Violation challenged: mis-allotment / misuse of school sites in Vasant Kunj, infringing DMP equal access neighbourhood school system rights of local students and residents in all sections of the community

Core issue: Land allotment conditions help operationalize the equitable benefit purpose of land policy by which land was compulsorily acquired in Delhi for development according Plan. Accordingly, conditions about type of school, local enrolment and free seats help operationalize Master Plan provisions for equal access neighbourhood schooling, which cannot be compromised, irrespective of the price charged for allotment. Use of school sites in violation of approved layout plan and Master Plan standards for space for buildings, parking, etc, leads to up-market schools in excess of what local demand can sustain. Schools tap city-wide market in violation, at cost of residential amenity, of local enrolment provisions. In the resultant exclusion due to commercialization, the poor among local students are worst affected as free seats' conditions are flouted with even greater impunity. This, in turn, makes for violations in government schools, burdened with enrolment in excess of and space short of standards and resultant environment not at all conducive to quality learning. Inequity in education cannot be removed by charity in residual resource space. It requires equitable access to resources, primarily space, for schooling - more so when inequitable use of school sites is illegal.

27/10/2004: Seventh listing: Petitions allowed: "It is true that in the matter it is pointed out by the learned counsel for the petitioner that in fact some parcels of land indicated in the lay-out plans as for the use as Nursery Schools are being used as integrated schools. On behalf of the Education Department, it is stated that only those schools which meet with the norms have been granted permission for upgradation. The learned counsel for Delhi Development Authority (for short "DDA") submitted that no permission has been obtained from the DDA. It is clear that when a layout plan has been prepared, any variation thereon must be according to the law. If any change is required to be made in such a plan, then only DDA can take appropriate action. In such a situation, it is for the Education Department to move the DDA for making necessary changes in the layout plan. So far as the other violators are concerned, it is pointed out on behalf of the DDA that show cause notices have been issued to the persons who have violated the conditions and it is assured that action will be taken against such violators in accordance with law after considering their replies. Let the action be taken within a period of 12 weeks. With this direction the petition is disposed off."

    The National Progressive Schools Council (NPSC) is all set to plea to the government for their representation in the civic bodies for the standardisation of the property tax and the parking charges.

    The unit area method property tax imposed by the MCD has been categorised from A to G. The last date of filing the taxes to gain 15 per cent rebate is October 31. The schools have however, opposed the new scheme as they say that even though the school is located in a posh area falling under category A but the students might not belong to an affluent family.

    "We want to subsidise and standardise the property tax of the schools as this would affect the tuition fees in return. The students come from varied financial background, therefore even though the school gets categorised as A but it would not be possible for each of the parents to shell out high sum of money," said Usha Ram, the principal of the Laxman Public School and the secretary of the NPSC. The schools have also decided to speak to the MCD on the imposition of annual parking charge of Rs 4,000.

    "We will be meeting the officials concerned of the MCD to waive off the parking fees charged from schools for the parking of the school buses," Ms Ram said. The NPSC comprising 105 public schools of Delhi and NCR claims that the decision is taken solely for the benefit of the parents. "The charges imposed by the civic bodies are putting an indirect pressure on the parents, therefore we are seriously concerned and want it to be resolved," added Ms Ram.

    The Government has finally been prodded into action. Following widespread criticism that government-owned schools lack even basic facilities, it has decided to hand over 1,000 schools to a third party for maintenance and upkeep.

    The Infrastructure Lease and Finance Services Limited (IL&FSL), in which the Centre has a significant stake, has been assigned the task of maintaining schools. The money being paid to the PWD would now go to this company.

    Sources said modalities for the transfer were being worked out. The draft of the new policy will be sent to the finance and law department for clearance. It will have to be finally approved by the Delhi Cabinet.

    Financial details regarding the amount to be given to the company per school would be worked out soon. The company made a presentation to chief minister Sheila Dikshit and other ministers in this regard earlier this week.

    Though the IL&FSL is keen on taking over all Delhi schools immediately for upkeep, the government plans to introduce the concept gradually, sources told the Hindustan Times.
    "Initially a few schools would be chosen and then we can give the contract of all schools," an official said.

