Delhi Metro Rail Corporation has been doing, besides metro, something
called metro property development, about which I have been filing
objections via legal Public Notice process.

After surveys began, alongside illegal malling and mega-housing proposals,
for metro corridor near ridge Qutb/mehrauli to Sultangarhi/mahipalpur, we
fielded in December 2003 a comprehensive PIL (hanging fire, as they are
not answering).

Around the same time metro property development by way of commercial IT
Park started on riverbed and in September Public Notice to, in effect,
regularise it was issued. Construction continued despite objections and CM
and other capital gods inaugurated first portion on 02/04/05. On 07/04/05
I moved court against metro property development without disposal of
Public Notices, with application for stay on property making on the
riverbed.

On 13/04/05 notice to reply in two weeks was issued, and ignored. On
23/05/05 (next hearing) instead of replies they brought to court copies of
notification of 25/04/05 regularising IT Park (thereby admitting that CM
and other gods had inaugurated illegal building and proving that part of
my case) and were ordered to file replies in four weeks and for riverbed
constructions also permissions. They have not.

Since mid-May capital gods-of-all-things are fuss-making about elevated
metro corridors, to implicitly certify lately completed underground
corridor as well as boldly continuing property development. On 15/07/05
ToI had a tender issued by DMRC to invite bids from private developers for
licenses for 15 Ha, plus 2.7 Ha parking, on the riverbed for 15 years at
reserve fee of 5 crore for temporary-facility for recreation. Documents
could be purchased and bids submitted between 18/07/05 and 01/08/05, when
tenders would be opened.

On 14/07/05 I had attended (as adviser to firm that had also responded to
IT Park Public Notice) investors meet called by Uttaranchal Forest
Department about private sector participation in eco-tourism, where about
hundred firms agreed that before any formal tender process several
techno-legal issues need to be resolved to avoid starting precedents
detrimental to PPP / eco-visitation prospects. DMRC tender was for what
investors had decided against the previous day and what wide range of
people had objected to in response to Public Notice for previous
commercial (IT Park) venture there. And it was in disregard of court
orders in my petition. After writing polite requests for withdrawal, on
25/07/05 I filed an application for stay and on 27/07/05 DMRC was
restrained from finalising bids.

DMRC seems to be have been assuring prospective bidders there is no stay,
etc, and Delhi may well get its minimum-5-crore-15-yr temporary-item to
talk about permanently (even after IIC and IHC sink in chalk, since we
have made another IHC close to tendered temporary-item). Meanwhile, with
coincidence of uttaranchal meet and a couple of other things, the stay on
a tender issued by The-Best is helping elsewhere.
