। यह असलियत है। यह मेरी शायरी नहीं है, आपकी ही लिखी हुई कहानी है।

श्री अनंत कुमार हेगड़े :असलियत यह है कि फॉरेन एजुकेशन इनस्टीटय़ूशन्स को पीछे से लाया जाए। बहुत बड़ा मंडप सजा कर, इनवीटेशन देकर। मेहमान कौन होंगे, अपने ही लोग होंगे, शादी करवाने वाला कौन होगा, अपना ही होगा। लेकिन शादी किससे होगी, जापान से होगी, यूएसए से होगी, कोलम्बिया से होगी। यह हकीकत है।

उपाध्यक्ष जी, इस विषय को सामने रखते हुए, पहला- मोस्ट अनकानस्टीटय़ूशनल। नंबर दो- इसके पीछे खेल अलग ही है। यह मंत्री जी मान सकते हैं कि उन्हीं का पेश किया हुआ बिल यह रिफलैक्ट करता है। एक्रीडिटेशन बिल और फॉरेन एजुकेशन बिल को सामने रखकर देखेंगे तो पीछे के दरवाजे का खेल अलग ही है। फॉरेन एजुकेशन को हिन्दुस्तान में लाना और हिन्दुस्तान में फॉरेन युनीवर्सिटी बढ़ाना।

उपाध्यक्ष जी, हम लोग एफडीआई का सपना देख रहे हैं। लेकिन एफडीआई किसके लिए एलाऊ किया जाता है। जिस क्षेत्र में पैसों की कमी हो।

श्री अनंत कुमार हेगड़े :उपाध्यक्ष महोदय, यह बहुत जरूरी बात है। एफडीआई के बारे में बहुत कम लोग जानते हैं। बहुत सारा पैसा विदेश से आ जाएगा और इस देश में समृद्धि हो जाएगी। एफडीआई का मतलब यह है कि हमारे पास पैसा नहीं है। हम बिकाऊ बन गए, इसलिए खुला है। आइए, अपने इनफ्रास्ट्रक्चर में इनवैस्ट कीजिए और ले जाइए। अपने इनस्टीटय़ूशन में इनवैस्ट कीजिए और ले जाइए। बाद में सभी सैक्टरों में एफडीआई आ जाएगी। रिटेल सैक्टर में भी एफडीआई का है।

उपाध्यक्ष महोदय : आप बिल पर बोलिए। यह विषय अलग है। जब यह विषय आएगा, तब बोलिएगा।

श्री अनंत कुमार हेगड़े:  आखिरी बात कहकर मैं समाप्त करता हूं कि इतना देखने के बाद, इतनी कहानी सुनने के बाद मुझे एक प्रेरणा मिली है कि मैं अपनी छोटी बच्ची से एक कहानी लिखवाना चाहता हूं और उसका अनावरण मंत्री जी से करवाना चाहता हूं, उसका नाम होगा "सिब्बल के सपने  '।

DR. K.S. RAO (ELURU): I sincerely thank the hon. Minister Shri Kapil Sibal for getting this Bill early.  The reason is that the quality education is the key for the economy of any country.  If the quality is not there in the education, then the citizens will not be competent to produce wealth. The institutions are sought to be upgraded for that. 

As you have said it was voluntary earlier in spite of the efforts made by the Government of India through NAAC.

You have said yourself about NBA, it is only 30 per cent which has been accredited so far.  The assessment said that even 90 per cent accredited institutions are not up to the satisfaction.  Only 30 per cent are accredited because it is voluntary on their part.  Even out of that 30 per cent, 90 per cent of them are not up to the standards.  So, naturally, it is very urgent that it must be made mandatory and you must ensure that those standards are maintained properly by these institutions and the penalties that are also levied at least make them fear to maintain it.  So, I really appreciate it and I wish that he must ensure that the Bill should be passed at the earliest. 

I heard Shri Anant Kumar Hegde.  I do agree that by virtue of his belonging to the BJP, he is finding fault with the Bill.  I would like to say that finding loophole with the Bill is nothing wrong but all the time I have observed that he was pessimistic. He was telling that the Bill should not be passed at all.  He is advising the whole House not to pass the Bill.  It means that we are obviously putting a block on the upwards by the Government to bring a quality education to this country.  I would like to say that we are lagging behind but certainly we are not blocking the way of the Bill.  We are not blocking the accreditation agency to choose to lay standards with regard to the education. 

I agree that the hon. Minister himself said that Gross Enrolment Ratio with regard to India for higher education is far below compared to the developed nations.  He is also agreeing that even in the developed nations’ accreditation is being done.  The accreditation is not for business.  The accreditation is to maintain the quality of the education in any country. Everybody appreciates this thing. Were all the developed countries fool to bring accreditation into the administration?  As our country is so big and the numbers of people are so many, it cannot be done by one organization.  So, he is creating a regulator and he wants to get it done through an outsourcing agency or through a Government agency.  I would like to say whether it can be the Government of India, State Government or a public sector enterprise.  The Government is not allowing any private sector in this. It is imperative that we have to bring this Bill and pass it immediately.  You yourself have read that the efforts made by the Standing Committee and they are also clearing that it is constitutional.  It is within the authority of the Parliament to pass this Bill. We appreciate it. 