    The contract would be for a period of five years, subject to renewal. "The proposal would now be implemented only from the next academic session," an official pointed out.

    Asked to explain the reasons for outsourcing maintenance of schools, an official said the PWD had its own priorities and projects. "We will now have one dedicated company to look into the nitty-gritty of school infrastructure. It would be answerable to the education department," he said.

    Govt can't manage its schools

    The pitfall:

    At present, principals can sanction up to Rs 1 lakh a year on infrastructure works. After outsourcing, they may not have this power.

    Paying property tax may become simpler for private schools in Delhi.

    The MCD’s Hardships and Anomaly Committee has recommended that schools be divided into just two categories for calculating property tax. Schools were earlier divided into three slots on the basis of the fees they charge.

    The first category comprises schools which charge up to Rs 600 as fees. Schools charging more than Rs 600 as fees will be in the second category and will have to pay twice the tax as those in the first category.

    While fixing a school's category, fees for boarding and transport would be deducted from the final figure.

    This means that only fees charged for development, security, library and cultural activities will comprise the final figure on the basis of which fees charged per student is calculated, said an MCD official.

    The third category for schools which charged more than Rs 1,200 has been done away with, said a committee member. This was done because of fears that schools would pass on the tax burden to parents.

    Committee member Sanjay Puri said schools have already been given other benefits, said Puri. The early payment rebate had been increased from 5 per cent to 15 per cent for schools which paid their tax till October 31.

    Schools had been demanding that the policy for calculating property tax be reviewed. "As per property tax rules, private schools falling in category C would have been asked to pay an additional Rs 37 lakh as tax which means Rs 2000 more per child per year," said V.K. Williams, of the Association of Progressive Schools in a representation to the committee.

    The Union government would launch a new health insurance scheme soon to cover more than three lakh people living below poverty line in New Delhi.

    The scheme would be funded through a corpus fund of Rs 400-500 crore by charging market rate from private hospitals, which have been allotted land at concessional rates by Delhi Development Authority (DDA) and L&DO of the Centre.

    The scheme has been initiated by the Urban Development Ministry. The ministry plans to put the corpus fund under an appropriate authority.

    A joint task force is to be constituted consisting of experts from both health and tourism to examine issues concerning medical tourism. This was decided in a meeting between Union Health and Family Welfare Minister, Dr. A. Ramadoss and the Minister of State for Tourism, Smt. Renuka Choudhury here today. The task force is to look into issues relating to accreditation of hospitals and a price band for various kinds of treatment to be offered as part of promotion of medical tourism. The Minister for Tourism also desired that the committee should look into the recognition of spas and ayurveda Centres in India. The committee will also look into other issues like insurance and staying facilities while according accreditation. Dr. Ramadoss informed Smt. Choudhury that a decision had been taken to standardize and accredit all hospitals in India but the exercise may take two years. The task force will submit its recommendations to a key committee to be headed by the Health and Family Welfare Minister and Minister of State for Tourism.

    A special UNICEF project aims to turn a gaggle of street children in New Delhi into roving puppeteers who use their marionettes to teach safe sex, promote AIDS awareness, gender equality and sensitivity to everyone from truck drivers to friends, family and peers.

    Spread over the next two years, the project would be conducted by the city-based Ishara Puppet Theatre Trust and the Salaam Balak Trust.

    "We will first have a large group of street children who will attend extensive workshops," said Dadi Pudumjee, head of the Ishara Puppet Theatre Trust. "From these, we will pick a core group of 25-30 children who will be our campaigners."

    These children would then go around the city and hold puppet shows to teach groups like truck drivers that are specially susceptible to HIV/AIDS.

    Truck drivers travel great distances on the highway and are in frequent contact with sex workers, which make them potential AIDS victims

    "This kind of activism works the best because puppets can say things that human beings cannot and children say things adults cannot," said Pudumjee, who has been a puppeteer for the last two decades.
    The puppeteers will give four performances in different locations and will be paid as well.

    "Though no one will be paid during the training workshop, the core group, once selected, will be paid," said Pudumjee.

    "We are looking to make this an alternate profession for these children, a different way to make a living, through which they can also contribute to society and teach a few things to their peers."

    A large number of schools operating from non-DDA land are not admitting children from economically weaker sections. They have instead, kept seats vacant till the ongoing case is resolved in the Delhi High Court.

    In a recent meeting of the action committee — a body representing Delhi’s private schools — it was decided that these institutions would keep the mandatory 20 per cent seats aside during the ongoing admission process.

    “We will keep the seats vacant and admit students only to the other seats,” R.C. Shekhar, Principal, Gyan Bharti School said.

    “Depending on the court verdict, schools can go ahead and admit students from the general quota or the economically weaker section as the case may be,” action committee secretary S.L. Jain said.

    Committee head T.R. Gupta said that they had asked Union HRD minister Arjun Singh for allowing classes for the weaker sections in the evenings. “The bright ones from this lot can then be integrated into the morning school,” he added.

    Meanwhile, some other institutions like Bharatiya Vidya Bhavan and Delhi Public School, Mathura Road have decided to adopt a wait and watch policy and are yet to decide on their policy vis-à-vis reservation.

  • 30. Students pay for teachers in Delhi schools

    New Delhi, Nov. 4: Students going to some of the government-run schools in Delhi are being made to pay an "additional" monthly fee ranging from Rs 10 to 45 for "hiring private teachers" to teach them because of shortage of teachers.

    A majority of government-run schools, which are facing shortage of teachers, have now adopted this method of charging a fee from the students to hire private teachers to teach them.

    Seven-year-old Ritesh Jain (name changed), studying in Class 3 of Sarvodya Balika Vidyalaya, Avantika, Sector I, Rohini, paid an extra fee of Rs 10 to the school administration last month for hiring private teachers. The school administration categorically told the parents of all students to pay an additional fee of Rs 10 for hiring private teachers for the school. The parents were also asked to give it in writing if they agree to hire a private teacher.

    Earlier, students of this school used to pay just Rs 20 as monthly fee to the school administration. Now, they are paying Rs 31.

    However, it is not mentioned in the fee receipts that the additional fee of Rs 10 is being charged for hiring private teachers.

    Interestingly, there is no government policy on this. The schools are apparently implementing this policy on their own.

    Same is the case with a government-run higher secondary school in the Ramesh Park area. For the first time, the school administration is charging Rs 45 from each student of Class 8 as monthly fee. Students of the school don’t know as to why the amount is being charged from them.

    Meanwhile, the Delhi government has decided to close down more than 50 schools in the city. The reason: there are few students.

    Of the 53 middle, secondary and senior secondary schools to be closed, some are more than 15 years old and have less than 300 students each on their rolls. As a result, it has become difficult for the administration to run them. The students of these schools will be accommodated in other schools.

    The education department of the Delhi government closed 30 schools in 2003. This year, the government has closed 25 schools so far

    A Delhi government-run senior secondary school near Kinari Bazar at Gali Barf Wali in the walled city area has only 47 students. Residents of the area claim that this school is more than 15 years old. Now, the government has decided to shut down the school.

    Besides, a government-run senior secondary school near Sushila Mohan Marg will also be closed down as it has only 50 students. While the government-run senior secondary school in Molar Band has just 55 students, a middle school situated near the Railway Colony in the Paharganj area has 71 schools. Another middle school situated in the Paharganj area also has only 77 students.

    There are also several government-run schools where the number of students are close to 300. Still, these will be closed down. They include a senior secondary school in Chhawla (291), a middle school in R.K. Puram-4 (291), a senior secondary school in Kangan Heri (290), a senior secondary school in Dichaon Kalan (290) and a middle school (Urdu medium) in Bulbuli Khana (288).

    The Union Urban Development Ministry has worked out a “practical” solution to the problem of hospitals not providing free beds to poor patients as per lease terms.

    Union minister Ghulam Nabi Azad has proposed to Lt-Governor B.L. Joshi that nine city hospitals, which are not treating poor patients for free in lieu of getting land at concession, be freed of their obligation.
    For this, hospital managements will have to pay the differential amount between the original allotment price and the current market price.