In this context, I just would like to bring to your notice some of the apprehensions which I also have in spite of being a Congressman or part of the UPA-II Government.  The purpose of this Bill is excellent to assess the quality and giving a benchmark to each institution so that they will compete with each other and then come to a standard.  While doing so, you are laying standards perfectly with regard to teaching, learning, research, curriculum, contribution to the knowledge, infrastructure and so many other things.  

You are telling that no institution can start admission without the approval of the Authority.  Giving this Authority to AICT means all the engineering colleges or professional colleges to be started in any part of the country which were used to be permitted by the respective State Governments have to now necessarily come and get approval from AICT.  Now by this I apprehend, even a degree college or a post-graduate institute whether it is in arts or sciences or social sciences or humanities which is to be started in the country will have to be with the approval of the Regulatory.   It is said that after 12 years of education, colleges and universities are included in this Bill. I just wanted to bring it to your notice what would be the state of starting colleges.  Should they have to take permission of the Regulatory in any part of the country?   I just wanted to know this from you.

Then, I am happy that you have taken the advice of the Standing Committee and changed the term of the registration from 10 years to five years. I also felt ten years is too long for registration because we will be giving ample opportunity for them.  You cannot rely on the institutions that they will maintain standards for ten years after taking the registration.  So, it is better if it is renewed or monitored regularly.   If they are maintaining the standards, there is no harm in renewing the registration.  But once we give it for ten years, there will be slackness on the part of the institutions.  So, your reducing it to five years is good and you can think in terms of whether it can be reduced further. 

Similarly, you have taken the advice of the Standing Committee for increasing the number from 1+4 to 1+8.  It is also good.  Your thinking in terms of putting the SC/ST or even assuring the OBCs and the minorities is also all right.  There is nothing wrong in it.

SHRI KAPIL SIBAL:  We will do it but the only problem is that there is a bench mark by the Supreme Court of India that more than 50 per cent reservation cannot be there.  So, we will have to increase the numbers from 8 to 11 and then get the minority and the OBC and the Scheduled Castes and Scheduled Tribes and women in so that it is not more than 50 per cent.  That we will do.  We will increase the number to 11 and then we will have all the representation of everybody.

DR. K.S. RAO: I am happy that you are increasing the number and including the SCs/STs, minorities and OBCs. 

I just wanted to know whether there is any limit in the number of accrediting agencies that you have in mind or it will be unlimited.  The unlimited number of accrediting agencies will possibly bring the same evils of what we have seen earlier.  I would request you to think seriously whether we can limit the number to a reasonable level rather than keeping it as unlimited.

In regard to choosing the accreditation agency, you are telling that the finance also must be self-sufficient.  My point is what we need is integrity, an unquestionable honesty, efficiency in their work, their knowledge and not necessarily finance.  Finance may not be required.  Suppose you say that the limit of finance should be such that they must have a balance sheet of five years with Rs.1 crore or Rs.10 crore. Then only rich people will come in as accreditation agency.  But we want only professionals, distinguished scientists, distinguished professors and who are experts in this line and not moneyed people.  Even if you keep self-sufficiency in finance, let it be a reasonable limit and not a major limit.  I would just request you to think on that.

Then in regard to gradation, you did not mention how many grades will be there and whether it will be a, b, c, d; or a, b, c or only I or II or something of that kind. Similarly, you did not put any clause. Suppose an institution does not apply for accreditation at all, then what would be the situation? We have seen that when it has become voluntary, many of them have not applied or have not taken it in spite of your insistence since 2002 or 2000. That means 12 years have passed.  But you have made it mandatory.  If it is not applied, then what is the position?  It is mandatory now.  In that case, are you going to close it?  I just want to know that if the institutions were not to apply for accreditation at all, knowing fully well that there are deficiencies in their institute, that they have not maintained their standards and the regulations, then what is the position?  Are you going to close it giving a time of five or six years or something like that? I just want you to think on it. If necessary, you may incorporate a clause on that.

In regard to the Selection Committee, you have said that there are four members in the Bill.   There is no mention about the member with a professional knowledge in science and technology but by increasing the number, I do not think, it will be a problem now.