    An amount of Rs 500 crore earned through this can be made into a corpus, which will be under the Lt. Governor’s management and will be used for health insurance schemes for the poor.

    The interest from the corpus fund at 5 per cent per annum will be Rs 25 crore — enough to give health insurance cover to 4 lakh families in the city who are below the poverty line.

    The insurance cover would reimburse medical expenses up to Rs 30,000 for hospitalisation, coverage of death due to accident of an earning head of the family for Rs 25,000.

    In a letter to lieutenant-governor B L Joshi, Union urban development minister Ghulam Nabi Azad on Friday gave his consent to free the hospitals from their obligations if they pay the current market rate of the land allotted to them. He has proposed no other penalty.

This new website enables maintenance of personal details of nearly nine lakh students, their performance in examination, health, discipline, the entire registration and admission process.

    Launching the website at the Delhi pavilion at Pragati Maidan today, the Education Minister, Arvinder Singh Lovely, said it was yet another step to fulfil the dream of the former Prime Minister, Rajiv Gandhi, to spread education and awareness among students through use of Information Technology. The Education Minister informed that under this new software, students and parents would be given a code. This code would also be kept with the Education Department. Through use of this code, individual parents can access the various details about their wards and make constant efforts to improve it. The best part of this software is that it contains full details about all the nine lakh students individually and keeps track of their performance subject wise. "It is the initiative of the Chief Minister, Sheila Dikshit, who had expressed keen interest that best possible facilities should be provided to students and technology should be used for their benefit,'' he added.

Joshi, here today witnessed uproarious scenes as the elected Members unanimously opposed tabling of the agenda for auction of school plots on the ground that it would make education expensive and take it beyond the reach of the ordinary citizens. The members also alleged large-scale corruption in allotment of over 400 institutional plots, conduct of mini draws and allotment of a residential plot and demanded a probe and action against guilty officials.

    The meeting, which lasted nearly two-and-a-half hours, saw the elected members -- MLAs Mahabal Mishra, Zile Singh Chauhan and Mange Ram Garg, and Councillor Virender Kasana -- join hands to oppose the proposal to auction all school plots. Stating that it would be tantamount to sale of education in Delhi, Mr Mishra vehemently opposed the proposal and called for continuing with the old method of allotting school plots to the eligible societies.

    NEW DELHI: Delhi Development Authority's (DDA) new policy to auction land to schools and trusts has run into rough weather as the elected representatives have raised objections against it. They have reportedly asked the civic body to scrap the policy.

    The policy came under fire in the board meeting of DDA, chaired by lieutenant-governor B L Joshi. The representatives, including all MLAs and councillor, said the policy was anti-poor. Councillor and member of DDA Virender Kasana said: "This will lead to commercialisation of education. DDA or the government would not have any control over the schools and they will charge anything as fee. This would mean pushing education out of the reach of the poor or economically-weak sections of the society."

    The Union government would launch a new health insurance scheme soon to cover more than three lakh people living below poverty line in New Delhi.

    The scheme would be funded through a corpus fund of Rs 400-500 crore by charging market rate from private hospitals, which have been allotted land at concessional rates by Delhi Development Authority (DDA) and L&DO of the Centre.

    NEW DELHI: You finally get to grade the government. Delhi government has commissioned a 'social audit' by which citizens can evaluate government services in hospitals, schools and issuance of licences and ration cards. The audit will be conducted by a Bangalore-based agency called Public Affairs Centre (PAC).

    Delhi will be signing a memorandum of understanding (MoU) with PAC soon. "This audit is being conducted so that we as a government are guided as to where the shoe is pinching. The report will study the level of public interaction, corruption levels and the reforms that should be introduced," said chief minister Sheila Dikshit.

  • 88. Donation racket unearthed in school

    NEW DELHI: The income tax department has cracked down on Bal Bharati Public School and found that the administration had been giving admissions to students in lieu of donations running into lakhs of rupees. The department has also zeroed in on five other public schools of Delhi and is investigating their role in carrying out a similar practice and illegally granting exemption certificates.