The major problem which is affecting the educational standards in this country is only corruption, as my friend has said.  This corruption has to be checked with the accreditation agencies also.  On that, I am also of the opinion that the law must be very stringent. As suggested by the Standing Committee, you have the period of imprisonment from two years to three months and penalty from Rs. 10 lakhs to Rs. 5 lakhs or both.  But I am of the opinion that there must be stringent punishment in this regard because we could not regulate or it has become difficult for us to regulate even one institution.  When there are many agencies, it will be very difficult for us to regulate them.   So, I wish that there must be stringent punishment in this regard or any complaint, if proved later, must be a non-bailable case.  Otherwise, there will always be a pressure.  Somebody will get imprisonment for three months and come back and they will pay Rs. 5 lakhs and get away. The amount involved in these things will be running in crores of rupees in the country.  So, I wish you to think of the magnitude of corruption that is going on in the country in regard to education and getting approvals, etc.  Please see to it as to whether it can be made a non-bailable offence.

In regard to compensation to the institution, you said that only the State Tribunals are responsible for it.  In regard to the mistake committed by the accreditation agencies, you said that the Central Tribunal is responsible.   Please distinguish between the two of them.   Please see whether the Central Tribunal can also have a say on that if the State Tribunal is too lenient in this regard.

I wish that the accreditation agencies should not have members from that particular State and they should be from some other State so that they cannot be influenced by them in this regard.

Regarding standard, you said that they will be mentioned by the concerned regulatory authority.  We have seen the performance of AICTE and other agencies.  Instead of leaving it to them, you can say that it should be done in consultation with the Central Government or the Central Regulatory Authority. Then we will have a say or control on those things.

As regards monitoring, we must have a separate Vigilance Division. Without constant vigilance, without constant surprise checks, we will not be able to control quality.  I am telling this because, unless the quality of education in this country is such where the production of wealth can be done easily by any citizen of the country, we will not be achieving our goal.  Countries like Germany, USA, Japan, South Korea and Malaysia have come up because of the quality of education that they are imparting and skills that they are developing there.

Though not connected to this Bill, I want to express my apprehension. I just want to say that allocation of the Government of India to education has increased and it is excellent. You wanted to cut down the drop-outs also and it is excellent.  Now, imagine a situation when 90 per cent of the people are studying upto 12th standard and we increase the GER also from ten to fifty. Then with this general education, there will be millions of people who are educated. They will think that they have done M.Sc or Ph.D. but when it comes to the question of generating wealth, they will not be able to do anything. Then you will face a lot of problems and it will really be a volcano from the side of unemployed educated people.

So, the education which we are going to impart must be rigorous, must be of quality and there must be productive ability. That means even if they were not in the employment from the Government sources, they must be able to live on their own.  So, you please think in that direction whether this education must be vocational in mean or you arrange the skills training separately for many of the citizens of this country. It is particularly in rural areas, from the poorer sections of the society; we have got a large number of youngsters who may not be able to do Ph. Ds., who may not come to the university, but there are people who can acquire skills very efficiently and very competently and live on their own.  So, I wish that this must be taken care of though it is not connected with this Bill. 

Sir, you said about the social audit. I also wish the same. When it comes to question of accepting or registering the agency or seeing the standards of the institution, the students, the parents, the teachers and all the people connected must be consulted before finally giving this registration to them or approving the institution. … (Interruptions)

Sir, in regard to revocation when there is a breach on the part of the institution in regard to maintaining the standards or accredited agency not maintaining the integrity or anything connected with that, there must be easy provision to revoke them or to cancel them.

Sir, in regard to the term of the members, you gave five years. You also said, the minimum age must be 55 years and maximum is 75 years and after retirement, they cannot work anywhere for five years.  Suppose, if a person of competency were to become a member at the age of 55 years and continue up to 60 years what would be his fate later?  So, you please think whether we can do some changes in that regard.

In regard to finance, instead of thinking always of making a provision in the Budget in a large scale in regard to colleges and universities, let the fees be so much that they can be self-sufficient.  All the other countries are charging exorbitantly on this aspect. 

As far as renewal is concerned, some of the countries are doing every year or every two years or three years by which they are getting some money to feed them only.   It is not for getting any benefit, but only to make them self-sufficient. 

Sir, in regard to compensation to the accrediting agency, if it goes wrong in accrediting an institution either voluntarily or involuntarily, you said that they have to pay right compensation. But is there any limit in that regard?  Is there any gauge or standard by which the compensation must be fixed?  So, I wish that a thought must be given to it whether there should be any limit in this regard.     

Sir, you said civil society, media, whistle blowers, students and all that will be consulted in this regard.  It is excellent.  But there also, once again, the Central Authority must have some say on these things. We cannot be carried away because all the sectors are now full of corruption. In this regard, we must be very cautious to ensure that it must be corruption free. 

Above all these things, we know that there is a faculty crunch. Unless the numbers of teachers are sufficient in this country, no matter what laws we pass here in the House, it will not help us. So, first of all, please think in terms of increasing the number of quality faculty.  Many of the good institutions only have the faculty and rest of the institutions do not have the faculty.  In fact, somewhere I read that some of the institutions which are not up to this level are not taking standard teachers.  It is because if they take standard teachers, all their loopholes will come out.  … (Interruptions)