    The exemption wing of the I-T department swooped upon the business premises of the school at Pusa Road branch and seized account books and other records. The department reportedly found that the school has been taking "conditional donations" from the parents for giving admissions. Receipts seized by the exemption wing revealed that the school has reportedly been taking Rs 1.5 lakh per student admitted at pre-primary level. Over 50 such receipts issued in 2004-05 have been seized.

    NEW DELHI: In an effort to introduce computer-aided learning in the non-formal sector, the Delhi government will provide access to computers for students under the Sarva Shiksha Abhiyan (SSA). The project will be undertaken with the assistance of chip major Intel and the administration will be signing a memorandum of understanding (MoU) with the firm soon.

    The program, Intel@Learn, will be introduced in 13 schools and is expected to target 6,000 students who have little or no access to computers. "Students under the SSA program already come for classes in languages and maths to our government schools after the regular classes are over. They use the same facilities and will now be using a computer lab also," a senior government official said. Extended monitoring and support will be provided to these schools through SSA district coordinators.

    NEW DELHI: The Delhi High Court on Friday issued notice to the Delhi government and the Municipal Corporation of Delhi (MCD) on the plea of a lawyers' group seeking a direction to the authorities to ensure availability of infrastructure and amenities like drinking water, toiletsand electricity in state-run schools.

    Chief Justice B C Patel and Justice B D Ahmed asked the Delhi Government and MCD to file their response to the application moved by Social Jurist by March 4, the next date of hearing.

  • 96. `Eco-Meet 2005' inaugurated

    NEW DELHI, FEB. 23. The Delhi Chief Minister, Sheila Dikshit, today said that to make the Capital a clean city it was necessary to involve the citizens in the various eco-related programmes.

    Inaugurating a four-day "Eco-Meet 2005" at the National Bal Bhawan here, Ms. Dikshit said management of garbage, control of pollution and improvement of general sanitation were necessary to make Delhi a world class city.

    "This is only possible if the Government works in tandem with the citizens," said Ms. Dikshit, who also administered an eco-pledge to the students besides handing out 65 certificates of recognition to leading Eco Club Schools. Ms. Dikshit -- who was accompanied by the Delhi Environment Minister, Raj Kumar Chauhan -- also visited an environment-related exhibition put up by children from across the Capital on the occasion.

  • 101. Bill on education is just a ploy: Abu Bakar

    NEW DELHI, FEB. 26. A two-day national consultation on the proposed "Free and Compulsory Education Bill 2004" was inaugurated today. Organised by the National Alliance for Right to Education and Equity (NAFRE), the convention has over 200 activists and educationists participating.

    Speaking on the occasion, the Chairman of the Minorities Commission, Abu Bakar, said people living in the margins have been denied education by the class in power since Independence. "The character of the State has been suppressive and coercive, whose deliberate plan is to keep education from the reach of the people. The proposed Free and Compulsory Education Bill 2004, scheduled to be tabled in Parliament during the ongoing budget session is nothing but another ploy to snatch education from the people,'' he said.

    NEW DELHI: Stung by allegations of misappropriation of funds, Delhi government has put aided schools under the scanner. The education department will conduct an audit of about 250 schools in the Capital.

    There have been several complaints against the functioning of aided schools that suffer from poor infrastructure and teaching facilities. "Most aided schools leave much to be desired as far as their teaching or other facilities are concerned," an official said. Aided schools get nearly 95% of their funding from the government. Sources say that there is very little check on the working or accounts.

    The Constitution of India, committed to universalisation of education through a directive principle, was amended to make free and compulsory school education a right. The amendment requires a law to be enacted, draft Bill for which was prepared and twice modified in 2003. In the discourse about the draft bill as well as in recent PIL on free seats for the poor concern for a common school system has been amply reiterated. But holistic solutions suggested in existing law, such as in the equal access neighbourhood school provisions of Delhi Master Plan, although being sought by communities, continue to be disregarded in the discourse. This list is for discussion premised on already existing law, so that the proposed education law improves upon them.
